The Police Order 2002 75Assembly fall short <strong>of</strong> the required number <strong>of</strong> such members, the vacant seat shall be allocatedto independent members:Provided further that in case <strong>of</strong> non-availability <strong>of</strong> a woman member <strong>of</strong> the ProvincialAssembly or National Assembly in a District, the seat shall be allocated to a woman independentmember;(b) one-third members, <strong>of</strong> whom one shall be a woman, shall be appointed as independent membersby the Government from a list <strong>of</strong> names recommended by the Selection Panel; and(c) the remaining one-third members, out <strong>of</strong> whom one shall be a woman, shall be elected by theZila Council from amongst its members on the basis <strong>of</strong> each member casting only one vote infavour <strong>of</strong> any contesting candidate through secret ballot.Explanation.- For the purpose <strong>of</strong> this Article, the “District concerned” for women members <strong>of</strong> the ProvincialAssembly and National Assembly shall, as far as possible, be on the basis <strong>of</strong> the District where they are registered asvoters.(2) In place <strong>of</strong> the members referred to in paragraphs (b) and (c) <strong>of</strong> clause (1), the elected or appointedmembers <strong>of</strong> the erstwhile District Public Safety <strong>Commission</strong> in the respective numbers holding <strong>of</strong>fice on thecommencement <strong>of</strong> the Police Order (Amendment) Ordinance, 2004, shall continue to hold their <strong>of</strong>fices till completion<strong>of</strong> their term <strong>of</strong> <strong>of</strong>fice as member <strong>of</strong> the District Public Safety and Police Complaints <strong>Commission</strong>.(3) The Chairperson <strong>of</strong> the District Selection Panel shall conduct the election <strong>of</strong> the Chairman andmembers <strong>of</strong> the District Public Safety and Police Complaints <strong>Commission</strong> referred to in clause (1) <strong>of</strong> Article 39 andparagraph (c) <strong>of</strong> clause (1) <strong>of</strong> this Article.(4) The names <strong>of</strong> the members <strong>of</strong> the <strong>Commission</strong> shall be notified in the Official Gazette.]39[39. Appointment <strong>of</strong> Chairperson.-(1) The Chairperson <strong>of</strong> the District Public Safety and Police Complaints<strong>Commission</strong> shall be elected by the members from amongst themselves every three years:Provided that the Chairperson <strong>of</strong> the District Public Safety <strong>Commission</strong> at the commencement <strong>of</strong>the Police Order (Amendment) Ordinance, 2004, shall continue to hold such <strong>of</strong>fice till completion <strong>of</strong> his term <strong>of</strong><strong>of</strong>fice as Chairperson <strong>of</strong> the District Public Safety and Police Complaints <strong>Commission</strong>.(2) The Chairperson <strong>of</strong> the District Public Safety and Police Complaints <strong>Commission</strong> shall be eligiblefor re-election for the second term.(3) The Chairperson <strong>of</strong> the District Public Safety and Police Complaints <strong>Commission</strong> shall not beremoved from his <strong>of</strong>fice save as provided for removal <strong>of</strong> a member <strong>of</strong> the <strong>Commission</strong>.(4) The Chairperson shall be entitled to honoraria and privileges as may be determined by the Government.]40. Meeting in the absence <strong>of</strong> the Chairperson. - In the absence <strong>of</strong> the Chairperson the District Public Safety40[and Police Complaints] <strong>Commission</strong> shall elect one <strong>of</strong> its member to preside over a meeting.41. Selection <strong>of</strong> independent members. - (1) There shall be a Selection Panel for independent members consisting<strong>of</strong> District and Sessions Judge who shall be its Chairperson and one nominee each <strong>of</strong> the Provincial Government andthe 41 [Provincial Public Safety and Police Complaints <strong>Commission</strong>]:Provided that such nominee shall not be elected representative or public servant.(2) The selection <strong>of</strong> independent members shall be by 42 [majority vote, one <strong>of</strong> whom shall be theChairperson <strong>of</strong> the Selection Panel.](3) The selection process shall be completed within thirty days from the 43 [occurrence <strong>of</strong> the vacancy].(4) Independent members shall be <strong>of</strong> impeccable integrity and proven pr<strong>of</strong>essional competence in suchfields as social work, law, administration, education, corporate sector, etc44[42. Functions <strong>of</strong> the Selection Panel.- The Selection Panel shall identify suitable candidates as well as invite
