2. Payments: Payment of the Security Deposit shall be due at the time of sign<strong>in</strong>g to hold the hall for thedate of the event. The <strong>Rental</strong> Fee is due 21 days prior to the event date. If the date of your event is lessthan 21 days, the entire <strong>Rental</strong> Fee and Security Deposit is due at the time of sign<strong>in</strong>g this agreement.3. Food and Beverage. Renter may use any caterer of their choice.4. Alcohol- Malt beverages, w<strong>in</strong>e and ciders are the only alcohol beverages permitted. If any other alcoholbeverages (hard liquor) are discovered, the event will close immediately and the deposit will be forfeited.NCIM does not have an alcohol license. All alcohol service must be contracted by a licensed andapproved vendor. Serv<strong>in</strong>g or consumption of alcohol on the premise without a licensed bartender willresult <strong>in</strong> forfeiture of the entire Security Deposit ($200.00).(a) BY LAW, NO ONE UNDER 21 MAY CONSUME OR TASTE ALCOHOLIC BEVERAGES.Renter agrees and warrants that there shall be NO CONSUMPTION OF ALCOHOL BY PERSONSUNDER AGE 21. Further, Renter shall monitor all service, if any, of alcohol and specificallyacknowledges that Renter is solely liable for the consumption of any alcohol by any person on thePremises and that such liability shall extend to any aspect regard<strong>in</strong>g the consumption of alcohol.(b) A NCIM representative may ask guests for identification to verify age. NCIM reserves the right to askthe entire party to leave if (1) a m<strong>in</strong>or is consum<strong>in</strong>g alcohol; (2) an adult is provid<strong>in</strong>g alcohol to a m<strong>in</strong>or;or (3) a guest or guests appears <strong>in</strong>toxicated and refuses to leave the Premises.(c) All alcohol must be served by a pre-approved bartender and consumed INSIDE NCCC. No alcoholis permitted anywhere outside of the ma<strong>in</strong> build<strong>in</strong>g. This <strong>in</strong>cludes outside the front door, the park<strong>in</strong>g lot,and rear of build<strong>in</strong>g. Only packaged liquor may be consumed. No “punch”, “kool-aid” or any otherdr<strong>in</strong>ks mixed by anyone other than licensed bartenders is allowed.(d) Only persons hold<strong>in</strong>g the appropriate liquor licenses and permits and pre-approved by NCIM will beauthorized to dispense alcohol, and only from the bar area.5. Refund Policy. The Refund Policy for cancellations is as follows:At least 30 days before the event:If NCIM can re-book the date, then the <strong>Rental</strong> Fee and all deposits will be refunded, less a 20% servicecharge. If not, then the entire amount is non-refundable.Less than 30 days before the event:Non-Refundable6. Term of Event. All events <strong>in</strong>clud<strong>in</strong>g music must end NO LATER THAN 12:00 AM. All guests, renter,and vendors secured by renter SHALL VACATE THE PREMISES BY 12:30 A.M.7. Access to Banquet <strong>Hall</strong>. All events are on a “first-come first-served” basis. Set-up shall be <strong>in</strong>cluded <strong>in</strong>book<strong>in</strong>g time, unless other arrangements are made <strong>in</strong> writ<strong>in</strong>g directly with NCIM. All Renters, guests,caterers, musicians and vendors shall be out of the Banquet <strong>Hall</strong> one-half (1/2) hour after the event’sscheduled end<strong>in</strong>g time, unless prior arrangements have been made. A charge of $100.00 per hour, orportion thereof, shall apply for each hour the Banquet <strong>Hall</strong> is not cleared after an event.8. Renter Responsibility.(a) Renter agrees to be completely responsible for any and all damages which may occur, either as the8/1/2013 2 | P a g e


esult of accidents or <strong>in</strong>tentional acts of Renter, guests, and/or vendors secured by the Renter orNCIM(b) Renter warrants that he/she shall rema<strong>in</strong> ON THE CONFERENCE HALL PREMISES AT ALLTIMES dur<strong>in</strong>g the Usage Term.(c) Renter shall provide to NCIM certificates of <strong>in</strong>surance and bond<strong>in</strong>g for any vendor secured byRenter prior to event. The Renter shall furnish a proof of liability <strong>in</strong>surance certificate where<strong>in</strong> it addsNCIM to its liability policy through the use of an Additional Insured Endorsement. This certificate isdue to NCIM thirty (30) days before the scheduled event9. Indemnity. Renter covenants at all times to hold harmless NCIM and its agents from and aga<strong>in</strong>st allloss, liability, cost or damages that may occur or be claimed with respect to any person or persons,corporation, property or chattels, on or about the Banquet <strong>Hall</strong>, or to the property itself result<strong>in</strong>g fromany act done, or omission by or through the Renter, its agents, contractors, employees, <strong>in</strong>vitees, or anyperson on the Premises by reason of the Renter’s use or occupancy or result<strong>in</strong>g from Renter’s non-use,or possession of said property and any and all loss, costs, liability, or expense result<strong>in</strong>g there from; andat all times to ma<strong>in</strong>ta<strong>in</strong> said Banquet <strong>Hall</strong> Premises and the surround<strong>in</strong>g property, <strong>in</strong> a safe and carefulmanner.10. Miscellaneous.(a) All tables must be covered with l<strong>in</strong>ens or plastic table clothes.(b)No smok<strong>in</strong>g <strong>in</strong>side of any part of the hall or build<strong>in</strong>g facility.(c) Build<strong>in</strong>g is handicapped accessible.(d) There shall be no rice, confetti, birdseed, bubbles, etc, thrown or used <strong>in</strong> the hall or on the premises.Music must end by 12:00 AM. <strong>Hall</strong> must be clear of guests, caterer, and enterta<strong>in</strong>ment by 12:30 AM.11. Inspection. .Renter should <strong>in</strong>spect facility when they arrive and report any problematic situationsimmediately to NCIM. If you see a problem or situation that you feel you could be charged for later anddo not report it immediately, we will have no choice but to assume it occurred dur<strong>in</strong>g your rentalperiod.12. Cleanup. Clean up of NCCC will be completed no later than one-half (1/2) hour after the end of thescheduled time. Renter or its agent shall adhere to the follow<strong>in</strong>g <strong>in</strong>structions for clean-up of the facility.(a) Banquet <strong>Hall</strong>: Table trash, cups, plates, plastic ware, cake, food, decorations, etc. will be gathered andplaced <strong>in</strong> trash bags. All cups will be emptied <strong>in</strong>to the s<strong>in</strong>ks before be<strong>in</strong>g placed <strong>in</strong> the trash bags.(b) Restroom: Trash will be picked up from the restroom floors.(c) Outdoors: Trash will be picked up outside the build<strong>in</strong>g. Cigarette butts, cups, miscellaneous itemsleft outside shall be disposed of <strong>in</strong> proper receptacles (not <strong>in</strong> planters or flower beds).(d) Kitchen/Bar Area: The kitchen is to be left as it was found.(e) If spills, food dropp<strong>in</strong>gs, or other similar <strong>in</strong>cidents (Ex: illness) occur, please clean it up immediately.Do NOT wait until the end of the event. Any major <strong>in</strong>cidents that cannot be handled easily and fully orthat leave evidence beh<strong>in</strong>d should be reported immediately. Failure to do so may result <strong>in</strong> the Renterbe<strong>in</strong>g held f<strong>in</strong>ancially responsible for its remedy after the fact.Any necessary clean-up by NCIM of any items (a) through (e) will be charged and withheld from thedeposit. NCIM will dispose of the bags of trash and will sweep the carpet for the next event.13. Decorations. Renter agrees that decorations shall NOT be attached to the walls, ceil<strong>in</strong>gs, exist<strong>in</strong>g walldecorations, woodwork, ceil<strong>in</strong>g fixtures, w<strong>in</strong>dow treatments, by use of nails, scotch tape, staples, etc.8/1/2013 3 | P a g e


