3. Similar directions have been passed by <strong>the</strong> Hon’ble<br />
High Court <strong>in</strong> all o<strong>the</strong>r cases where<strong>in</strong> forest <strong>of</strong>fence cases<br />
have been registered by <strong>the</strong> Karnataka Forest Department. It<br />
is seen that <strong>the</strong> directions have been passed by <strong>the</strong> Hon’ble<br />
High Court regard<strong>in</strong>g <strong>the</strong> cont<strong>in</strong>uation <strong>of</strong> m<strong>in</strong><strong>in</strong>g operations <strong>in</strong><br />
<strong>the</strong> lease area, return <strong>of</strong> <strong>the</strong> seized vehicles, tools and<br />
mach<strong>in</strong>ery to <strong>the</strong> m<strong>in</strong><strong>in</strong>g lease holders, re-survey by <strong>the</strong><br />
Deputy Conservator <strong>of</strong> Forest <strong>in</strong> <strong>the</strong> presence <strong>of</strong> m<strong>in</strong><strong>in</strong>g<br />
lease holders, <strong>the</strong> representatives <strong>of</strong> <strong>the</strong> Indian Bureau <strong>of</strong><br />
M<strong>in</strong>es and <strong>the</strong> Survey <strong>of</strong> India after a statement <strong>in</strong> this<br />
regard was made by <strong>the</strong> Learned Advocate General<br />
appear<strong>in</strong>g for <strong>the</strong> State <strong>of</strong> Karnataka.<br />
4. The State <strong>of</strong> Karnataka has allowed <strong>the</strong> m<strong>in</strong><strong>in</strong>g<br />
operations to cont<strong>in</strong>ue <strong>in</strong> respect <strong>of</strong> all <strong>the</strong> m<strong>in</strong><strong>in</strong>g leases<br />
where<strong>in</strong> illegal m<strong>in</strong><strong>in</strong>g and encroachments were found by <strong>the</strong><br />
Lokayukta, Karnataka. The survey <strong>of</strong> <strong>the</strong> m<strong>in</strong><strong>in</strong>g lease areas<br />
has been completed only <strong>in</strong> respect <strong>of</strong> <strong>the</strong> seven m<strong>in</strong>es. The<br />
details <strong>of</strong> <strong>the</strong> f<strong>in</strong>d<strong>in</strong>gs <strong>of</strong> <strong>the</strong> survey are given <strong>in</strong> <strong>the</strong><br />
statement at ANNEXURE-R-55 to this Report. It may be<br />
seen that <strong>in</strong> six cases, <strong>the</strong> encroachment / illegal m<strong>in</strong><strong>in</strong>g has<br />
been confirmed while <strong>in</strong> only one case where<strong>in</strong> <strong>the</strong><br />
Lokayukta had <strong>report</strong>ed encroachment <strong>of</strong> 0.64 hectare, no<br />
encroachment has been found. The survey work <strong>in</strong> respect<br />
<strong>of</strong> <strong>the</strong> o<strong>the</strong>r cases has not been undertaken / completed on<br />
