1 General Conditions1.1 Definitions‘MFT’ means <strong>Malta</strong> <strong>Freeport</strong> <strong>Terminals</strong> Limited.‘<strong>Malta</strong> <strong>Freeport</strong> Authority’ (the Regulator) is <strong>Malta</strong> <strong>Freeport</strong> CorporationLimited as set out under the provisions of the <strong>Malta</strong> <strong>Freeport</strong>s Act.‘Terminal Operator’ means MFT.‘User’ includes any person, corporation, vessel owner, operator orcharterer, company or body of persons, or hauler who visits the premises ofthe Terminal Operator, and who delivers, collects or handles any goods orequipment howsoever being on such premises.‘Cargo’ includes goods of any description whatsoever, together with itspacking, casing, pallets or any fitting or attachment that carries, supports,contains or protects such goods.‘Equipment’ includes any vehicle, trailer, cargo-handling machinery orcontainer.‘The <strong>Terminals</strong>’ mean <strong>Malta</strong> <strong>Freeport</strong>’s Terminal One and Terminal Two asdefined in the <strong>Malta</strong> <strong>Freeport</strong>s Act Chapter 334 of the Laws of <strong>Malta</strong>.‘Day’ means a calendar day and unless otherwise indicated commences atmidnight for a period of 24 hours.‘Storage Period’ means that the first calendar day of the storage period isthe day of receipt of the cargo or container in the <strong>Terminals</strong>. The last day isthe day of loading to vessel or exit through the Main Gate.‘Free Storage Period’ refers to the number of calendar days, starting withday one of the storage period, for which no storage charge is applicable.‘Vessel’ stands for any ship or carrier calling at <strong>Malta</strong> <strong>Freeport</strong> <strong>Terminals</strong>.‘Container’ refers to a standard ISO 20 foot, 40 foot, or 45 foot long box,including flat racks, platform and tank containers.‘Containership’ means any ship, including feeder ships, employed for thecarriage of containers, but excluding Ro-Ro containerships.‘Ro-Ro containership’ is a specific containership employed for the carriageof containers that are loaded and discharged on a roll-on and roll-off methodwhich cannot be handled by a quay crane.‘Operations Manual’ is the document containing the requisites, proceduresand information required by the Terminal Operator from all interested/relevantparties as published and amended from time to time by the TerminalOperator.1.2 Alterations to <strong>Tariff</strong>The Terminal Operator reserves the right to alter, change or amend from time totime any or all charges, terms, conditions or interpretations contained in this<strong>Tariff</strong> with or without prior notice excluding the ‘Regulated Service ProviderCharges’ listed in Section 6 – Domestic Cargo.1


1 General Conditions1.3 Operations ManualThis <strong>Tariff</strong> is subject to the Operations Manual of the Terminal Operatorexcept where specifically superseded and amended herein or as otherwiserevised from time to time.1.4 JurisdictionThe Terminal Operator is the exclusive licensed operator of the <strong>Terminals</strong> basedon a license granted by the <strong>Malta</strong> <strong>Freeport</strong> Authority. The rights and powers ofthe Terminal Operator under these general conditions are in addition to thoseprovided by the <strong>Malta</strong> <strong>Freeport</strong>s Act and by any legal notice(s) promulgated bythe Government of <strong>Malta</strong>.1.5 ConditionsThe use of the <strong>Terminals</strong> shall constitute unconditional acceptance of andagreement to the terms and conditions of the <strong>Tariff</strong> as specified hereinafter.Evidences agreement on the part of all vessels, their owners, operators,charterers, mortgages or agents, the cargo owners (shippers or consignees)and other users of the <strong>Terminals</strong>, to pay all charges specified and to begoverned by all rules and regulations contained herein and such noticesissued at any time by MFT and/or <strong>Freeport</strong> Authority.1.6 ApplicationThe application and interpretation of the <strong>Tariff</strong>, its rates, rules and regulationsshall be at the sole discretion of the Terminal Operator.1.7 Access to RecordsWhen required by the national authorities or by law, MFT shall have the right torequest all vessels and all other users, having cargoes passing through the<strong>Terminals</strong> to permit access to manifests of cargo and all other documents. Thisis required for the purpose of audit and verification to ascertain the correctnessof reports filed and the assessment of charges. Any such information soacquired shall not be disclosed to any person other than MFT in the execution oftheir official duties.2