Other decorat<strong>in</strong>g restrictions apply, as described <strong>in</strong> the attached “Additional Conditions.”14. Use of Kitchen. The kitchen is for warm<strong>in</strong>g food only. If it is found that the kitchen was usedwithout permission it will result <strong>in</strong> forfeiture of the entire Security Deposit ($200.00). – Kitchen facilitynot currently available.15. Use of Park<strong>in</strong>g Lot Area. The Park<strong>in</strong>g Lot Area is available for use with the <strong>Hall</strong>, weather permitt<strong>in</strong>g.Smok<strong>in</strong>g is permitted on the Park<strong>in</strong>g Lot. Renter is requested to ensure that guests observe the city noiseord<strong>in</strong>ance. Renter is responsible for dispos<strong>in</strong>g of cigarette butts <strong>in</strong> the proper receptacles (not planters orflower beds). Any necessary clean-up by NCIM will be charged from the Security Deposit.16. Use of Equipment. No tables, chairs, furniture, or other equipment/supplies may be removed from theFacility without the prior consent of NCIM.17. Conduct of Event. For the duration of the event, the Renter and its guests must abide by the NCIMpolicies and comply with applicable regulations and laws. Renter is responsible for the actions of guestsand for any damages or losses <strong>in</strong>curred dur<strong>in</strong>g the event. Misuse of the facility, unruly or illegal behavior,failure to observe posted signage, and/or the failure to obey any portion of the provisions conta<strong>in</strong>ed <strong>in</strong> thisdocument or your rental contract constitute a breach of contract and may result <strong>in</strong> actions aga<strong>in</strong>st theRenter <strong>in</strong>clud<strong>in</strong>g, but not limited to, cancellation of rental period, immediate dismissal/removal from thefacility, forfeiture of a portion or all of the Security Deposit and/or <strong>Rental</strong> Fees. NCIM has the right torefuse entry or service to and remove from the premises any person it deems to be behav<strong>in</strong>g <strong>in</strong> animproper or abusive manner or <strong>in</strong> a manner not befitt<strong>in</strong>g NCIM. NCIM reserves the right to exclude orremove any undesirable persons from the event and premises without liability.18. Govern<strong>in</strong>g Law. The parties agree that any dispute shall be subject to the laws of the State ofWiscons<strong>in</strong>, and that any legal action shall be brought <strong>in</strong> <strong>Milwaukee</strong> County, Wiscons<strong>in</strong>.19. Entire <strong>Agreement</strong>. The parties agree that all of the terms and conditions are conta<strong>in</strong>ed here<strong>in</strong> and thatany modification shall be <strong>in</strong> writ<strong>in</strong>g.20. Compliance. ADDITIONAL CONDITIONS1. The NCCC facility is rented as is. Alterations to the facility are not permitted: pictures, trophies, lamps, furniture,and other day-to-day decorative accessories may not be relocated or removed from the Premises.Renter Initials2. Renters are required to rema<strong>in</strong> <strong>in</strong> areas specified <strong>in</strong> the agreement, and are responsible for keep<strong>in</strong>g groupparticipants conf<strong>in</strong>ed to those areas.Renter Initials3. No nails, staples, screws, p<strong>in</strong>s, tape, or adhesives of any k<strong>in</strong>d may be put <strong>in</strong>to walls, ceil<strong>in</strong>gs, or floors. Noadhesive tapes <strong>in</strong>clud<strong>in</strong>g scotch, mask<strong>in</strong>g, and duct tape may be placed on any surfaces.Renter Initials4. The usage of candles <strong>in</strong> centerpieces is permitted only with approval from NCIM representative. Candles may beused on buffet tables by caterers, but only when the table/candles are under their direct supervision.Renter Initials5. No rice, confetti, birdseed, or other unapproved “celebration materials” shall be allowed <strong>in</strong>side or outside the facility.Please check with NCIM if a certa<strong>in</strong> material is unapproved.Renter Initials6. No Dr<strong>in</strong>ks whatsoever allowed on the dance floor.Renter Initials7. No punch with red dyes or red soft dr<strong>in</strong>ks allowed. All other colored beverages (cranberry juice/tomato juice formixers, etc.) will need prior approval by NCIM. Any additional or special clean<strong>in</strong>g charges (m<strong>in</strong>imum of $100) fromred dyed dr<strong>in</strong>ks/foods will apply.Renter Initials8. Alcohol is def<strong>in</strong>ed as: Malt beverages, w<strong>in</strong>e, and ciders are the only alcohol beverages permitted. If any other alcoholbeverages (hard