Article 7(5) Claims that a decision issued by any area or multi-state JointArbitration Committee are contrary to <strong>the</strong> provisions of Articles 1 through 35 of <strong>the</strong>NMATA may be submitted to ei<strong>the</strong>r <strong>the</strong> Union or Employer Chairperson of <strong>the</strong> <strong>National</strong>Joint Arbitration Committee, and must be submitted within fifteen (15) calendar days of<strong>the</strong> date of <strong>the</strong> decision being appealed. The <strong>National</strong> Joint Arbitration Committee mayreverse or modify any such decision that ei<strong>the</strong>r <strong>the</strong> Union or Employer Chairpersondetermines to submit to it. If <strong>the</strong> <strong>National</strong> Joint Arbitration Committee fails to reach amajority decision to modify or reverse such a lower level decision, <strong>the</strong> decision shallstand as final and binding, and will not be considered deadlocked or referred to a Boardof Arbitration.(b) Area Joint Arbitration CommitteeIt shall be <strong>the</strong> function of <strong>the</strong> Area Joint Arbitration Committees to settle disputes andgrievances deadlocked or referred to it by <strong>the</strong> appropriate Multi-State Joint ArbitrationCommittee or directly filed by a party consistent with this <strong>Agreement</strong> which grievancewas not settled in accordance with Section 5 of this Article.(c) Multi-State Joint Arbitration CommitteesIt shall be <strong>the</strong> function of <strong>the</strong> various Multi-State Joint Arbitration Committees to settledisputes which have not been settled by <strong>the</strong> Employer and <strong>the</strong> Local Union inaccordance with Section 5 and <strong>the</strong> procedure <strong>the</strong>rein established.Section 8.Rights of <strong>National</strong>, Area and Multi-State Joint Arbitration Committees(a) The Joint Arbitration Committees designated in this Article shall have <strong>the</strong> rightto investigate all facts pertaining to <strong>the</strong> dispute. Both parties shall be entitled to presentsuch evidence and witnesses in support of <strong>the</strong>ir position as <strong>the</strong>y see fit.A decision by a majority of a Joint Arbitration Committee shall be final and binding on<strong>the</strong> Employer, <strong>the</strong> Local Union and <strong>the</strong> employees.(b) The Joint Arbitration Committees shall have <strong>the</strong> authority to order full, partialor no compensation in deciding disputes and/or grievances and rendering awards.(c) It is agreed that all matters pertaining to <strong>the</strong> interpretation of any provision ofthis <strong>National</strong> <strong>Agreement</strong>, whe<strong>the</strong>r requested by <strong>the</strong> Employer or <strong>the</strong> Local Union, mustbe submitted to <strong>the</strong> <strong>National</strong> <strong>Automobile</strong> <strong>Transporters</strong> Joint Arbitration Committee fordecision.33
