Senior governmentofficial visits MidstreamA member of the executive council (MEC) of the Gauteng Provincial Governmentvisited Midstream on 7 March this year. <strong>The</strong> MEC of the Gauteng Department ofRoads and Transport, Dr. Ismail Vadi, requested to visit Midstream to officiallyopen the section of K109 (Midstream Drive) by means of a ceremonial opening.<strong>The</strong> MEC and his entourage, VIP’s, the Bondev team and various media (includingSABC) all gathered for this special event at the local Retire@MidstreamRestaurant. Ten Grade 11 students from Midstream College – all serving on theMidstream Council and with Engineer Graphics and Design as subject – also attendedthe meeting. Dr. Vadi also hosted a media briefing and State of the ProvinceAddress (SOPA) to outline the department’s plans and budget for <strong>2013</strong>/14,priorities and programmes in response to the delivery of the Provincial Addressby Premier Nomvula Mokonyane on 25 February.With the road being in use for 12 months and the compulsory 12-month retentionlapsing at the end of March <strong>2013</strong> Bondev officially handed the road over tothe province for future maintenance. MEC Vadi presided over the handing overby Bondev <strong>Midrand</strong> and also opened the R34 million project. In a published notificationby GPRT the following was mentioned on the department’s website: “<strong>The</strong>3,2 kilometres single carriageway project was undertaken by Bondev <strong>Midrand</strong>,a residential property developer, contributing to government’s strategic objectiveof socio-economic upliftment and improving transport infrastructure. <strong>The</strong>company has further pledged to contribute future road construction in the area.”Mr. Jan Zeederberg from Bondev elaborated on the project, also mentioning thatwaste material from the Gautrain project was used to construct the foundationlayers of the road. I would like to share athought with you for this month.We all know what its like to be interrupted. Weare thinking about things - someone breaks ourtrain of thought, that stops all the creative juices,and we find ourselves having to start all overagain. This is particularly true when one is countingthings! Frustration beyond frustration!Jesus is on His way to the house of Jairus, a leaderand ruler in the community. His daughter is desperatelyill and he comes to Jesus asking for help.Jesus sets out to go to the home but along the waya woman who has been ill for 12 years touches thehem of His garment. Jesus feels power go out ofhim. He knows that someone has touched Him andHe stops! He stops to heal the woman. She cannothide away, she cannot run away, and she ownsup to the fact that it was she who touched Him.Her simple, profound faith! All she knew was thatif she could only touch Him she would be well, andthat is exactly what she did.come to the realization of just how much He caresabout you are me.As we head up to the Holy Week and Easter, I praythat you will find out for yourself, just how muchHe loves you. Jesus had been interrupted.He did not get there in time. Can you imagine themixed emotions. <strong>The</strong> elated woman who has beenhealed, and the heartbreak of the father who haslost his daughter. <strong>The</strong> thoughts that went throughJairus’s mind must have been something like, ifonly Jesus had not stopped. If only the woman hadnot interrupted Him.Jesus however, continues on to the home of Jairusand heals the daughter. Eventually a happy endingfor all.I wonder what would happen if we would dare tointerrupt Jesus? I wonder if we would have theguts to stop Him, tell Him about the things thatdisturb us? So often we do not speak to Jesus becausewe are afraid that perhaps He will not listen.But I can assure you that He will stop. He will allowyou to interrupt Him! He wants you to come toHim and interrupt Him!Take time to go and read this story in Mark 5:21– 43. Golffor the fun of it<strong>The</strong> Himalayas is coming to town!A copy of the Himalayas Ladies Putting Green locatedadjacent to the Old Course at St Andrewsin Scotland will open in September this year nextto the entrance gate of the newly developed MidstreamHill. <strong>The</strong> putting course will be open to thepublic and require no prior knowledge of golf – onlyflat heeled shoes, a keen imagination and a senseof humour.<strong>The</strong> following article on the real Himalayas by JohnHuggan appeared in the American Golf Digest ofJanuary 2011.“It is Wednesday, Oct. 6, a mere two days after Europehas won the 2010 Ryder Cup. With about 20minutes of daylight remaining at the Home of Golf,I’m strolling through the gloaming and down thegame’s most famous fairway, away from the Royaland Ancient Golf Club of St. Andrews’ clubhouse.My destination is the diminutive Jigger Inn, where Iwill interview Darren Clarke (a European vice-captainat Celtic Manor) for a newspaper piece.Halfway there, I chance upon the Himalayas puttingcourse that sits to the right of the second teeon the Old Course.