2129. COMPLETION CERTFICATEWithin one month of the completion of work in all respect, thecontractor shall be furnished with a certificate by the Engineer-In-Charge of such completion, but no certificate shall be given nor shallthe work be deemed to have been executed until all surplus materialsand rubbish is cleared off the site completely nor until the work shallhave been measured by the Engineer-In-Charge whose measurementshall be binding and conclusive. The works will not be considered ascomplete and taken over by the owner, until all the temporary works,labour and store and colonies etc. constructed are removed and thework site cleared to the satisfaction of the Engineer-In-Charge.If the contractor fails to comply with the requirements of this clauseon or before the date fixed for the completion of the works, theEngineer-In-Charge may at the expenses of the contractor removesuch, surplus materials and rubbish and disposal off the same as hethinks fit and clean off.Such dirt as aforesaid, and the contractor shall forthwith pay theamount of all expenses incurred and shall have no claim in respect ofany such surplus materials as aforesaid except for any such actuallyrealized by the sale thereof.30. COMPLIANCE WITH LABOUR/INDUSTRIAL LAWS(a) The contractor (which shall include the Contractingfirm/company) shall be solely liable to obtain and to abide byall necessary licensees/permissions from the concernedauthorities as provided under the various Labour Lawslegislations including labour license from the competentauthority under the contract Labour (Registration & Abolition)Act 1970.(b) The contractor shall also be bound to discharge obligations asprovided under various statutory enactments including theEmployees Provident Fund & Miscellaneous Act, 1952, ESI Act1948, Contract Labour (Regulation and Aboloation) Act 1970,Minimum Wages Act 1948, Payment of Wages Act 1936,Workmen’s Compensation Act 1923 and other relevant ActsRules and Regulations enforced from time to time.(c) The contractor shall be responsible for necessary contributionstowards PF, Family Pension, ESIC, or any other statutorypayment to Government agencies as applicable under the law in
22respect for the contract and of personnel employed by thecontractor for rendering service to GAIL, shall deposit therequired amounts with the concerned statutory authorities onor before due dates. Each contractor shall obtain a separateP.F. Number from the concerned Regional Provident FundCommissioner and submit necessary proof of having depositedthe employees as also the employer’s contributions to theProvident Fund. The contractor shall also be responsible forpayment of any administration / inspection charges thereof,wherever applicable, in respect of the personnel deployed byhim relating to the work of GAIL.(d) The contractor shall regularly show all relevant records /documents in this regard to GAIL representative to release thepayments withheld.(e)(f)(g)(h)(i)(j)(k)The contractor shall ensure and will be solely responsible forpayment of wages and other dues latest by 7 th of the followingmonth to the personnel deployed by him. The contractor shallbe directly responsible and indemnify the company against allcharges, claims, dues etc. arising out of disputes relating to thedues and employment of personnel deployed by him.The contractor shall indemnify the Company against all lossesor damages caused to it on account of acts of the personneldeployed by the contractor.The contractor shall ensure regular and effective supervision ofthe personnel deployed by him.The personnel deployed by him must be in the muster roll of thecontractor.The personnel to be deputed by the contractor shall observe allsecurity , safety, fire rules of GAIL while at site. This work willbe supervised by the supervisor of contractor. The contractorhas to strictly adhere to guidance, instruction of EIC from timeto time.Contractor shall provide proper identification card for hispersonnel to be deputed by him for work duly signed by him orhis authorized representative. Also the contractor has to obtainentry passes from CISF through EIC for his employees.All personnel proposed to be deployed by the contractor shall bemedically examined by qualified medical practitioner and it
