The Punjab Police Act 2010 (Draft) 27(g) Secretary to the Government <strong>of</strong> the Punjab, Home Department; and(h) Provincial Police Officer as the Council’s secretary.(2) Any vacancy in the Council shall be filled up as soon as practicable, but not later than one month <strong>of</strong>occurrence <strong>of</strong> the vacancy.(3) Each member shall have a right to caste a vote in the matters <strong>of</strong> the Council except those mentionedat (e) to (h) in sub-section (1) above.86. Gender Representation. -There shall be at least two women among the members nominated by the ChiefMinister.87. Meeting in the absence <strong>of</strong> the Chairperson. -In the absence <strong>of</strong> the Chairperson the Law Minister shall presideover a meeting.88. Powers and Functions <strong>of</strong> the Provincial Police Council. – (1) The Council may(a) frame policy guidelines for promoting efficient, effective, responsive and accountable policing, inaccordance with the law;(b) identify performance indicators to evaluate the functioning <strong>of</strong> the Punjab Police. Such indicatorsshall, inter alia, include: operational efficiency, public satisfaction, victim satisfaction vis-à-vispolice investigation and response, accountability, optimum utilization <strong>of</strong> resources, and observance<strong>of</strong> human rights standards;(c) direct Provincial Police Officer to evaluate performance <strong>of</strong> the Punjab Police using performanceindicators identified by the Council and submit to the Council by the end <strong>of</strong> August this evaluation inan annual report for each completed financial year;(d) review performance <strong>of</strong> the police in the Punjab as a whole as well as district-wise in the light <strong>of</strong> theannual report from the Provincial Police Officer keeping in view the resources available with andconstraints <strong>of</strong> the police;(e) refer a complaint to a District Police Council for action under section 35.(2) The report mentioned in sub-section (1)(c) above shall deemed to be the annual administrationreport <strong>of</strong> the Police Department as required by rules or any other law.89. Terms <strong>of</strong> members <strong>of</strong> the Provincial Police Council. -(1) A Member <strong>of</strong> the Provincial Assembly shall continueto be a member <strong>of</strong> the Council till the expiry <strong>of</strong> his elected term unless he ceases to be a Member <strong>of</strong> the ProvincialAssembly.(2) The term <strong>of</strong> an independent member shall be three years unless he resigns or is removed undersection 90 below.90. Removal <strong>of</strong> Members. – (1) On grounds contained in section 77 above the Chief Minister may terminate theCouncil’s membership <strong>of</strong> any <strong>of</strong> the MPAs.(2) An independent member may be removed by a majority vote <strong>of</strong> the total voting membership <strong>of</strong> theCouncil on grounds contained in section 77 above.91. Meetings and conduct <strong>of</strong> business <strong>of</strong> the Provincial Police Council. -(1) The business <strong>of</strong> the ProvincialPolice Council shall be conducted by the Council in a meeting.(2) The meeting may be convened either by the Chairperson on his own or by the Secretary on therequisition <strong>of</strong> one-third <strong>of</strong> total members.(3) Quorum for a meeting <strong>of</strong> the Provincial Police Council shall be a half <strong>of</strong> its total membership.(4) Members shall attend meetings <strong>of</strong> the Council as and when required for which at least a week’snotice, with agenda, shall be given. The Council shall meet at least once a month. An emergency meeting may be heldat a short notice <strong>of</strong> not less than twenty-four hours.(5) The Council may frame rules <strong>of</strong> procedure for conduct <strong>of</strong> its business.
