<strong>the</strong> purported ground that <strong>the</strong> Indian Bureau <strong>of</strong> M<strong>in</strong>es and<br />

<strong>the</strong> Survey <strong>of</strong> India are not cooperat<strong>in</strong>g to ensure early<br />

completion <strong>of</strong> <strong>the</strong> survey work.<br />

5. The CEC is <strong>of</strong> <strong>the</strong> view that <strong>the</strong> m<strong>in</strong><strong>in</strong>g lease holders<br />

who were found to be <strong>in</strong>volved <strong>in</strong> illegal m<strong>in</strong><strong>in</strong>g /<br />

encroachment outside <strong>the</strong>ir m<strong>in</strong><strong>in</strong>g lease areas should not<br />

have been allowed to cont<strong>in</strong>ue m<strong>in</strong><strong>in</strong>g. If <strong>the</strong>re was any<br />

doubt about <strong>the</strong> extent <strong>of</strong> illegality committed by <strong>the</strong>m, <strong>in</strong><br />

such cases <strong>the</strong> extent <strong>of</strong> encroachment and illegal m<strong>in</strong><strong>in</strong>g<br />

should have been determ<strong>in</strong>ed expeditiously. Exemplary<br />

punitive action should have been taken aga<strong>in</strong>st <strong>the</strong> lease<br />

holders <strong>in</strong>volved <strong>in</strong> illegal m<strong>in</strong><strong>in</strong>g and encroachment. In<br />

stead, rely<strong>in</strong>g upon <strong>the</strong> Hon’ble High Court orders, which<br />

have been given on <strong>the</strong> basis <strong>of</strong> <strong>the</strong> statements made by <strong>the</strong><br />

State <strong>of</strong> Karnataka, <strong>the</strong> m<strong>in</strong><strong>in</strong>g operations have been<br />

allowed to cont<strong>in</strong>ue unabated and seized vehicles, tools and<br />

mach<strong>in</strong>ery have been returned to <strong>the</strong> err<strong>in</strong>g lease holders.<br />

No effective steps have been taken to verify <strong>the</strong> extent <strong>of</strong><br />

illegal m<strong>in</strong><strong>in</strong>g. Effective follow-up action on <strong>the</strong> Report <strong>of</strong> <strong>the</strong><br />

Lokayukta has not been taken. This is a most undesirable<br />

state <strong>of</strong> affairs particularly consider<strong>in</strong>g that illegal m<strong>in</strong><strong>in</strong>g has<br />

been tak<strong>in</strong>g place on a large scale <strong>in</strong> Karnataka. The<br />

<strong>in</strong>action on <strong>the</strong> part <strong>of</strong> <strong>the</strong> State Government has fur<strong>the</strong>r<br />

encouraged illegal m<strong>in</strong><strong>in</strong>g <strong>in</strong> <strong>the</strong> State.<br />
