167. LOCATION AND SITE CONDITIONS7.1 The work has to be done on the buildings of LPG recovery plant usar. The site located near Usar village about 13 km from Alibag town onAlibag – Raha road and about 120 Km south of Mumbai by road.7.2 The contractor deemed to have inspected the site thoroughly andacquainted himself with the site conditions, availability of storage formaterials, work areas available for construction, disposal / stackingof surplus earth from excavation of all kinds of soil/ rocks andacquainted himself with the general nature of the site , sub soil watertable and its other features likely to affect his tender and theconstruction of the works. No claim/ extension of time whatsoevershall be entertained on account of prevailing site conditions.8. TIME SCHEDULETotal period of contract for this work will be for 120 days (4 Months)to be reckoned from 7 th day from the date of issue of letter of award.Time is the essence of the contract and as such as every effort shouldbe make to complete the work within prescribed time period for theexecution of the work as contemplated under this contract. GAILreserves the right to terminate the contract without assigning anyreason during the currency of the contract period by giving 30 daysnotice to the contractor.10. LIQUIDATED DAMAGESTime is the essence of CONTRACT. In case the CONTRACTOR fails tocomplete the work within the stipulated period, then unless suchfailure is due to Owner’s defaults, the CONTRACTOR shall pay to theOWNER, by way of compensation for delay and not as penalty, a sum@ 0.5 % of the VALUE OF CONTRACT for delay per week on pro-rataor part thereof subject to a maximum of 5 % (Five percent) of theVALUE OF CONTRACT.The decision of the Engineer-In-charge in regard to applicability ofCompensation for delay shall be final and binding on theCONTRACTOR.
