COST OF TENDER DOCUMENTS (TENDER FEE): Rs. 1,000/- (RUPEES OneThousand Only) (including sales tax). To be remitted along with the techno-commercialbid in the form of a crossed Bank Draft favoring “ELECTRONICS CORPORATION OFINDIA LIMITED” from a nationalized bank payable at Hyderabad/ Secunderabad. Thecost of tender document is non- refundable.5. EARNEST MONEY DEPOSIT (EMD): Rs 1.0 Lakh. EMD is to be remitted along withthe techno-commercial bid in the form of a crossed Bank Draft favoring“ELECTRONICS CORPORATION OF INDIA LIMITED” or a Bank Guarantee valid for aperiod of six months from a nationalized bank payable at Hyderabad/ Secunderabad.The EMD will stand forfeited if the bidder withdraws or amends the Quotation withoutthe concurrence of the purchaser or declines to accept the Purchase Order placed bythe purchaser during validity period of the Quotation. The EMD deposited byunsuccessful bidders shall be refunded without interest after finalization of the order.The EMD of the successful bidder will be appropriated towards Security Deposit.Proforma for Bank Guarantee is given in Appendix – I.6. SCOPE OF WORK: Supply of Electrical Items at the address given in Hyderabad asper details given in Appendix-I of Volume-II and Execution of Power Distribution and

Wiring Works at MSRS-II Sites as per details given in Appendix-II of Volume-II at siteslisted in Appendix-III of Volume-II.7. SUBMISSION OF BIDS: The main cover shall contain separately sealed envelopessuper scribed as below:Part – I: TECHNO-COMMERCIAL PART- I.Part - I shall contain all documents required as per this tender except Price Bid.- ORIGINAL Tender Document signed and stamped on each page. No cutting oroverwriting should be done. Price schedule etc. forming part of this shall not be filled in.- Covering letter, technical submissions including brochures, if any, and other detailsrequired forming part of the offer.Part – II: PRICE PART II - DO NOT OPEN WITH PART – I.Part -II of offer shall contain Price Bid. The bidder needs to fill the prices against eachitem. The rates and prices quoted by the bidder should be in the Indian Rupees. Thequoted prices must be stamped and signed. Any conditions including conditional pricebids shall not be taken into account.8. FORMATS AND SIGNING OF TENDER: The bidder is required to submit the tendertyped or written in indelible ink and shall be signed by the bidder or a person or personsduly authorized to sign on behalf of the bidder. The name and position held by eachperson signing must be typed or printed below the signature. All pages of the tendershall be page numbered and shall be signed by the person or persons signing thetender. Any corrections or overwriting will be valid only if these are initialed by theperson or persons signing the tender. Bidder must quote self supporting composite ratefor every item. ECIL reserves the right to increase or decrease the quantities in any / allitems in any proportion and no claim shall be entertained for escalation in rate ofquantities given in schedule.9. SUBMISSION OF TENDERS: Tender shall be submitted in a sealed cover superscribed TENDER NO, and Due Date. Tenders brought in person must be dropped insealed box, which will be kept in the office of DGM, Sub-contract purchase, CNSG,ECIL, Hyderabad. Tender sent by post must be by registered post, speed post or

courier. No tender shall be accepted unless it is properly sealed. If the envelopes arenot sealed and/ or not marked as instructed above ECIL shall not be responsible for themisplacement or consequent loss, or validity of such bids. Both the envelopes,containing Part I and Part II bid respectively as indicated above, should be sealed inouter envelope. Both inner and outer envelopes shall be addressed to:DGM, Sub-contract purchase,Manufacturing & Engineering Division,Communication Systems Group,ELECTRONICS CORPORATION OF INDIA LIMITED,HYDERABAD – 500 062 {A.P.}10. DUE DATE: The last date for receipt of both parts of the bid is as given above. Thetechno- commercial bids (Part I) will be opened on the 1st July 2011 at 14:00 hours.The authorized representatives of the bidders may be present at the time of openingwith prior appointment. The techno-commercial bids will not be considered in theabsence of cost of Tender fee and EMD.11. COST OF TENDERING: The bidder shall bear all the costs associated with thepreparation and submission of the tender, regardless of the conduct or outcome of thetendering process including cancellation of this tender.12. DEVIATIONS, EXCEPTIONS AND COUNTER OFFERS: Any deviations taken bythe bidder to the stipulations of the tender document shall be brought out as per theformat given only and enclosed along with the offer. Any deviations not brought out inthe stipulated Form at Appendix-VIII of Volume-I shall not be recognized and the tenderdocument shall be treated as null and void. Where counter terms & conditions areoffered by the bidder, the buyer shall not be governed by those, unless, specificacceptance of the same is conveyed in writing in order or otherwise by ECIL.13. PERIOD OF VALIDITY OF TENDERS: The tender must be for a minimum period of120 days from the date of opening of price bid. In exceptional circumstances, ECIL mayrequest for extending the period of validity for a specified additional period. Bidder shallhave the option to refuse to extend the validity of their offer.

