Article 10Sick pay will be paid on <strong>the</strong> day that an employee notifies <strong>the</strong> Employer of an illness orinjury. However, <strong>the</strong> first day sick pay will not be paid if <strong>the</strong> first day of absence is <strong>the</strong>day immediately preceding or following a paid holiday or scheduled vacation, in whichcase <strong>the</strong> employee must be absent three (3) consecutive days and sick pay will <strong>the</strong>n bepaid retroactive to <strong>the</strong> first day of absence.(c) Truckaway or driveaway drivers with bid schedules shall be treated as localemployees with a standard workweek. Line drivers on sleepers or rotating boards willbe treated as having a seven (7) day operation with no off days for <strong>the</strong> purpose ofcomputing qualifying workdays.(d) Sick leave does not establish <strong>the</strong> need for a doctor's statement before sickleave benefits are paid. However, sick leave shall not interfere with an establishedprocedure that requires an employee to have a doctor's statement before returning towork.(e) Employees on <strong>the</strong> inactive seniority roster prior to June 1 of a calendar yeardue to layoff or long term illness or injury are not eligible to receive sick leave. Once <strong>the</strong>employee returns to work, he shall be eligible for sick leave occurring after that date.(f) Sick leave not used by May 31st of any contract year will be paid on May 31stat <strong>the</strong> applicable hourly rate in existence on that date. Each day of sick leave will bepaid for on <strong>the</strong> basis of eight (8) hours' straight-time pay at <strong>the</strong> applicable hourly rate.Sick leave not used by May 31st of any contract year will be calculated at <strong>the</strong> applicablehourly rate in existence on that date based on <strong>the</strong> following:(1) In order to receive payment of <strong>the</strong> unused portion of sick leave upon<strong>the</strong> completion of <strong>the</strong> contract year (May 31st), <strong>the</strong> employee must have worked ninety(90) days, including holidays, vacations, and compensable jury duty, during <strong>the</strong> contractyear and <strong>the</strong> employee must have remained on <strong>the</strong> seniority roster (active or inactive)for <strong>the</strong> complete contract year (June 1st through May 31st);(2) A laid-off employee is due sick leave benefits only if that employeemeets <strong>the</strong> qualifications for payment of unused sick leave at <strong>the</strong> end of <strong>the</strong> contractyear;(3) Employees who are discharged for cause, or who voluntarily quit, arenot eligible for unused sick leave;(4) Employees who retire, die or are on workers' compensation shall beeligible for unused sick leave provided <strong>the</strong>y have worked ninety (90) days or moreduring <strong>the</strong> contract year.47