liquor) are discovered, the event will close immediately and the Security Deposit will be forfeited.9. Will alcohol be served at your event? All alcohol will be dispensed only by licensed andapproved bartenders and only beverages approved by NCIM and served at the bar <strong>in</strong>side NCCC. Any alcoholicbeverages consumed outside NCCC, <strong>in</strong>side or from the <strong>in</strong>side, trunk or any part of an automobile, brought <strong>in</strong>to NCCC<strong>in</strong> coolers, conta<strong>in</strong>ers, cloth<strong>in</strong>g, purses etc., or brought <strong>in</strong>to or onto the premises by anyone other than the contractedbeverage service, and only at the load-<strong>in</strong> of all appropriate alcohol for the event, shall be subject to an immediatecancellation and shutdown of the event.Renter Initials8/1/2013 5 | P a g e


11. D.J.’s/musicians must be f<strong>in</strong>ished by 12:00 AM. This allows time to dismantle their equipment and be out by 12:30AM. A breach of contract occurs if the vendor is not out of the build<strong>in</strong>g by 12:30 AM. D.J.’s may use a fog mach<strong>in</strong>ewith prior approval. No dance wax or compound, or any substance, may be spread on the floor.Renter Initials12. All foods, dr<strong>in</strong>ks and any other materials that sta<strong>in</strong>, damages or otherwise disfigure floor<strong>in</strong>g, walls or any other part ofNCCC will <strong>in</strong>cur clean<strong>in</strong>g charges to remove the damages. A m<strong>in</strong>imum charge of $100 shall apply. If damages occur,NCIM will contract all repairs to be made by skilled professionals; charges for repairs will be deducted from Renter’sSecurity Deposit. In the event that repair costs exceed the amount of Security Deposit, Renter will be responsible forthe entire repair over and above the Security Deposit.Renter Initials13. Furniture arrangement must be approved by NCIM prior to the event. While every effort will be made to arrange allfurniture at the request of the renter, NCIM’s reserves the right to adjust furniture as necessary to allow for safety,traffic, security to walls or other reasons it deems necessary.Renter Initials14. A jo<strong>in</strong>t walk-through will be requested by NCIM dur<strong>in</strong>g the next bus<strong>in</strong>ess day after the event if damage has occurredto the facility. If no damages have occurred, as determ<strong>in</strong>ed by NCIM, a walk-through will not be required.Renter Initials15. If damages to the facility prevent the next scheduled event(s) from occurr<strong>in</strong>g, Renter will be responsible for any andall refundable deposits that may be demanded by future Renter(s).Renter Initials16. NCCC is a non-smok<strong>in</strong>g facility. All smok<strong>in</strong>g should be done outside on the Park<strong>in</strong>g Lot and the cigarette buttsdisposed of properly. Renter is responsible for pick<strong>in</strong>g up cigarette butts <strong>in</strong> the front of the build<strong>in</strong>g, around front doorarea and park<strong>in</strong>g lot after event. The use of Chew<strong>in</strong>g Tobacco, snuff or any other smokeless tobacco product is strictlyprohibited <strong>in</strong>side NCCC. Receptacles for smokeless tobaccos, or “spit-cups” found <strong>in</strong> the premises after an event willconstitute immediate forfeiture of the entire Security Deposit.Renter Initials17. S<strong>in</strong>ce rental is for _________________<strong>Hall</strong> of the Conference Center, use of any other part of the NCCC isprohibited.Renter Initials18. We at the NCCC want your event to be memorable and as special as possible. We recognize that celebrations often<strong>in</strong>clude children and children will be children. We ask that parents be parents and supervise the children. Childrenshould be kept from runn<strong>in</strong>g, throw<strong>in</strong>g food or other objects, stand<strong>in</strong>g <strong>in</strong> w<strong>in</strong>dow boxes, on tables or chairs, hang<strong>in</strong>gfrom or on doors. Children should at no time be allowed <strong>in</strong> the kitchen or bar areas, or outside if unsupervised. NCIMshall not be responsible for <strong>in</strong>juries to unsupervised children.
