116Revisiting Police Lawswomen.(4) The Naib Zila Nazim shall request the Chairperson <strong>of</strong> the District Selection Panel to conduct the election <strong>of</strong> themembers <strong>of</strong> the District Public Safety <strong>Commission</strong> referred to in clause (1).(5) The appointment <strong>of</strong> members shall be notified in the Official Gazette” substituted vide the Police Order (Amendment)Ordinance, 2009.39. Article “39. Appointment <strong>of</strong> Chairperson. - (1) The Chairperson shall be elected by the members from amongstthemselves annually alternating between independent and elected members.(2) The Chairperson shall preside over the meetings <strong>of</strong> the <strong>Commission</strong>” substituted vide the Police Order (Amendment)Ordinance, 2009.40. Inserted vide the Police Order (Amendment) Ordinance, 2009.41. The words “District Government” substituted vide the Police Order (Amendment) Ordinance, 2009.42. The word “consensus” substituted vide the Police Order (Amendment) Ordinance, 2009.43. The words “commencement <strong>of</strong> the selection process” substituted vide the Police Order (Amendment) Ordinance,2009.44. Article “42. Functions <strong>of</strong> the Selection Panel. -The selection panel shall invite applications or nominations from thepublic for selection <strong>of</strong> independent members, and after interviewing eligible and willing candidates, forward names <strong>of</strong>persons twice the number <strong>of</strong> appointments to be made to the Governor <strong>of</strong> the Province” substituted vide the PoliceOrder (Amendment) Ordinance, 2009.45. Inserted vide the Police Order (Amendment) Ordinance, 2009.46. Article “44. Functions <strong>of</strong> the District Public Safety <strong>Commission</strong>. - The District Public Safety <strong>Commission</strong> shall performthe following functions including those related to complaints against the police:-(a)approve an annual Local Policing Plan prepared by the District Police Officer in consultation with the Zila Nazimsetting out the arrangements for the policing during the year: Provided that such Policing Plan shall include –(i) a statement <strong>of</strong> the financial resources expected to be made available by the Provincial Government; and(ii) performance targets for the year and their delivery mechanism;(b) evaluate the delivery <strong>of</strong> performance targets contained in the Local Policing Plan on quarterly basis and sendhalf-yearly reports to Zila Nazim, Tehsil Nazim, Provincial Government, Provincial Public Safety <strong>Commission</strong> andProvincial Police Officer;(c) encourage police-public cooperation;(d) provide recourse to District Police Officer or City Police Officer for reporting against any unlawful or malafideorder or request for police support from any authority received by him or any <strong>of</strong>ficer subordinate to him and givea decision thereon which shall prevail;(e)(f)refer the matter in writing to the Provincial Government for appropriate action where the District Public Safety<strong>Commission</strong> is satisfied that a collusive relationship detrimental to the interest <strong>of</strong> the people exists between theZila Nazim and District Police Officer or City Police Officer: Provided that before making such report the DistrictPolice Officer or City Police Officer and the Zila Nazim shall be given an opportunity to be heard in person toexplain their respective positions;direct the District Police Officer or City Police Officer as to disposal <strong>of</strong> unclaimed property under clause (4) <strong>of</strong>Article 135.(g) direct the District Police Officer or City Police Officer in writing, where the District Public Safety <strong>Commission</strong> hasreasons to believe that the head <strong>of</strong> the police station has unjustifiably refused or avoided to register any FirstInformation Report, to conduct an inquiry into the matter and cause the registration <strong>of</strong> the First InformationReport under section 154 <strong>of</strong> the Code, if any cognizable case is made out from the allegations <strong>of</strong> the complainantand report to the District Public Safety <strong>Commission</strong> within forty-eight hours the action taken by him;(h) on receipt <strong>of</strong> a complaint <strong>of</strong> excess by a police <strong>of</strong>ficer;(i) direct the District Police Officer or City Police Officer in writing to take appropriate action and submit areport within a specified period; or(ii)conduct a fact finding enquiry through two or more <strong>of</strong> its members, and in case the complaint is found
