Successful tenderer are to get his establishment registered under the Act "The building& others construction worker's welfare cess Act,1996" and rules made there under from theregional labour offices and follow various provisions of they Act.As per Finance Deptt.'s no. 6895-F dt.I1.09.06 no payment will be made withoutdeduction of the cess @l % (one Percent) of the cost of construction to be executed.The Authority reserves the right to reject the lowest Tender / all the Tenders withoutassigning any reason whatsoever.Soecial terms & Conditions: -'\1) RIDF norms to be followed. /2) Defect liabilitYperiod tbTeeyears after satisfactory completion of the work.3) 5% of the contract price as performance security to be deposited by the' successfultenderer in form of bank guarantee in favour of Howrah Zilla Parishad from anationalized bank within seven days from the date of issuance of the acceptanceletter.4) The tenderer have to possess suitably qualified technical persons as includinglaboratory technicians for smooth execution of the works. .5) The tenderer must have the availability of the following equipments/ machinery of hisowned / leased or on hire:-a) (i) Static Roller(ii) Vibrator Roller(iii) Mini hot mix plant(iv) Concrete mixer(v) Earth compactor machine and other machineries as perrequirement.b) Field laboratory including laboratory equipments for quality control of roadworks.6) Failure of the successful tenderer to comply with the requirement of 5% of thecontract price as performance security to be deposited by the successful tenderer inform of bank guarantee in favour of Howrah Zilla Parishad.from a nationalized bankshall constitute sufficient grounds for cancellation of the said tender & forfeiture ofthe earnest money. He will also be debarred from participating any tender under HZPfor one (1) year.7) The contractor shall not be allowed to sub contract to any part of the works or thewhole of the works.8) All risks of loss of or damage to physical property and of personnel injury and deathwhich arise during and in consequence of the performance of the contract are theresponsibility of the contractor.9) The contractor shall be responsible for the safety of all activities on the site.10) Anything of historical or other interest or of significant value unexpectedlydiscovered on the site shall be the property of the HZP. The contractor shall notify theEngineer-in-Charge of this project of such discoveries & caIT)'outthe instruction ofEngineer-in-Charge for dealing 'withthem.11) The Engineer-in-Charge may issue notice to the contractor to carryout works ofdefects, if any, noticed in his inspection or brought to his notice. The contractor shallremove the defects within the period specified in the notice and submit to. theEngineer-in-Charge a compliance report.12) Payments in respect of works, already executed as per specification shall be made onreceipt of satisfactory test results made by the contractpf13) If the contractor has not corrected a defect pertaining to the defect liability period ofthe condition of the contract to the satisfaction of the Engineer-in-Charge within thetime specified in the Engineer-in-Charge's notice, the Engineer-in-Charge will assessthe cost of having the defect corrected and the contractor will pay this amount orcorrection of the defect, which will be adjusted from the security deposit and/orperformance security kept on his behalf.