1 General Conditions1.8 RepresentationAll lines and vessels calling at the <strong>Terminals</strong> must be represented by alicensed ship agent based in <strong>Malta</strong>. It is a prerequisite that at all times when avessel is operational at the <strong>Freeport</strong>, the line(s) will have a representative oncall who is of sufficient seniority and able to take decisions related to shipworkwithout reference. Vessels shall authorise their ship agents to represent them inall matters including in legal proceedings unless another person has been soappointed and notified to MFT.1.9 Terminal Operator held HarmlessEach vessel owner, operator or charterer whose vessel calls at MFT and eachowner of cargo handled there, as a condition of receiving services at the<strong>Terminals</strong>, hereby agrees to indemnify and save harmless the TerminalOperator (any other person, firm or corporation engaged by the TerminalOperator to furnish labour, materials or equipment relating to the receipt orhandling of unit loads or containers, their cargoes and or vessels at the<strong>Terminals</strong>) from and against all losses, claims, demands and suits for damages,(including court costs and counsel fees) for death or personal injury or propertydamage that may be imposed upon the Terminal Operator or any of its agents,servants, employees or contractors as a consequence of services received bythem at the <strong>Terminals</strong>.1.10 Terminal Operator’s RightsThe Terminal Operator reserves the right to schedule, control and perform theloading, unloading, and handling of all freight and cargo at the <strong>Terminals</strong>. Italso reserves the right to order the shifting of any vessel from one berth toany other position and such shifting should be at the expense of the line orvessel being shifted.1.11 Damage to <strong>Terminals</strong>All users of the <strong>Terminals</strong>, or their agents, shall be responsible for anydamage resulting from their use of the piers, wharves, docks and otherfacilities. The Terminal Operator shall reserve the right to repair, or otherwisecause to be repaired, all such damage at the expense of such users.1.12 Hazardous CargoThe handling of dangerous or hazardous cargo within the <strong>Terminals</strong> shall be3


1 General Conditionsgoverned by the appropriate rules and regulations as specified by theInternational Maritime Organisation, the Laws of <strong>Malta</strong>, <strong>Malta</strong> MaritimeAuthority and any other competent authority.1.13 Objectionable CargoThe Terminal Operator reserves the right to refuse to handle any cargo orother material and the right to move it to another location. Any such move willbe notified to, and will be at the risk and expense of the owner of the cargo.1.14 InsuranceCharges published in this <strong>Tariff</strong> are exclusive of insurance coverage on thecargo, containers, vessels or other equipment since the Terminal Operatoraccepts no responsibility or liability for loss of or damage to the same.1.15 Notice of ArrivalThe lines should follow the procedures stipulated in the Operations Manual.1.16 Departure from Berth and right of MFT to Manage BerthsVessels must retain the ability to move from the berth at short notice. TheTerminal Operator must be notified in advance when any engine requiresrepairs or other activity which would temporarily incapacitate the vessel. Suchnotification shall be communicated to and approved by the Terminal Operator.On completion of shipwork the vessel must clear the berth within one hour orotherwise be removed at the expense of the line. The Terminal Operator maysuspend operations on a vessel at any time and for any reason and may alsorequest that a vessel be shifted from its place of berth. No liability shall beincurred by the Terminal Operator when exercising its powers under theprovisions of this clause.1.17 Waiting/ Non-Productive Time€672.004


1 General ConditionsThe above charge, per crane hour or part thereof, shall be raised against thevessel for:• Waiting/non-productive time arising from the fault of the vessel, its line oragent. The calculation shall be on an aggregate basis and shall commence fromthe agreed start of operations up to the actual completion of operations by theTerminal Operator.• Waiting/ Non-productive time arising when a line berths and works a vessel,with the intention to sail that vessel upon completion but, because of changedpriorities replaces the former vessel with another line's vessel.1.18 Postponement of Berthing / CancellationWhen it is decided to cancel or postpone berthing, advance notice of 24 hoursshall be given to the Terminal Operator otherwise the Operator reserves theright to raise a charge per crane hour of:€672.001.19 HealthNormal quarantine regulations apply. Should it be necessary, operations willonly commence as soon as pratique has been obtained from the Port HealthAuthorities.1.20 Customs<strong>Malta</strong> <strong>Freeport</strong> is operated within a free zone, and all goods handled at the<strong>Terminals</strong> may be subject to <strong>Freeport</strong> Authority, Customs and GovernmentRegulations as may from time to time be in force. All users shall be subject tosuch regulations, including the prompt securing of Customs pratique by theagent for each vessel on arrival. The Master of the vessel, or his designate,shall be required to declare on an appropriate form supplied by the TerminalOperator, whether or not the cargo to be discharged from the vessel onto the<strong>Terminals</strong> includes tobacco products and/or alcoholic spirits and to indicate,where applicable, in which container/s such tobacco products and/or alcoholicspirits are being held.5


