Article 8ARTICLE 8.PROTECTION OF RIGHTSSection 1.Picket LineIt shall not be a violation of this <strong>Agreement</strong>, and it shall not be cause for discharge,disciplinary action or permanent replacement, in <strong>the</strong> event an employee refuses toenter upon any property involved in a primary labor dispute, or refuses to go through orwork beyond any primary picket line, including <strong>the</strong> primary picket line of Unions party tothis <strong>Agreement</strong>, and including primary picket lines at <strong>the</strong> Employer's place of business.Section 2.Struck GoodsIt shall not be a violation of this <strong>Agreement</strong> and it shall not be cause for discharge,disciplinary action or permanent replacement, if any employee refuses to perform anyservice which <strong>the</strong> Employer undertakes to perform as an ally of an Employer or personwhose employees are on strike, and which service, but for such strikes, would beperformed by <strong>the</strong> employees of <strong>the</strong> Employer or person on strike.Section 3.Subject to Article 33 - Work Preservation, or <strong>the</strong> appropriate work preservation orsubcontracting provisions of <strong>the</strong> Area Supplements, <strong>the</strong> Employer agrees that it will notcease or refrain from handling, using, transporting or o<strong>the</strong>rwise dealing in any of <strong>the</strong>products of any o<strong>the</strong>r Employer or cease doing business with any o<strong>the</strong>r person, or fail inany obligation imposed by <strong>the</strong> Motor Carriers' Act or o<strong>the</strong>r applicable law, as a result ofindividual employees exercising <strong>the</strong>ir rights under this <strong>Agreement</strong> or under law, but <strong>the</strong>Employer shall, notwithstanding any o<strong>the</strong>r provision in this <strong>Agreement</strong>, when necessarycontinue doing such business by o<strong>the</strong>r employees.Section 4.The layover provisions of <strong>the</strong> applicable Supplemental <strong>Agreement</strong> shall apply when <strong>the</strong>Employer knowingly dispatches a road driver to a terminal or dealer at which a primarypicket line has been posted as a result of <strong>the</strong> exhaustion of <strong>the</strong> grievance procedure, orafter proper notification of a picket line permitted by <strong>the</strong> collective bargainingagreement, or economic strikes occurring after <strong>the</strong> expiration of a collective bargainingagreement or to achieve a collective bargaining agreement.40
