Article 13within <strong>the</strong> meaning of Section 302(c)(9) of <strong>the</strong> LMRA, as amended, established andfunctioning so as to fulfill one or more of <strong>the</strong> purposes set forth in Section 6(c)(2) of <strong>the</strong>Labor Management Cooperation Act of 1978. The Committee shall have <strong>the</strong> fullsupport and commitment of both <strong>the</strong> International Bro<strong>the</strong>rhood of Teamsters and <strong>the</strong>Employer Association or Employer, where applicable, in Committee's efforts to identifyproblems, formulate plans to solve those problems and, where appropriate, conductjoint activities designed to implement <strong>the</strong> plans.The Union and Employer Association or Employer, where applicable, will establishprocedures for <strong>the</strong> operation of this Committee.Section 3.The Employer and <strong>the</strong> Union toge<strong>the</strong>r shall establish a <strong>National</strong> Health Benefits JointCommittee to review <strong>the</strong> provision of health benefits to employees covered by this<strong>Agreement</strong>. This Committee is charged with <strong>the</strong> critical responsibility of ensuring thatemployee health benefits are made available to employees covered by <strong>the</strong> terms of <strong>the</strong><strong>National</strong> <strong>Master</strong> <strong>Automobile</strong> <strong>Transporters</strong> <strong>Agreement</strong> in a secure and cost-efficientmanner.It is anticipated that this Committee shall serve as a source of continuing studyregarding <strong>the</strong> most efficient manner of providing health benefits to covered employeesand as a source of continuing guidance, particularly in those instances where anexisting Health and Welfare Fund is not capable of maintaining benefits within <strong>the</strong>contribution level provided under <strong>the</strong> terms of this <strong>Agreement</strong>. To <strong>the</strong> extent coveredemployees might suffer a reduction in benefits due to <strong>the</strong> inability of a Health andWelfare Fund to continue to provide existing benefits within <strong>the</strong> contribution amountprovided hereunder, <strong>the</strong> Joint Committee shall have <strong>the</strong> responsibility of makingrecommendations to <strong>the</strong> affected employees and <strong>the</strong>ir Local Unions concerningalternative methods, if possible, of securing comparable health benefits.The Employer and <strong>the</strong> Union will establish procedures for <strong>the</strong> operation of thisCommittee. The Committee will make periodic reports and recommendations to <strong>the</strong><strong>National</strong> Negotiating Committee concerning <strong>the</strong> payment for health services by <strong>the</strong>jointly administered Health and Welfare Funds receiving contributions under <strong>the</strong> termsof this <strong>Agreement</strong>.52