1 General ConditionsAny charges raised by Customs in respect of their services will be recovereddirectly by Customs. The Terminal Operator may not be held liable and/ orresponsible for any delay in the handling of a container occasioned by anyrequest for inspection by the Customs of <strong>Malta</strong> irrespective as to whether suchrequest and inspection has been carried expediently or not.1.21 ImmigrationImmigration procedures must be followed as prescribed by the Laws of <strong>Malta</strong>.Shore leave is permitted for crew members provided that the ImmigrationAuthorities have given approval for entry and a list of names and nationalI.D./passport numbers have been supplied by the agent to the security gatestaff immediately after pratique has been issued.1.22 CurrencyAll tariff rates are stated in Euro and prices shown in LM have been convertedfrom the Euro price at the central parity rate of one euro = Lm0.4293 forinformation purpose only.1.23 Invoices and PaymentAll invoices are due on presentation. Failure to pay may cause a line to bedenied further access to the <strong>Terminals</strong> until all outstanding charges, withinterest, have been paid. This shall not prevent the Terminal Operator fromtaking alternative actions including the non-release of containers and anydamages raised by third parties for such non-release shall not be entertainedby the Terminal Operator but shall be assumed by the defaulting line orvessel.The Terminal Operator may at its sole discretion estimate and collect inadvance all charges that may accrue against cargo or vessels. Use of the<strong>Terminals</strong> may be denied until such advance charges have been paid.1.24 Port HealthThe provisions of the Port Regulations apply. Use of waste disposal servicesis compulsory.6


1 General Conditions1.25 Unclaimed GoodsThe Terminal Operator reserves the right to remove cargo upon which duesor charges remain unpaid. Such goods may be sold by public auction torecover costs on such dues and charges after a period of ninety days fromarrival in the Port, or less in the case of perishable cargo. The lines and cargoowners hereby exonerate the line from any responsibility and from any legalproceedings.1.26 Vehicle ConditionThe Terminal Operator reserves the right to refuse entry to, or to provideservices to, any vehicle not reaching, in the opinion of the Terminal Operator,appropriate EU safety standards.1.27 Identification CardAn identification card is required by all persons to be able to enter the<strong>Freeport</strong> zone. <strong>Malta</strong> <strong>Freeport</strong> Authority issues identification cards withbarcode strips which are also colour-coded to identify the areas to which thecardholder has access.1.28 Working Hours: VesselsThe Terminal is available to work vessels at any time with the exception ofthe following non-working times:• 31 December from 16:00 hours to 02 January 08:00 hours• Good Friday from 08:00 hours for 24 hours• 1 May from 08:00 hours for 24 hours• 15 August from 08:00 hours for 24 hours• 24 December from 12:00 hours to 26 December 08:00 hours1.29 Working Hours: Other WorkLandside services are provided between 07:30 hours and 16:00 hours from7


1 General ConditionsMonday to Friday. At all other times, these services can be supplied with theprior agreement of the Terminal Operator. Charges for services during theseother times are outlined in Section 3.3.9. The landside services are subjectto changes based on work exigencies by the Terminal Operator.1.30 Overtime Charges<strong>Tariff</strong> rates apply to all shipwork and landside operations, including hatch coversand restows, with the following qualifications whereby the overtime rates apply:• Domestic containers handled between 17:01 hours and 07:59 hours betweenMonday and Friday and between 12:01 hours Saturday and 07:59 hoursMonday as per charges stipulated in section 3.3• Transhipment containers handled between 17:01 hours Friday and 07:59hours Monday as per charges stipulated in section 3.3• Other chargeable work carried out between 17:01 hours Friday and 07:59hours Monday as per charges stipulated in section 3.3This supplement is not applicable for Main Gate moves during overtime asoutlined in Section 3.3.9.1.31 Restricted / Detained VesselsAny vessels that are either:• restricted from entering MFT for reasons beyond the Terminal Operator’scontrol, or• detained from sailing by any competent authoritywill be subject to charges for waiting/non-productive time as stipulated inSection 1.17.1.32 ISPS FeeDue to the requirements of the ISPS Code a security fee on only transhipmentcargo handled shall be charged to the respective container operator per twocontainer moves handled at the rate of:€6.838


