2Message from the DeanIt is my pleasure to introduce our Honor Roll of Donors. Thismessage is my first formal opportunity as dean of Southwesternto thank those who support the law school. I have already had thepleasure of meeting many of those listed in these pages, and I lookforward to getting to know many more in the coming months andyears. We are very grateful for the loyalty and supportacknowledged throughout this publication. The first purpose of this message therefore is simply to say thankyou to our donors for their generous contributions. My other purposes look toward the future. I hope as dean toparticipate in activities at Southwestern that will multiply thereasons for our donors to invest in this school. Our history is rich.We led the way especially in educating deserving individuals whootherwise were precluded from pursing a legal education. Ourgraduates can be found in all areas of the legal profession, inbusiness, and in the government. The numbers in governmentand the judiciary are especially striking. Our task in the future is to build on our historical mission whilemoving the law school to the forefront of legal education. Thereis much we can do in terms of curricular innovation, in findingresources for increased financial aid, in recruiting topnotch facultywhose research and teaching will fit the Southwestern mission, and in building an environment that maximizes the chances forour students to pass the bar exam and successfully navigate therapidly changing legal world. We need the help of our friendslisted in these pages to succeed in our ambitions. We need the help of others as well. To our loyal core ofsupporters, therefore, I want to make one further point. Weare reaching out with numerous receptions, individual and groupmeetings, written communications, and other means to recruitfriends and classmates into the enterprise of helping Southwesternto realize its great potential. With the help of our core group,we hope in a few years that we will be able to look back on thispublication as the starting point for a major reinvestment in allaspects of Southwestern Law School – with major beneficialconsequences for our students and the communities thatthey serve.Sincerely,Bryant G. GarthDean

3Honor Roll of DonorsThe publication of Southwestern’s Honor Roll ofDonors is a tribute to our alumni and friends whosecontributions were received between July 1, 2004 andJune 30, 2005. These generous gifts underlie thecontinued development of the law school and itsgrowing recognition as an institution of excellence, asdemonstrated so clearly in the academic achievementsof its students and the lives and careers of its alumni.Such recognition also illuminates the value of aSouthwestern education to colleagues in the legalprofession, clients and the public. For many benefactors, a sense of gratitude is the firstinspiration for their gift. But there are many others, andsome have chosen more than one avenue for theirgiving. Among them:•to honor or memorialize a family member orfriend, especially one who has been associatedwith the school;•to provide support to the library or specific academicor cocurricular programs;•to encourage financially needy students, a particulargroup of students, or interest in a special area of law;or•to help provide a solid future for the new generationof legal professionalsThe result is an outpouring of generosity in the formof gifts and endowments that support scholarshipprograms, technology, capital improvements, librarycollections, lecture series, and professorships.Whatever the reason for giving, the focus or size ofthe gift, the entire law school community extends itsgratitude to each donor. Yours is an investment inthe future through the next generation ofSouthwestern graduates.Note: While every effort has been made to ensure the accuracy of these records, readers areencouraged to notify the Development Office (213.738.6814; development@swlaw.edu)regarding any corrections or additions. Gifts received after June 2005 will be acknowledged ina subsequent donor report.GIVING LEVELSFounders$25,000 and aboveThomas L. Driscoll & NancyE. QuinnEstate of Calvin & VivienneHelgoeShinaan S. 26Planned Giving Opportunities at SouthwesternOver the years, a number of alumni and friends have asked what they can dofor Southwestern above and beyond their annual support. While many mightlike to make substantial charitable gifts in their lifetime, they have concerns aboutthe financial uncertainties that may be encountered during the remainder of theirlives. “Planned Giving” accomplishes the long-term support of Southwestern whileoffering significant tax advantages and a financially secure future.Benefits of Planned Giving The following are brieffor donors:explanations of some• Significant tax benefits while of the most popular plannedmaintaining financial security gifts using Southwestern asfor them and their families. the charitable beneficiary.