<strong>The</strong> Himalayas, two acres of the humpiest, bumpiestand “funnest” putting experience on the planet,is all but deserted. <strong>The</strong> only people putting are twoyoungsters, 10-year-old Willie and his pal Jim, 9.I stop to watch them in action. And it is an education.In the absence of tees and flagsticks, the paircreates holes from their imaginations, putting uphill and down dale. <strong>The</strong> journeys travelled by theirputts are hugely entertaining. Most take big, exaggeratedbreaks before plummeting into valleyswhere the cups are located. Some require judgingcurves off as many as four sizable humps andbumps. <strong>The</strong> most diverting and interesting involvethe ball travelling yards past the cup, then reversingback down the slope. This is a test of inventivenessas much as anything.Best of all, however, are the whoops, hollers andchildish giggles emanating from the two participantsas the balls make their convoluted ways fromputter to hole. This is innocent fun and laughter atits most enchanting. And on a “golf course” withno dress code (other than flat footwear), not evena hint of stuffiness and no gender restrictions. Isee no sign of either a bag drop or valet parking.<strong>The</strong>re’s a lesson in that for all of us, surely.Even at the busiest times, an 18-hole round typicallytakes no more than 45 minutes. Walking on,the high-pitched voices of the two children followme across the ancient links. It is the law!Can there be a legal duty of children tosupport their parents?“<strong>The</strong> liability of children to support their parents,if these are indigent (inopes), is beyond question:see Voet, 25.3.8; van Leeuwen, C Censura Forensis1.10.4. <strong>The</strong> fact that a child is a minor does notabsolve him from his duty, if he is able to provideor contribute to the required support;”Whenever we hear the word maintenance we automaticallythink of support as defined and specificallyenforced by various Acts of parliament, i.e.duty as pertaining to spouses or the parent’s dutyto support and care for the child. But what is theposition of a parent in need of support with noone else to turn to other than their own and/oradopted children?THE LEGAL POSITIONIn South Africa the Maintenance Act, Act 99 of1998, regulates all maintenance matters but unfortunatelythis act does not specifically place aduty on a child to support his/her parent in theevent of such a need arising.This means that to establish whether such a legalduty exists and rests on a child the answer to ourquestion will have to be sought from our case law.Fortunately in terms of our case law the legal positionis clear. Children do have a duty to supporttheir parents in whole or in part, according to theirability, even though such children might be minors,In Oosthuizen v Stanley, Judge of Appeal Tindallsummarized the position as follows:Such a claim for support has however a muchstricter criterion in the case of a child claiming supportfrom his/her parents in that a parent has toprove that he/she cannot provide for the necessitiesof life and that his/her child has the financialability to provide such supportWhat happens if the child who already supports theparent dies?If the deceased was at the time of his death responsiblefor the maintenance and support of hisor her parent, the parent will have a claim againstthe deceased’s child’s estate for continued maintenanceand support.Such claims will not be dealt with in terms of whathas been stated above but on normal motion andor action procedures for which legal assistance willbe required and be of paramount importance.CONCLUSIONEven though there is no specific legislation in SouthAfrica stating that children owe their parents a legalduty of support it is clear from our case lawthat in the eyes of South African Courts such a dutydoes in fact exist and will be enforced by our courtsif the requirements as stated above can be allegedand proved.<strong>The</strong> <strong>Midrand</strong> <strong>Estates</strong> <strong>Newsletter</strong> - <strong>April</strong> <strong>2013</strong> 18