2 Marine <strong>Services</strong>2.1 Vessel Reporting and ControlThe Ports Directorate of Transport <strong>Malta</strong> is responsible for all vesselmovements to and from Maltese ports. Notice of arrival of vessels isreceived at the Ports Directorate and vessels and their agents must complywith the Directorate’s instructions and procedures.2.2 PilotageArrangements must be made with the <strong>Malta</strong> Maritime Pilots.2.3 TugsArrangements must be made with the Tug Company.2.4 BunkersBarge or road tanker deliveries are available through arrangements made withship agents. All deliveries must have prior approval from the Terminal Operator.In this respect, ship agents and/or line representatives must advise the <strong>Malta</strong><strong>Freeport</strong> Security Department and the Operations Department 24 hours prior tobunkering operations taking place.2.5 ChargesThe services in Section 2.1 to 2.5 above are not provided by the TerminalOperator. The applicable charges will be determined by the suppliers.2.6 MooringMFT is fully responsible for providing mooring services at the <strong>Terminals</strong> as from1 st April 2011.9

During February, March and April, the meansea level in the central Mediterranean may fall as much as 0.5m below thenormal tidal range.2.9 Wharfage/ Lay-By Berth VesselsAll vessels calling at the <strong>Terminals</strong> will pay a wharfage charge per 24 hourperiod or part thereof as follows:€LOA up to 120 metres 875.00LOA 121 metres up to 200 metres 1250.00LOA in excess of 201 metres 1750.0011


2 Marine <strong>Services</strong>2.10 Fresh WaterFresh water is available only in small quantities. Barge or road tankerdeliveries are available through arrangements made with ship agents. Alldeliveries must have prior approval from the Terminal Operator.2.11 Cleanliness of QuayVessels are required to ensure that the quay area at which they are berthed isclean on their departure. Any refuse, paint, spillage etc. will be cleared orcleaned at the expense of the vessel's agent. The agents are fully responsibleto assure cleanliness of the sea. For any matters relating to this, the ship agentsare to co-ordinate with Transport <strong>Malta</strong> and/ or necessary contractors.2.12 Stowage charge by Vessel CommandWhen shifting is carried out during quayside operations by the request of thevessel’s officials or for vessel’s convenience, then this will be charged to thevessel agent as follows:On board (same bay)Via quay€70.35 per container85.05 per containerShifting will be undertaken only with prior notification to, and authorisationfrom MFT. ‘On board’ moves using the quay crane may be undertaken onlywithin the same bay. All other moves with the crane will be charged at the‘via quay’ rate.12


3 Container <strong>Services</strong> – Lo-Lo3.1 ConditionsThe charges quoted apply under the following conditions:• The vessel is a cellular containership.• The loading or discharge activity is not delayed or interrupted by cargowhich is not ready for handling.• Reporting and documentation is in accordance with the provisions of this<strong>Tariff</strong>, the Operations Manual and other Terminal Operator’s existing rules,regulations and procedures.• Transhipment containers arrive at the <strong>Terminals</strong> by sea and, withoutleaving the control of MFT or its nominees in the interim, are reloaded toa vessel at the <strong>Terminals</strong>.• Transhipment containers leaving or entering the <strong>Terminals</strong> by road willincur an additional charge.• Domestic containers are loaded to or discharged from a ship at <strong>Malta</strong><strong>Freeport</strong> and move once through the Main Gate at the <strong>Terminals</strong>.• Secondary handling of containers will be subject to an additional charge.• Lashing gear should be provided by the vessel and should be of the quickrelease type. Additional charges as per point 1.17 will apply if lashing gearis not as specified.A surcharge of 50% on lo-lo rates will be raised on container movescarried out on non-cellular vessels.3.2 Scope of <strong>Services</strong>This Section outlines the charges for services given in each category includingthe supply of labour, use of cranes and other equipment as following:DischargeLoadDirect DeliveryLift from the vessel and transfer to the yard.Transfer from the yard and placed on the vessel.Lift from the vessel and transfer under the cranedirectly to the external trailer at the TerminalOperator’s sole discretion.13

4 General and Bulk Cargo4.1 ConditionsGeneral or bulk cargoes will be handled at the <strong>Terminals</strong> either astranshipment or domestic traffic under the following conditions:• The agent has provided adequate and accurate prior information aboutthe cargo and has made prior arrangements for it to be handled.• The cargo on arrival at the <strong>Terminals</strong> is found to be in a fit state to behandled and that access on the vessel for that purpose is sufficient.• Standard and specialist cargo handling gear on the vessel is madeavailable without charge to the Terminal Operator.• Vessel's gear, when provided for use, must be adequate to handle thecargo, and may be subject to the Terminal Operator's inspection.