14. LATE TENDERS: Any tender received by ECIL after the tender closing date shall berejected.15. OPENING THE “TECHNO-COMMERCIAL” PART OF THE TENDER BY THE ECIL:On opening the “Part I Techno – Commercial Bid”, ECIL will ascertain whether theBidder has submitted the EMD and Tender fee. In the absence of payment of EMD andTender fee, the “part I Techno – Commercial Bid” of the tender shall be considered asnon-responsive and shall be rejected outright.16. EXAMINATION OF TENDERS: Prior to the detailed evaluation of tenders, ECIL willscrutinize all tenders to confirm that requisite documents and tender/offers are signedby the bidder. Where there is discrepancy between the amounts in words and figures,the amount in words will govern. Where there is a discrepancy between the unit priceand the total price shall be corrected, unless in the opinion of ECIL there is an obviousmisplacement of the decimal point in the unit price, which case the total price as quotedwill govern and the unit price will be corrected. If the successful Bidder does not acceptthe correction of the errors pursuant to a) and b) above, this bidder treated as invalidand the EMD may be forfeited.17. CLARIFICATION OF THE “TECHNO- COMMERCIAL” PART OF THE TENDERS:To assist in the examination, evaluation and comparison of the Part I “Techno –commercial “part of the tenders, ECIL may, seek clarification from the bidders. Therequest for clarification and the response shall be in writing, by Mail or by Fax / e-mail,but no change in the rates and prices or substance of the tender shall be sought,offered or permitted. After receiving all clarifications, technical negotiation meeting maybe convened with the bidder for the technical acceptance of their tender at thediscretion of ECIL.18. TECHNO-COMMERCIAL EVALUATION shall be done on only bidders fulfilling theeligibility criteria mentioned above and to be eligible for opening of Part II. 19.OPENING THE “PRICE BID” PART OF THE TENDERS BY ECIL: After receiving allclarifications, commercial and technical acceptance of the tender by ECIL, ”Part II –Price Bid” shall be opened of only after ascertaining commercial & technically acceptedand cleared tenders, which in the view of ECIL, have met the requirement. Decision ofECIL in this regard will be final.

20. CONFIDENTIALITY: The tender evaluation process is confidential. Informationrelating to the evaluation of tenders will not be disclosed to bidder or any other personnot officially concerned with such procedure.21. RATES / PRICES: The Rates/Prices quoted and accepted by ECIL shall remainfixed and firm till the satisfactory execution of work covered under the Tender. Noincrease in rates or prices, whatsoever, on any account, shall be considered by ECILduring the currency of the contract. At the option of ECIL, the “Price Negotiation“ may ormay not be carried out with the parties.22. TERMS OF PRICE: Quotations shall be submitted on F.O.R. Destination basisincluding transit to the address given in Hyderabad. Quotations from Hyderabad/Secunderabad bidders should be only on free delivery basis at our stores.23. ECIL’S RIGHT TO ACCEPT OR REJECT ANY TENDER: ECIL reserves the right toaccept, reject any tender, cancel the tender process and reject all tenders at any timeprior to award of the contract, without any financial liability to the affected bidder.24. AWARD CRITERIA: The award of contract shall be on the basis of overall quotationfor all the 9 sites which includes supply of electrical items as per Appendix-I of Volume-II and site works as per Appendix-II of Volume-II, at sites as given in Appendix-III ofVolume-II put together. ECIL reserves the right keep two sources for each set of items.The given requirement will be divided in two suppliers. 70% share will go to Lowestbidder (L1) and 30% share will be given to L2, if L2 matches the landed prices with L1.25. NOTIFICATION OF AWARD: Prior to the expiry of the period of tender validity, ECILmay notify the successful bidder in writing that its tender has been accepted. A detailedpurchase order complete with agreed technical and commercial terms and conditionswould be issued to the successful Bidder. Successful Bidder will be required toacknowledge the receipt and acceptance of the purchase Order. The EMD ofunsuccessful bidders will be refunded without interest.

26. SEVERABILITY OF CONTRACT: The order resulting from the Tender shall betreated as an individual contract, and it shall not create any general lien to the bidder,and shall not get prejudiced in execution due to any situation arising out of some othercontract that the bidder may have with ECIL. Bidder shall not further Sub-Contract thisorder or part there of any other party / firm without prior approval of ECIL.27. INSPECTION AND ACCEPTANCE: The electrical materials will be inspected byECIL at supplier’s premises.. Though the parts will be inspected by ECIL, this will notabsolve the supplier of their responsibility for the rectification of defects if any, forsatisfactory performance, without any extra cost to ECIL. Inspection calls shall be given15 days in advance by the supplier for electrical items as per Appendix-I of Volume-II.28. INSURANCE: The transit insurance of the items shall be arranged by the suppliercovering all transit risks up to the destination. The Insurance charges are to be includedin the quoted prices.29. TERMS OF PAYMENT:a) 70% of the value for supply of electrical items (plus taxes & duties) as per Appendix-Iof Volume-II will be made within 30 days from the date of receipt at designated location,acceptance of items duly certified by authorized representative of ECIL and challan /bills submitted by the bidder.b) Balance 30% of the value for supply of electrical items (plus taxes & duties) as perAppendix-I of Volume-II on pro-rata basis(1/9 th electrical items cost) station wise alongwith 100% Execution charges for the corresponding station for the works executed asper Appendix-II of Volume-II will be made within thirty (30) working days of certificationof handing over and taking over.30. LIQUIDATED DAMAGES: In the event of any delay in supply beyond the agreeddelivery schedule, liquidated damages will be recovered @ 0.5% per week of delay orpart thereof subject to a maximum of 10% of the value of the order.31. RISK PURCHASE: In case if the firm fails to execute the contract within the time(s)specified/agreed upon, ECIL reserve the right to arrange the procurement /purchase/execution of the parts / items/works from any other alternate sources and thedifference in the cost, if any, and all other expenses incidental there to shall berecovered from the firm.