<strong>The</strong> “LEGO-type” bridges of MidsMost residents and visitors driving along Brakfontein Road cross the bridges at the entrance to the areawithout a second thought. <strong>The</strong> divide crossed by the bridges is the “stream” from which the name of Midstreamwas coined. Cost of electricity in <strong>Midrand</strong> <strong>Estates</strong>to rise on average by less than 8%With every household reliant on electricity for comfort, heat and a warm plate of food, the annual increasein electricity tariffs is awaited annually by consumers with eager anticipation. In March 2012 South Africanconsumers were surprised by the decision taken by the national energy regulator (NERSA) to decrease anearlier approved rate increase by ESKOM from 25% for 2012/13 to 16%. For the year <strong>2013</strong>/14 and the following4 years, ESKOM submitted an application to NERSA for an annual increase of 16% per annum whichwould see the price of electricity double over the 5 year term.On 28 February <strong>2013</strong> NERSA released the following press release:<strong>The</strong> National Energy Regulator of South Africa (NERSA) at its meeting held today, Thursday, 28 February<strong>2013</strong>, approved an 8% average increase per annum for the next five years. <strong>The</strong> average electricityprice will increase to 65.51c/kWh in <strong>2013</strong>/14 up to 89.13c/kWh in 2018. <strong>The</strong> total revenue approvedfor the five years amounts to R906 553 million. On 18 October 2012, NERSA received Eskom’s RevenueApplication for the Third Multi-Year Price Determination, referred to as MYPD3. <strong>The</strong> application coversa five-year period from 01 <strong>April</strong> <strong>2013</strong> to 31 March 2018. Eskom applied for an annual price increase of16% over the MYPD3 period. <strong>The</strong> requested price increase translates into required revenues of over R1trillion over the MYPD3 period. <strong>The</strong> MYPD3 application also includes Eskom’s proposals to restructure itsretail tariffs. <strong>The</strong> retail tariffs are the tariff rates applicable to the various customer categories, namelyurban, rural, residential and local authorities.Following a huge sigh of relief after having dodged the 16% pay hike, the question remained on what therestructuring of the retail tariffs would entail. <strong>The</strong> tariffs for electricity in <strong>Midrand</strong> <strong>Estates</strong> are determined byMES in accordance with the ESKOM tariff structures and will see the following changes for <strong>2013</strong>/14.• <strong>The</strong> four tier inclining block (IBT) structure has been replaced by a two tier structure. A First Quarter Review….With a blink of the eye <strong>2013</strong> is literally at the end ofit’s first quarter. One would think that there couldnot be much to review in such a short period oftime but you would be wrong.Much work has been done with regards to completingthe services of X50 of Midstream Hill andvery soon the houses will be popping up under thealready glowing street lights in this extension. Anothervery successful launch was held on 1st ofMarch when a further 95 stands were sold in X51.With the sale of these two extensions the total newhome owners compliment is touching on 200. Seriouswork is also underway on the development ofthe Himalaya’sCourse which isset to be a veryunique featureof MidstreamHill. <strong>The</strong> Gatehouse is basicallycompleted,double securitywalls arebeing completedand the NewSecurity Managerhas beena p p o i n t e d .Future homeowners can be at ease that the security systemsare being put in place in good time before anyonetakes occupation. MIDSTREAM HOAcreating a preserve forGrass OwlsIn the course of 2012 the Midstream HOA board decidedto give renewed and focussed attention to theGrass Owl Preserve located next to the Northern perimeterof the Estate. <strong>The</strong> objective is to rehabilitatethe area in such a way that it would ultimately be asuitable and natural habitat for the Grass Owl specie.As a point of departure a Grass Owl Sub-Committeewas established and tasked to oversee the variousrelated projects and allocated finances. This Committeereports directly to the Midstream Board andthe following matters already emanated from themeetings held thus far:• A Group of experts in this field were approachedto guide the sub-committee in terms of the actionsrequired to effectively rehabilitate the area.• A report in this regard has been received from them and is already partly implemented.• <strong>The</strong> Committee is cognisant of the fact that the work required to be done will have to be done within ourlimited capabilities, by using our own limited resources and budget.• In terms of the proposals in the report and bearing in mind the fact that we had limited resources, it wasdecided to start the project by managing the inflow of water into the area. This was viewed to be themain cause of the uncontrolled growth of undesirable plant species.• Throughout this process, on-going attention will be given to the eradication of these plant species.• During the months of November and December 2012 the water canals channelling the outflow of thewater to the Irene Farm were cleaned out on both sides of the Northern border fence in order to enhancethe overall drainage of the water from the Preserve.