Article 11ARTICLE 11.MILITARY CLAUSEEmployees enlisting or entering the military service of the United States, as defined bythe provisions of the Uniform Services Employment and Reemployment Rights Act(USERRA), Title 38, U.S. Code Chapter 43, shall be granted all rights and privilegesprovided by USERRA and/or other applicable state and federal laws.The Employer shall pay the health and welfare and pension fund contributions onemployees on leaves of absence for training in the military reserves or National Guard,but not to exceed thirty (30) days maximum within a calendar year, providing suchabsence affects the employee's credits or coverage for health and welfare and/orpensions.Effective the date of ratification, the Employer shall continue to pay Health & Welfarecontributions for regular active employees involuntarily called to active duty status fromthe military reserves or the National Guard during periods of war or military conflict.Such contributions shall only be paid for a maximum period of twenty-four (24) months.Section 1.Posting of AgreementARTICLE 12.A copy of this Agreement shall be posted in a conspicuous place in each garage andterminal.Section 2.Union Bulletin BoardsThe Employer agrees to provide suitable space for the Union bulletin board in eachgarage, terminal or place of work. Posting by the Union on such boards is to beconfined to official business of the Union.The Union bulletin board shall be glassed-in with a lock for which the Employer and thesteward shall have a key.50
Article 12Section 3.Lie DetectorNo employee shall be required to take any form of lie detector test as a condition ofemployment.Section 4.The Employer may not use video cameras to discipline or discharge an employee forreasons other than theft of property or dishonesty. If the information on a videotape isto be used to discipline or discharge an employee for theft or dishonesty, the Employermust provide the Local Union, prior to the hearing an opportunity to review thevideotape used by the Employer to support the discipline or discharge.Section 1.ARTICLE 13.UNION AND EMPLOYER COOPERATIONThe Union, its members, and the Employer agree at all times, as fully as it may bewithin their power, to further their mutual interest and interests of the AutomobileTransporter Industry and the International Brotherhood of Teamsters nationwide.The Union and the Employer recognize the principle of a fair day's work for a fair day'spay; that jobs and job security of employees working under this Agreement are bestprotected through efficient and productive operations of the Employer and theAutomobile Transporter Industry. The Employer may establish reasonable workstandards which shall take into account all factors relating to the work assignment, run,terminal and territorial operational conditions, subject to agreement and approval withthe Local Union, and to be filed for approval with the Area Joint Arbitration Committee.Section 2.Committee on Industry DevelopmentThe Union and Employer Association or Employer, where applicable, agree to establisha Committee on Industry Development. The purposes of the Committee are to identifyproblems causing loss of business and jobs; to direct communication so as to educateemployees relative to long-term job security through the Employer, the Local Unionssignatory to this Agreement and when deemed necessary and appropriate, to presentthe views of the Committee to the legislative and executive branches of the federal andstate government. This Committee shall operate as a labor-management committee51
