66Article 30disputes cannot be resolved, such disputes shall be submitted to <strong>the</strong> appropriate Healthand Safety Committee.Section 2.The parties agree that <strong>the</strong> Local Unions, <strong>the</strong> employees and <strong>the</strong> Employers signatory tothis <strong>Agreement</strong> are obligated to file and process all grievances or complaints involvingalleged unsafe or unhealthful workplace conditions pursuant to <strong>the</strong> grievanceprocedures of <strong>the</strong> <strong>Agreement</strong> in accordance with <strong>the</strong> following procedures:(a) When <strong>the</strong> appropriate Local Union representative receives a writtengrievance with respect to an occupational safety or health issue, such alleged unsafe orunhealthful condition shall be carefully scrutinized by <strong>the</strong> Local Union Representative todetermine if <strong>the</strong>re is a violation of any legal safety or health standard/regulation orreadily apparent safety or health hazard.1. The <strong>National</strong> Committee Co-Chairpersons shall designate a StandingHealth & Safety Subcommittee composed of eight (8) members consisting of an equalnumber of Local Union and Employer representatives.2. A grievance alleging a violation of Article 30, excluding Section 14, shallfirst be discussed by <strong>the</strong> Local Union with <strong>the</strong> designated Company representativewithin thirty (30) days of <strong>the</strong> incident leading to <strong>the</strong> dispute. The nature of <strong>the</strong> disputeshall be reduced to writing and submitted to <strong>the</strong> appropriate Company representatives.3. A local level hearing shall be conducted by <strong>the</strong> Local Union andCompany within ten (10) days after <strong>the</strong> written grievance is submitted to <strong>the</strong> Company.4. In <strong>the</strong> event <strong>the</strong> Article 30 dispute is not resolved at <strong>the</strong> local levelhearing, <strong>the</strong> Local Union and Employer shall jointly prepare a form which shall contain<strong>the</strong> following information.a. Specific nature of <strong>the</strong> violation.b. Date or dates on which <strong>the</strong> violation occurred.c. Employee or employees affected by <strong>the</strong> alleged violation.d. The specific provision of <strong>the</strong> contract, federal or state statute orregulation involved in <strong>the</strong> Article 30 dispute.e. Pending governmental agency or judicial proceedings, if any,involving <strong>the</strong> same subject matter.
