Article 30f. Description of <strong>the</strong> condition sought to be remedied.g. Nature of <strong>the</strong> equipment involved, if applicable.h. A description of <strong>the</strong> remedy sought by <strong>the</strong> moving party.The completed form shall be sent to <strong>the</strong> <strong>National</strong> Committee Co-Chairpersons alongwith <strong>the</strong> Local Union and Employer's written positions concerning <strong>the</strong> alleged dispute.This information must be submitted to <strong>the</strong> <strong>National</strong> Co-Chairpersons within ten (10)days of <strong>the</strong> local level hearing.5. Within ten (10) days of receipt of <strong>the</strong> aforementioned information two ormore subcommittee members shall be designated by <strong>the</strong> <strong>National</strong> Co-Chairpersons tomeet within thirty (30) days with <strong>the</strong> Local Union and Employer representatives. Theyshall submit a written report to <strong>the</strong> <strong>National</strong> Committee Co-Chairpersons setting forth<strong>the</strong>ir findings within ten (10) days after <strong>the</strong>ir meeting with <strong>the</strong> Local Union and Employerrepresentatives. The Health & Safety Subcommittee is authorized, following aninvestigation, to direct an Employer to abate any safety hazards that it has a reasonableapprehension will cause serious injury to employees or <strong>the</strong> public, as defined in Article30, Section 2(c), until <strong>the</strong> final disposition of <strong>the</strong> case at <strong>the</strong> next regularly scheduledmeeting of a panel of <strong>the</strong> <strong>National</strong> Health and Safety Committee.6. The panel of <strong>the</strong> <strong>National</strong> Health and Safety Committee shall becomposed of an equal number of Local Union and Employer representatives, at leastfour (4) in number, and shall be appointed by <strong>the</strong>ir respective Co-Chairpersons. TheCommittee shall meet on <strong>the</strong> first (1st) day of <strong>the</strong> <strong>National</strong> Joint Committee's regularlyscheduled meeting or at o<strong>the</strong>r times designated by mutual agreement by <strong>the</strong> <strong>National</strong>Co-Chairpersons. A decision of <strong>the</strong> <strong>National</strong> Health and Safety Committee shall befinal and binding on all parties, including <strong>the</strong> Local Union, <strong>the</strong> Employer and <strong>the</strong>employees affected.7. In <strong>the</strong> event <strong>the</strong> <strong>National</strong> Health and Safety Committee is unable toresolve <strong>the</strong> dispute, it shall be referred to a Board of Arbitration consistent with <strong>the</strong>provisions of Article 7, Section 9 of <strong>the</strong> <strong>National</strong> <strong>Agreement</strong>.(b) It may be necessary to secure expert advice with respect to applicablestandards, regulations, practices or procedures in order to ensure that grievances willbe decided in keeping with legally established standards, regulations, laws andrequirements. Such expert advice may be obtained by <strong>the</strong> appropriate representativesof <strong>the</strong> Employer and <strong>the</strong> Union, meeting jointly with <strong>the</strong> Occupational Safety and HealthAdministration (OSHA) Area Director or a designated representative; Office of MotorCarrier, Federal Highway Administration (OMC/FHWA) Regional Director or adesignated representative, providing complete pertinent information with respect to67