• The ability to make a larger giftthan might otherwise beAppreciated Propertypossible. This includes gifts of stocks, bonds,• The opportunity to establish real estate, or other appreciateda permanent memorial to a assets that cause capital gains torelative, friend or in one’sbe realized when the asset is sold.own name.By giving the asset to charityinstead of selling it, capital gainsBenefits of Planned Giving tax can be avoided.for Southwestern:• A lifelong relationshipLife Insurancewith donors. Most people purchase life• An enhanced capability toinsurance policies to protectundertake large-scale projects themselves and their loved ones, such as scholarship and loan often at a time when their estatefunds, new facilities andis small. They want to make sureequipment, the Law Library, their beneficiaries receive fundsfaculty chairs and supportimmediately. Long-standingfor other aspects of theinsurance policies are sometimesacademic program.no longer necessary where• An occasion to recognize the substantial other investments andgenerosity of donors, through benefits will yield a good incomethe naming of funds or projects for the family after the donor’swhich will live on in the donor’s lifetime. Life insurance could behonor or in memory of another. the most sensible way for donorsto make a significant charitablegift and take advantage of anumber of benefits:• The donor can get a taxdeduction. By namingSouthwestern as the beneficiary, the donor may receive avaluable income tax charitablededuction and reduce the size oftheir taxable estate. A gift of lifeinsurance also reduces the “bite”from estate taxes — proceedsfrom the policy will be fullyexcludable from the estate.• The donor’s income won’t bereduced. Unlike a gift of anincome-producing asset, a giftof an insurance policy won’treduce current income.• The donor’s cash flow mayincrease. If the donor stopspaying the policy premiums, they will enjoy an increase inspendable income. Or if theycontinue paying the premiumson a policy donated toSouthwestern, the donor isallowed an annual income taxdeduction. Life insurance ismore valuable than ever.By a gift of insurance toSouthwestern, donors can savetaxes and increase spendableincome. Such gifts are easilyarranged; ownership can betransferred without the expensesassociated with wills, codicils ortrust formation. In concert withthe donor’s financial advisors,Southwestern can help the donorlearn and evaluate how to get themost from a contribution in theform of life insurance.Charitable Lead TrustA lead trust is one created bya donor to pay income toSouthwestern during the trustterm, after which the corpus thenpasses either back to the donor orto another beneficiary. If the leadtrust is created during the donor’slifetime, an income tax deductionwill be allowed for the presentvalue of the income interestSouthwestern receives. If the leadtrust is instead testamentary, anestate tax deduction of the presentvalue of the income interest willbe allowed.Charitable Remainder TrustThe opposite of a lead trust, aremainder trust permits a donor, spouse and children to retain theincome from assets set aside nowin trust for Southwestern. The donor establishes a trust thatpays them and their spouse (orother income beneficiary) incomefor life, with Southwesternreceiving the corpus of the trustat the end of their lifetimes. The donor can receive either afluctuating income based on afixed percentage of the trust’sannual value (unitrust) or afixed income that is determinedat the creation of the trust(annuity trust).

27There is typically no income, giftor estate tax payable on the initialtransfer of the assets to the trust.Furthermore, donors enjoy animmediate income-tax deductionbased on the present value of thegift that Southwestern will receiveat the end of the trust term. If theassets transferred to the trust haveappreciated since being acquired, then capital gains tax will also beavoided and the income taxdeduction will be based on thehigher, appreciated value of thatasset. An additional advantagemight be increased income if lowyieldproperty is donated and theproceeds are invested in higheryieldassets within the trust.Charitable Gift AnnuityThe Gift Annuity Programoffers a simple, secure andrewarding way to support thefuture of Southwestern.Cash or other assets can betransferred to Southwestern’sannuity program to enjoyguaranteed regular payments forlife. The amount of each paymentis determined by the age(s) of theannuitant(s) when the annuity isinitially funded. Once the paymentsare determined, they remain fixedfor the annuitant’s lifetime.A gift annuity may also beestablished for someone in thedonor’s will. A donor can alsomake a gift now, and defer orpostpone the income until alater date.Doron M. Tisser ’81Attorney at LawThe payments will then be basedon the original contribution plusaccumulated interest. At the deathof the last annuitant, your giftcomes to Southwestern withoutthe delay of probate. The donor isentitled to a current income taxdeduction for the present value ofa gift to Southwestern, and part ofeach payment they receive willalso be tax-free. The donor is alsoable to avoid capital gains taxupon the transfer of an appreciatedasset to the program.Charitable BequestThe most widely used method forplanned giving is a bequest in aLast Will and Testament. Acharitable bequest may be in theform of cash, real estate, securities,or other property. There are severalways to provide for Southwesternby bequest:• A General Bequest of a specifieddollar amount or percentage ofthe donor’s estate.• A Specific Bequest of aparticular asset, such as a savingsaccount, stock, or real property.INSPIRED GIVING • TIMELESS GIFTS“I enjoy giving to Southwestern. I believe it’s important to show supportto the school that gave me my chance to establish a career. I would neverhave had the opportunities in my career if I had gone to any other school.I think there should be a continuing appreciation for that. And the bestway to show that appreciation is by donating – both financially and withtime and service. I know the school will put the money to its best use, whether it’s helping students with scholarships or improving the buildingsor updating equipment.”• A Contingent Bequest, if the Outright bequests, whatever theprimary beneficiaries fail to amount, are free from federal estatesurvive the donor.
