96Revisiting Police Laws145. Penalty for contravention <strong>of</strong> orders under Articles 131 and 132. - Whoever contravenes any order madeunder Article 131 and Article 132 shall, on conviction, be punished with imprisonment for a term, which may extendto three years, or with fine up to one hundred thousand rupees, or with both.146. Penalty for obtaining employment as a police <strong>of</strong>ficer through fraudulent means.-Any person who makesa false statement or a statement which is misleading in material particulars or uses a false document for the purpose<strong>of</strong> obtaining employment as a police <strong>of</strong>ficer shall on conviction be punished with imprisonment for a term which mayextend to one year, or with fine up to fifty thousand rupees, or with both.147. Warning to first <strong>of</strong>fender. - It shall be lawful for Head <strong>of</strong> District Police or any other <strong>of</strong>ficer authorized byhim not below the rank <strong>of</strong> Inspector, to request the relevant court to issue in lieu <strong>of</strong> prosecution, a warning in writingto the accused in relation to first commission <strong>of</strong> any <strong>of</strong>fence mentioned in Articles 138 to 140:Provided that for any subsequent <strong>of</strong>fence mentioned in this Article the <strong>of</strong>fender on conviction willbe awarded at least half <strong>of</strong> the prescribed punishment.148 Defiling water in public wells, etc. - Whoever shall de<strong>file</strong> or cause to be de<strong>file</strong>d water in any public well, tank,reservoir, pond, pool, aqueduct or part <strong>of</strong> a river, stream, nullah or other source or means <strong>of</strong> water supply, so as torender the same unfit for the purpose for which it is set apart, shall on conviction be punished with imprisonment fora term which may extend to six months or with fine which may extend to thirty thousand rupees, or with both.149. False alarm <strong>of</strong> fire, etc. -Whoever knowingly gives or causes to be given a false alarm <strong>of</strong> fire to the firebrigade or to any <strong>of</strong>ficer or fireman there<strong>of</strong> shall on conviction be punished with imprisonment for a term which mayextend to three months or with fine which may extend to fifteen thousand rupees, or with both.150. Penalty for contravention <strong>of</strong> orders made under Article 124. - Whoever contravenes, or abets thecontravention <strong>of</strong> any order made under Article 124 shall, on conviction, be punished with imprisonment which mayextend to three months, or with fine which may extend to ten thousand rupees or with both.151. Penalty for unauthorized use <strong>of</strong> police uniform. - If any person not being a member <strong>of</strong> the police wearswithout authorisation, the uniform <strong>of</strong> police or any dress having the appearance or bearing any <strong>of</strong> the distinctivemarks <strong>of</strong> police uniform, he shall, on conviction, be punished with imprisonment for a term which may extend tothree years, or with fine up to one hundred thousand rupees, or with both.152. Penalty for frivolous or vexatious complaint. – Any person who <strong>file</strong>s a complaint against the police,which on enquiry by the 118 [Federal] Police Complaints Authority is held frivolous or vexatious, shall be punished onconviction with imprisonment for six months, or with fine, which may extend to fifty thousand rupees, or with both.153. Certain <strong>of</strong>fences to be cognizable. - Notwithstanding anything contained in the Code, <strong>of</strong>fences falling underArticles 148 to 152 shall be cognizable.154. Power to try <strong>of</strong>fences summarily. - The court trying <strong>of</strong>fences under this chapter shall have power to try such<strong>of</strong>fences summarily in accordance with the procedure laid down for summary trial in the Code.CHAPTER XVIIOFFENCES BY AND PUNISHMENTS FOR POLICE OFFICERS155. Penalty for certain types <strong>of</strong> misconduct by police <strong>of</strong>ficers. – (1) Any police <strong>of</strong>ficer who-(a) makes for obtaining release from service as police <strong>of</strong>ficer, a false statement or a statementwhich is misleading in material particulars or uses a false document for the purpose;(b) is guilty <strong>of</strong> cowardice, or being a police <strong>of</strong>ficer <strong>of</strong> junior rank, resigns his <strong>of</strong>fice or withdrawshimself from duties without permission;(c) is guilty <strong>of</strong> any wilful breach or neglect <strong>of</strong> any provision <strong>of</strong> law or <strong>of</strong> any rule or regulation orany order which he is bound to observe or obey;(d) is guilty <strong>of</strong> any violation <strong>of</strong> duty;(e) is found in a state <strong>of</strong> intoxication, while on duty;