• During February <strong>2013</strong> the second phase of this project commenced. This comprised the building of apermanent channel to accommodate the storm water flowing from the Islington Crescent area. (see attachedphoto).• Information/notice boards were designed and have already been made which will be placed strategicallyonce the damaged portions of the fence have been repaired.• Additional work relating to the inflow of water into the area will be undertaken in the near future.• Stray cats are still proving to be a serious problem as these are clearly enemy number one as far as theowls are concerned. RULEOFTHESTREETAccess to a stand (erf) is provided through roadsystems that ultimately link a resident to the outsideworld. Ownership and the associated maintenanceresponsibility changes through the road systemfrom national roads where the national roadsagency (SANRAL) is in charge up to the resident’sdriveway. <strong>The</strong> major connector roads through andaround <strong>Midrand</strong> <strong>Estates</strong> belong to either the GautengProvincial Government (the K109) or the metropolitanmunicipalities for Brakfontein and Nellmapius Roads.Ownership of all the roads beyond the access controlpoints of the various estates within <strong>Midrand</strong> <strong>Estates</strong>has been transferred to the respective home ownersassociations. As per the condition of establishment theHOA has to accept ownership of the road reserve withthe road and storm water system after proclamationand the developer is obliged to transfer the properties.As owner of the road and road reserve the HOAincorporated certain “Rules of the streets” in the Houserules. An extract of the recently revised House rulesof the Midstream HOA provides insight into the rulesthat do apply, (Note: House rules from other HOAs maydiffer slightly, but the same principles do apply).Rules of the streets (As an extract from theMidstream HOA House rules)1.1 <strong>The</strong> streets of Midstream are for the use of allresidents, whether it be on foot, bicycle or motorvehicles. <strong>The</strong> streets are private roads and notpublic streets. <strong>The</strong> MHoA may enforce its own rulesand determine fines with regard to street safetyand the safety of all street users.1.2 Every person who enters the Estate will do so oncondition that they subject themselves to theseRules.1.3 <strong>The</strong> MHoA may appoint Traffic Officers to enforcethese Rules.1.4 <strong>The</strong> following Rules will apply to all street usersincluding residents, visitors, contractors anddelivery vehicles:1.4.1 Street users are not allowed to act in anymanner that may pose a danger by:(a) Exceed the general speed limit of 30km per hour(b) Not adhering to traffic signs(c) Parking on paved walkways, pavements andparks(d) Using any motor vehicle with noisy exhaustsystems(e) Using any motor vehicles on walkways or joggingpaths(f) Street users not giving the right of way topedestrians at pedestrian crossings(g) Operating any engine powered vehicle on thestreets of the Estate without a valid driver’slicense(h) Driving an unlicensed motor vehicle on the streetson the Estate(i) Driving a motor cycle without a helmet(j) Parking in a loading zone designated for deliveryvehicles or disabled persons(k) Using a cell phone while driving a motor vehicleon the streets, unless the cell phone is operatedby means of a hands free device.1.4.2 Any motor vehicle that is found parked on anyprohibited area mentioned in this Rule shall beclamped and only released after the prescribedfine has been paid during working hours at theEstate Office at the Old Kent Gate.1.4.3 Parents are responsible for ensuring that theirchildren are made aware of the dangers relatingto the use of streets and must take responsibilityfor their children’s behaviour and safety.1.4.4 Motor vehicles are only authorised on thestreets of the Estate and not on parks and orpavements.1.4.5 Only licensed drivers may operate and drivemotor vehicles on the streets of the Estate,excluding authorised and trained employeesof the MHoA using company equipment whileperforming their duties.1.4.6 Pedestrians may only cross streets at designatedcrossings in the Estate and they have theright of way. Motorists must always approachcrossings with caution.1.4.7 No person may dump any rubbish, dirt, muck,garbage, refuse, paper, waste or any like articleon the streets, pavements, parks and or greenareas of the Estate.1.4.8 No person may place any object, for examplecement balls, on the cement curb directly nextto the street surface. <strong>The</strong> MHOA will not be heldliable for any injuries or damages caused bysuch objects.1.4.9 Members or tenants are only allowed to have 10visitor’s vehicles at any given time on any singlestand.
