""TENDER FORM(Instructions to Tenderers)1. Quotation must be enclosed in a properly sealed cover addressed to the Director,Animal Husbandry, Himachal Pradesh, Shimla- 5 by designation (not by name). Thequotation must be super-scribed "Quotation for the supply of fully automated setterand hatcher till April, 2013 as called for in the tender notice dated ". Thequotation must reach the Directorate of A.B. up to 11.00 A.M. on 17th April, 2012 asmentioned in the tender notice.2. In the event of the quotations being submitted by a firm, it must be signed separatelyby each member thereof or in the event of the absence of any partner it must be signedon his behalf by a person holding a power of attorney authorizing him to do so, or incase 9f a company the quotation should be executed in a manner laid down in the saidcompany's articles of association. The signature on the quotation shall be deemed to beauthorized signature.3. All the columns of the quotation form shall be duly, properly and exhaustively filled in.The rates quoted shall not be over written. The quotations shall always be both infigures and words.4.5.Any omission in filling the columns of the rates shall altogether debar a quotation frombeing considered. "All corrections must be signe~ by the tenderers.6. Earnest money of Rs. 25,000/ - in the shape of fixed deposit receipt duly pledged to theDirector, Animal Husbandry, Himachal Pradesh, Shimla- 5 must accompany the tenderform, without which it will not be considered. The said amount will be regarded asforfeitable to the Director, Animal Husbandry, Himachal Pradesh, Shimla- 5 if anysuccessful tenderer fails within the time fixed by the Director, Animal Husbandry,Himachal Pradesh, Shimla- 5, either to sign the contract on terms contained in theinvitation for tenders, its tender form and condition of contract referred in theinvitation of tenders.7. The Director, Animal HusQandry, Himachal Pradesh, Shimla- 5 will have the right ofrejecting any or all of the quotations without assigning any reason.8.No tender will be considered unless and until all the documentsare properly signed.9.10.The quotation will be regarded as constituting an offer or offers open to acceptance onwhole at the discretion of Director, Animal Husbandry, Himachal Pradesh, Shimla- 5up to 17thApril, 2012.In the event of tender being accepted, the quotation will be converted into a contractwhich will be governed by the c~nditions given in the Schedule "B" (enclosed) readwith these instructions.11. Any attempt at negotiation direct or indirect on the part of the tenderer with theauthority to whom he has submitted the tender or the authority who is finallycompetent to accept it after he has submitted his tender or any endeavour to secure anyinterest for an actual or prospective tenderer or to influence by any mean theacceptance of a particular tender will render the tender liable to exclusion fromconsideration.

12.13.14.15.16.17.18.19.20.Legal disputes, if any will be restricted to the jurisdiction of the Shimla Courts only.Tender must be accompanied by General Sale Tax, Central Sales Tax ClearanceCertificate showing clearance of taxes up to 31stMarch of the preceding year.Prices should be firm and validity of rates must not be less than 90 days where theperiod of validity is specifically mentioned as 90 days or more and the tenderer doesnot send an intimation by a registered post after expiry of such specific period, thevalidity of rates shall be deemed to have been extended till the date of issue of thetelegraml letter of acceptance in favour of the tenderer.The tenderer who wish to file an appeal against the award of rate contract may do sowith in 10 days of the award of rate contract and the appeal shall lie to the Secretary(AH), Government of Himachal Pradesh.Payments will be made against physical delivery of inspectedl accepted automatedhatcher and setter duly supported with satisfactory inspection note and after receipt ofthe automated setter and hatcher at consignees sitel destination.Rate of the automated setter and hatcher must be quoted in megic system and filledonly in the Schedule IIA" .All photocopies required to be attached with the tender should be got attested from aGazetted Officer.Inspection of premises may be carried out by the Director of A.H. or his authorizedrepresentative to ensure the genuineness of firm as well as to verify thecapacity 1quality of automated setter and hatcher being fabricated by the firm.Taxes should be indicated separately otherwise rates will be deemed to be inclusive ofsuch taxes.21.Late and delayed tenders will not be consideredat all.22.The tenderer shall provide detail of the manufacturer, authorized agents, dealers,stockist, etc. who will cater to after sales need.23.Product complying with ISI standardswill be given preference.24.Tenderers who do not fulfill the above mentioned requirements, their tender will beliable for rejections.Read and acceptedSignatureof TendererI/We hereby quote to supply automated setter and hatcher F.O.R. destination at Nahanor Sundernagar in the state of Himachal Pradesh as specified in the underwritten schedule inthe manner in which and within the time specified as set forth in the conditions of the contractgiven in the schedule" A" (enclosed). The payment will be made on the basis of bill system by the concerned District Heads andno money will be paid in advance.4. Inspection of the premises of the tenderer shall be carried out by the Director, AnimalHusbandry, Himachal Pradesh or his representative(s) to ensure the quality of the productquoted in the tender.5. Prior to taking of the delivery the inspection of the supply will also be done by theconcerned Assistant Director (P.D.) or his representative.6. Incase of any dispute,will be final.the decision of the Director, Animal Husbandry, Himachal Pradesh7. The Director of Animal Husbandry, Himachal Pradesh reserves the right to reject any or alltender without assigning any reason, thereof.8. The supplier will have to execute the supply of fully automated hatcher and setter on thedays as decided by the Director, Animal Husbandry, Himachal Pradesh, Shimla- 5 so as tostreamline the hatching process for the distribution of chicks in various districts.9. The supplier will have to install the hatcher or setter, as per the supply order, in thehatchery building at Nahan or Sundernagar and make a test run of the same for ensuringproper working of the machines. Warranty period shall be mentioned in the tender.Essential spares (to be enlisted in the tender) are also to be provided free of cost.10.
