Article 24opportunity presents itself. During this leave of absence <strong>the</strong> Employer shall have noobligation to make health and welfare or pension contributions on behalf of <strong>the</strong>employee.ARTICLE 25.PASSENGERSNo driver shall allow anyone, o<strong>the</strong>r than employees of <strong>the</strong> Employer who are on duty, toride on <strong>the</strong> driver's truck, except by written authorization of <strong>the</strong> Employer, or except incases of emergency arising out of disabled commercial equipment or an Act of God.This shall not prohibit drivers from picking up o<strong>the</strong>r drivers, helpers or o<strong>the</strong>rs in wreckedor broken down motor equipment and transporting <strong>the</strong>m to <strong>the</strong> first available point ofcommunication, repair, lodging or available medical attention. This shall not prohibit <strong>the</strong>transportation of o<strong>the</strong>r drivers from <strong>the</strong> driver's own Employer at a delivery point orterminal to a restaurant for meals where permission has been granted.ARTICLE 26.NONDISCRIMINATIONThe Employer and <strong>the</strong> Union agree nei<strong>the</strong>r to discriminate against any individual withrespect to hiring, compensation, terms or conditions of employment because of suchindividual's age, race, color, religion, sex, national origin, or disability, nor will <strong>the</strong>y limit,segregate or classify employees in any way to deprive any individual employee ofemployment opportunities because of age, race, color, religion, sex or national origin ordisability.The Union and Employer agree to abide by <strong>the</strong> provisions of <strong>the</strong> Americans withDisabilities Act or pertinent state laws. The Employer shall negotiate with <strong>the</strong> LocalUnion before providing a reasonable accommodation to a qualified bargaining unitemployee. Any disputes arising under this provision shall be subject to <strong>the</strong> grievanceprocedure.Nothing herein (in seniority or o<strong>the</strong>r provisions contained in this <strong>National</strong> <strong>Master</strong><strong>Agreement</strong> or any approved Area Supplement) shall be construed or applied to deny toany employee <strong>the</strong> employment opportunities set forth above.Any alleged denial of <strong>the</strong> aforesaid opportunities in violation of this Article shall besubmitted to <strong>the</strong> grievance procedure.In those terminals where classification seniority applies, <strong>the</strong> parties agree that in fillingvacancies with qualified employees which occur subsequent to <strong>the</strong> execution of this62
