which <strong>the</strong> diversion <strong>of</strong> 105.22 hectares <strong>of</strong> forest land for<br />

renewal <strong>of</strong> <strong>the</strong> m<strong>in</strong><strong>in</strong>g lease <strong>in</strong> favour <strong>of</strong> M/s<br />

Lakshm<strong>in</strong>arayana M<strong>in</strong><strong>in</strong>g Company was granted by <strong>the</strong><br />

MoEF is enclosed at ANNEXURE-R-58 to this Report. From<br />

<strong>the</strong> approval granted by <strong>the</strong> MoEF it is seen that it was<br />

treated as a case <strong>in</strong>volv<strong>in</strong>g violation <strong>of</strong> <strong>the</strong> FC Act and for<br />

which penal compensatory afforestation over <strong>the</strong> degraded<br />

forest land twice <strong>in</strong> extent <strong>of</strong> <strong>the</strong> area to be broken afresh<br />

was imposed. The approval under <strong>the</strong> FC Act was co-<br />

term<strong>in</strong>us with <strong>the</strong> period approved under <strong>the</strong> MMRD Act.<br />

The rema<strong>in</strong><strong>in</strong>g area <strong>of</strong> 70.41 hectare out <strong>of</strong> <strong>the</strong> total lease<br />

area <strong>of</strong> 175.63 hectares along with reclamation charges <strong>of</strong><br />

Rs.6.05 lakh towards construction <strong>of</strong> check dam, gully<br />

check, afforestation broken <strong>of</strong> natural re-generation and<br />

sow<strong>in</strong>g <strong>of</strong> seeds, etc. was handed over to <strong>the</strong> Forest<br />

Department on 15.12.2000. S<strong>in</strong>ce <strong>the</strong> approval under <strong>the</strong> FC<br />

Act was accorded for lesser forest area than <strong>the</strong> forest area<br />

<strong>in</strong>cluded <strong>in</strong> <strong>the</strong> m<strong>in</strong><strong>in</strong>g lease, <strong>the</strong> lease deed executed by <strong>the</strong><br />

lessee should have been accord<strong>in</strong>gly modified. However that<br />

does not appear to have been done. After <strong>the</strong> expiry <strong>of</strong> <strong>the</strong><br />

m<strong>in</strong><strong>in</strong>g lease period <strong>of</strong> <strong>the</strong> first renewal on 20.5.2003, <strong>the</strong><br />

MoEF vide letter dated 8.5.2003 granted temporary work<strong>in</strong>g<br />

permission over already broken area (enclosed at<br />

ANNEXURE-R-59 to this Report). The formal approval under<br />

<strong>the</strong> FC Act for second renewal <strong>of</strong> m<strong>in</strong><strong>in</strong>g lease over 105.22<br />