32. SECURITY DEPOSIT (SD): The successful bidder will be required to remit aSecurity Deposit 10% of order value for site electrical works as per Appendix-XI ofVolume-I(Price Bid) exclusive of taxes and duties etc after adjusting the EMD amountalready remitted. SD is to be remitted along with the Order Acceptance in the form of acrossed Bank Draft favoring “ELECTRONICS CORPORATION OF INDIA LIMITED” or aPERFORMANCE BANK GUARANTEE from a nationalized bank payable at Hyderabad/Secunderabad. The Security Deposit will be forfeited in the event of failure to executethe Purchase Order. Bank guarantee format is given at Appendix-II of Volume-I.33. REFUND OF SECURITY DEPOSIT: The Security Deposit will be refunded withoutinterest after the Purchase Order is successfully executed to the satisfaction of thePurchaser and completion of period of liability.34. Period of Liability: The contractor shall maintain the works for a period of Three (3)months from the date of handing over and taking over. Any damage or defect of theitems supplied or works done in the course of execution up to the liability period shall bemade good by the contractor at his own expenses.35. EXEMPTIONS: Registered Small Scale Industries (SSI’s) can avail exemption fromEMD by producing a copy of their valid Registration Certificates along with the Part I ofthe bid. However, there is no exemption for tender fee of Rs 1000/-.36. STATUTORY REGULATIONS: For work required to be carried out at deliveredsites premises, the bidder shall have to comply with all statutory Rules & Regulationssuch as ESI, PF Act, family Pension Scheme, etc.37. ALTERNATE DISPUTE RESOLUTION: Any dispute(s) arising out of this tender orthe resulting contract/ Purchase Order or interpretation of any clause(s) or term(s) andcondition(s) hereof shall be settled by the purchaser and supplier/ contractor under thespecific provisions of the Indian Arbitration and Conciliation Act 1996.38. JURISDICTION OF COURTS: The tender and the contract resulting from it, if any,shall be governed by the laws of India. Only courts in Ranga Reddy District or inHyderabad and Secunderabad in Andhra Pradesh shall have exclusive jurisdiction overthe dispute, if any, notwithstanding claims for concurrent jurisdiction of other courts.

39. INSTRUCTIONS TO BIDDERS1. The supplier shall submit along with Part-I of the tender, original tender documents(Volume-I and Volume-II) duly signed and stamped on each page. No cutting oroverwriting is permitted.2. Other details as required to be submitted along with Part-I (i.e Techno-CommercialPart) of the tender are given below:a) Covering letter as given at Appendix-III of Volume-I.b) Check list as per Appendix-IV of Volume-I.c) Information about tenderer as per Appendix-V of Volume-I.d) List of Enclosures as described at Appendix-VI of Volume-I.e) Details of works executed/concurrent commitments as per Appendix-VII ofVolume-I.f) Exceptions and Deviations as per Appendix-VIII of Volume-I.g) Compliance statement filled in the formats as given in Appendix-IX ofVolume-I.PRICE DETAILS SHALL NOT BE GIVEN IN PART-I.3. Part-II shall contain:a) Price Bids only as per Appendix-X and Appendix-XI of Volume-I.b) Conditional offers will not be acceptedc) Overwriting or cutting will not be permitted4. The bidder should have minimum 3 Years experience in executing similar works andhaving average turnover of Rs 20 Lakhs for the last three years. The supplier’sshould have executed 2 similar works each of value not less than Rs 5 lakhs or onesimilar work cost not less than Rs 10 Lakhs in the last 3 years. The supplier’s shallsubmit proof of certifications, agreements, rate contract from central-stateGovernment organization and balance sheets.5. The bidder should submit the proof of Excise duty and Sales tax, VAT registrations,Service Tax Registration.6. The price bid should contain the following details clearly:a) Unit price of each item and final priceb) Sales tax as applicable / VAT as applicable.

c) Excise duty if applicable (acceptance of exemption certificate should beconfirmed).d) Packing, forwarding and freight charges.7. Time is the essence of the contract and hence all the material to be delivered at thedesignated destination within the delivery period stipulated in the purchase orderand all works shall be executed at various sites within the stipulated period in thePO.8. The bidders while submitting the tender should invariably submit Income Tax PANNo.9. Any bid received after the expiry of the date and time prescribed for receiving thecompleted bids shall not be considered.10.
