8. Subsequently when <strong>the</strong> <strong>in</strong>spect<strong>in</strong>g authorities <strong>of</strong> <strong>the</strong><br />

Forest Deptt. undertook a verification <strong>of</strong> <strong>the</strong> seized iron ore<br />

on 2.6.2010 it was detected that most <strong>of</strong> <strong>the</strong> seized iron ore<br />

was miss<strong>in</strong>g. About 2.0 lakh metric tonnes <strong>of</strong> iron ore was<br />

found to be available while <strong>the</strong> rema<strong>in</strong><strong>in</strong>g quantity <strong>of</strong> about<br />

6.0 lakh metric tonnes was found to have been stolen. The<br />

Forest Deptt. filed a compla<strong>in</strong>t before <strong>the</strong> JMFC, Ankola<br />

aga<strong>in</strong>st <strong>the</strong> Port Conservator, Belikeri Port, Stevedores and<br />

o<strong>the</strong>rs and F.I.R. No. 189 dated 8.6.2000 has been<br />

registered aga<strong>in</strong>st <strong>the</strong> Port Conservator under Section 406 <strong>of</strong><br />

<strong>the</strong> I.P.C. A compla<strong>in</strong>t has been filed before <strong>the</strong> Chief<br />

Vigilance Commissioner, New Delhi aga<strong>in</strong>st <strong>the</strong> Customs<br />

Officer. Writ Petitions (Crim<strong>in</strong>al) were filed before <strong>the</strong><br />

Hon’ble Karnataka High Court on 14.6.2010 aga<strong>in</strong>st <strong>the</strong><br />

<strong>of</strong>fence case registered by <strong>the</strong> Forest Deptt. The Hon’ble<br />

Karnataka High Court on 25.6.2010 granted a stay on fur<strong>the</strong>r<br />

<strong>in</strong>vestigation by <strong>the</strong> Forest Deptt. The <strong>writ</strong> <strong>petition</strong>s were<br />

subsequently dismissed by <strong>the</strong> Hon’ble High Court on<br />

2.11.2010. The <strong>in</strong>vestigations by <strong>the</strong> Forest Deptt. rema<strong>in</strong>ed<br />

suspended from July, 2010 onwards because <strong>of</strong> <strong>the</strong> stay<br />

granted by <strong>the</strong> Hon’ble Court and subsequently on <strong>the</strong><br />

ground <strong>of</strong> non-availability <strong>of</strong> certified copy <strong>of</strong> <strong>the</strong> High Court<br />

order. The <strong>writ</strong> <strong>petition</strong>s filed by <strong>the</strong> various exporters for <strong>the</strong><br />

release <strong>of</strong> <strong>the</strong> seized iron ore have been dismissed by <strong>the</strong><br />

Hon’ble High Court on 3.11.2010.<br />
