24(C) The payment shall be made by Office of Manager (F&A), GAIL,Usar.(D) The bill’s shall be submitted in computerized form in triplicate,along with the floppy. Security deposit shall be deducted as per clauseNo. 12.0 of SCC.33. CONSTRUCTION WATER AND POWER:-Free water and electricity shall be given by GAIL, at one location. Thecontractor shall make his own arrangement for connection &distribution etc. at his own cost.34. In case of any accident, injury, death caused to the any employee ofcontractor while executing the work under the contract, thecontractor shall solely be responsible to pay the adequatecompensation, insurance money etc. to the next kith & kin of thatinjury or dead taken. The contractor undertakes and Indemnify ownerfrom such liabilities.35. The contractor also undertakes to obtain insurance cover policiescovering all risks which may arise out of the execution of work underthe contract. The contractor will pay the insurance premium to theinsurance company from time to time against the insurance coverpolicy taken for his employees including third party.36. In case of any disputes which may arise out of the any meaning,interpretation of any term and condition of contract, the same shall bereferred to sole Arbitrator i.e. OIC of Pata or its nominee. Thedecision of Sole Arbitrator shall be final & binding on both the partiesto the contract i.e. contractor & Owner. The Arbitration proceedingsshall be governed under the Indian Arbitration & Conciliation Act,1996 and venue of Arbitration proceedings shall be at Pata.37. In case of court case, the contractor here agrees that the court ofagreeing shall only have the Jurisdiction to entertain such matter.38. The contractor shall not engage or deploy any person having acriminal record. If at any stage found, such person is executing thework, by order will terminate the contract or advise the contractor tochange that Labour.
