77Article 302. Two (2) screw-capped self-sealing tamper-resistant urine collection bottlesof appropriate capacities.3. Instructions for specimen collection.A chain of possession form shall be completed by <strong>the</strong> hospital/clinic personnel duringspecimen collection and returned with <strong>the</strong> urine specimen before sealing <strong>the</strong> entire kit.The exterior of <strong>the</strong> collection kit must <strong>the</strong>n be secured (e.g., by placing <strong>the</strong> tamper-proofshipping seals over <strong>the</strong> outlined tab areas, or sealing <strong>the</strong> flaps if so provided). Ifpossible, have <strong>the</strong> employee initial <strong>the</strong> seals or flaps.Urine testing shall be performed in strict accordance with federally mandated laboratoryprocedures regarding screening, confirmation and reporting of results, as reflected in<strong>the</strong> Substance Abuse Policy.B. Leave of Absence Prior to Testing.An employee shall be permitted to take a leave of absence for <strong>the</strong> purpose ofundergoing treatment pursuant to an approved program of alcoholism or drug use. Theleave of absence must be requested prior to a positive test result or <strong>the</strong> commission ofany act subject to disciplinary action.Such leave of absence shall be granted on a one-time basis and shall be for amaximum of sixty (60) days unless extended by mutual agreement. While on suchleave, <strong>the</strong> employee shall not receive any of <strong>the</strong> benefits provided by this <strong>Agreement</strong> orSupplements <strong>the</strong>reto except continued accrual of seniority, nor does this provisionamend or alter <strong>the</strong> disciplinary provision.Employees requesting to return to work from a leave of absence for drug use oralcoholism shall be required to submit to testing as provided for in Part (E) of thisSection. Failure to do so will subject <strong>the</strong> employee to discipline including dischargewithout <strong>the</strong> receipt of a prior warning letter.The above provisions shall not apply to probationary employees.C. Disposition in Event of Positive Test ResultFederal regulations provide specific consequences for employees who test positive for<strong>the</strong> misuse of alcohol and <strong>the</strong> use of controlled substances. In addition, suchemployees may be subject to discipline, up to and including discharge, depending upon<strong>the</strong> circumstances surrounding <strong>the</strong> taking of <strong>the</strong> test and <strong>the</strong> nature of <strong>the</strong> test results.Based upon those regulations, policies and contractual terms, <strong>the</strong> followingconsequences will apply:
