Article 27At locations where border crossing is a regular part of the Employer’s business, FastPass or any other expedited system that becomes available will be obtained by theEmployer to expedite crossing into or out of Canada.No employee will be required to have their driver’s license reproduced in any mannerexcept by their employer, law enforcement agencies, government facilities and facilitiesoperating under government contracts that require such identification to enter thefacility.ARTICLE 28.USA-CANADA-MEXICOVehicles destined for delivery via truck transportation from the U.S. to Canada andvice-versa, or from the U.S. to Mexico and vice-versa, shall be delivered to an agreedterminal or marshaling area, from which point final delivery of the automotive vehiclesshall be made by the drivers in their respective countries. Present agreed practicesshall remain in effect.The parties recognize the mutual interest in implementing slip seat operations as ameans of enhancing efficiency and promoting work opportunities. It is agreed that uponthe request of an Employer, a Local Union will negotiate an Agreement for slip seatoperations within the Continental United States. If the parties are unable to reach asatisfactory agreement, the matter shall be referred to the National Committee.Agreements regarding slip seat operations must be approved by the affectedmembership and National Committee prior to implementation.Moreover, the parties recognize the need to protect job security for both U.S. andCanadian domiciled Teamster employees, and the Union and Employer agree toestablish a Standing Committee consisting of an equal number of U.S. Companyrepresentatives, U.S. Teamster representatives, Canadian Company representativesand Canadian Teamster representatives. This Standing Committee shall meet at leastsemi-annually and as otherwise necessary to discuss and jointly recommend to theirrespective Union and Employer Negotiating Committees actions to improve operationalobjectives, increase work opportunities and further the interests of all affected parties.It is also recognized that business opportunities and customer demands arise whichinvolve the potential for diversion of cross border traffic and/or support in the respectivecountries to meet temporary demands enhancing the ability to provide additionalbargaining unit jobs and job security for existing employees. To that end, the partiesagree that if a particular Employer or Local Union identifies such opportunities andnotifies the Co-Chairmen of the National Negotiating Committee of same, those Co-Chairmen will promptly facilitate discussions between the involved U.S. and Canadian64
Article 28Local Unions in an attempt to bring about an agreement as to how to fully capitalize onthe opportunities in a manner that is equitable to the employees who would be involved.The parties agree to reopen the provisions of this Article for modification if a significantand relevant change in the law is made which affects transportation across the bordersto Canada or Mexico.ARTICLE 29.JUMBO JETSIt is recognized by both Employers and Unions that during the term of this contractthere will come into existence a new and radically different distribution system bymanufacturers because of their use of jumbo jets. The parties have reason to believethat instead of being adversely affected as in the case of the tri-level rail cars, theEmployers and the Unions could work out an industry plan which would induce themanufacturers to expand their use of truck transportation as a permanent part of theircontemplated distribution system.To carry out such objectives, the National Joint Negotiating Committee shall establish apermanent subcommittee to meet, discuss and carry out any negotiations withrepresentatives of manufacturers and make recommendations to the National JointNegotiating Committee, which Committee shall, after full hearing, and after furtherinvestigation and study, if necessary, make final decisions as it may deem necessary toaccomplish the aforementioned objectives.Section 1.ARTICLE 30.JOINT HEALTH AND SAFETY COMMITTEE(a) The Employers and the Unions together shall create National and Area JointCommittees of qualified representatives for the purpose of consulting amongthemselves and with appropriate government agencies, state and federal, on mattersinvolving safety and health of the employees, including highway and equipment safety.(b) At each terminal location, the Employer and the Local Union shall form aLocal Joint Safety Committee composed of both Employer representatives andemployees designated by the Local Union, in writing, not to exceed three (3) in number,or any other mutually acceptable number. The Local Joint Safety Committee shall meetat mutually acceptable times and places in order to investigate and adjust mattersinvolving health and safety, damage prevention and night time deliveries.
