400.1.22university without a copy of a signed contract regarding his/her services to be performed forECSU in exchange for payment from ECSU.11. Prior to ECSU’s Chancellor signing any contractual agreements over $5,000, the agreementwill be reviewed by ECSU’s Legal Counsel.12. After the contract is signed and/or a purchase order is issued, the complete procurement file(with the exception of proprietary or confidential information) is available for publicinspection.ConfidentialityAll information and documentation relative to the development of a contractual document(Request for Quotes, Request for Proposals, Waiver of Competition, Negotiation, etc.) for aproposed procurement or contract shall be deemed confidential in nature, except as deemednecessary by the purchase to develop a complete contractual document. Such material shallremain confidential until the award of contract.This includes all information and documentation relative to the development of a specificationuntil the adoption of that specification or an award of contract if developed for a specificprocurement or contract, which ever is later.During the period of evaluating offers and prior to the award, possession of offers andaccompanying information shall be limited to those in using agencies who are responsible forparticipating in the evaluation and to persons in the North Carolina Division of Purchase andContract. After award of the contract, the complete file shall be available to any interested personwith the exception of trade secrets, subject to the following Rules:1) To promote maximum competition and to protect the public competitiveprocedure from being used to obtain information which would normally not beavailable otherwise, agencies may maintain the confidentiality of certain typesof information. Such information includes trade secrets, as determined byNorth Carolina law, and like information as the <strong>State</strong> Purchasing Officer maydetermine to insure the integrity of the public purchasing process. Tradesecrets which the offeror does not wish disclosed shall be identified as follows:Each page shall be identified in boldface at the top and bottom as“CONFIDENTIAL”. Cost information shall not be confidential.2) Certain award information, as determined by the North Carolina <strong>State</strong>Purchasing Officer, may be deemed confidential due to the nature of thepurchase (Example: law enforcement surveillance equipment.)
