Article 30<strong>the</strong> expiration of any period of disciplinary suspension, whichever occurs first. If <strong>the</strong>employee tests positive for drugs or shows a breath alcohol concentration of 0.02 orgreater, he/she will be subject to discharge.Section 15.All new equipment ordered on or after <strong>the</strong> date of ratification will be provided with quickrelease ratchets. All quick release ratchets shall be properly maintained.Section 16.The Employer shall comply with all applicable federal, state and local regulationspertaining to worker safety and health and subjects covered by Article 30. Failure to doso shall be subject to <strong>the</strong> grievance procedure and any o<strong>the</strong>r remedies prescribed bylaw.Section 17.Employees and authorized Union representatives shall have access to all writtenoccupational safety and health programs implemented, utilized or instituted by <strong>the</strong>Employer. Upon request, <strong>the</strong> Employer shall provide a copy of <strong>the</strong> program to <strong>the</strong>authorized Union representative free of charge.Section 18.The Employer shall ensure that cab integrity is maintained in accordance with <strong>the</strong>Federal Motor Carrier Safety Regulations, Part 393.84, by providing that <strong>the</strong> flooring inall motor vehicles shall be substantially constructed, free of unnecessary holes andopenings, and shall be maintained so as to minimize <strong>the</strong> entrance of fumes, exhaustgases or fires. Floors shall not be permeated with oil or o<strong>the</strong>r substances likely tocause injury to persons using <strong>the</strong> floor as a traction surface.Section 19.The Employer shall not require a driver to drive in excess of ten (10) hours within a tourof duty. It will also be <strong>the</strong> employee’s option whe<strong>the</strong>r to utilize a thirty-four (34) hourrestart or <strong>the</strong> seventy (70) hours in eight (8) day rule.Section 20.All garage facilities must be equipped with ventilation for <strong>the</strong> removal of exhaust fumesand dust.81
