Article 7Each committee shall consist of designated representatives appointed by <strong>the</strong>Employers and <strong>the</strong> Local Unions from <strong>the</strong> affected geographical area. Any panel of <strong>the</strong>Multi-State or Area Joint Arbitration Committee hearing a case shall consist of an equalnumber of designated representatives of <strong>the</strong> Employers and <strong>the</strong> Local Unions. Eachmember may appoint an alternate.Section 6.Rules of ProcedureAll Joint Arbitration Committees shall formulate rules of procedure to govern <strong>the</strong>conduct of <strong>the</strong>ir proceedings. Upon adoption, all Multi-State Joint ArbitrationCommittees shall submit <strong>the</strong>ir rules to <strong>the</strong> appropriate Area Joint Arbitration Committeefor review and approval. In <strong>the</strong> event a Multi-State Joint Arbitration Committee fails toagree upon its rules of procedure, it shall refer <strong>the</strong> disputed items to <strong>the</strong> appropriateArea Joint Arbitration Committee which shall resolve <strong>the</strong> disputed items and formulaterules of procedure for adoption by <strong>the</strong> Multi-State Joint Arbitration Committee. Rules ofprocedure for Joint Arbitration Committees may not be in conflict with similar provisionsof <strong>the</strong> Rules of Procedure for <strong>the</strong> <strong>National</strong> <strong>Automobile</strong> <strong>Transporters</strong> Joint ArbitrationCommittee. If any conflict exists, <strong>the</strong> provisions of <strong>the</strong> <strong>National</strong> Committee Rules ofProcedure shall prevail.Section 7.Functions of Joint Arbitration Committees(a) <strong>National</strong> Joint Arbitration CommitteeIt shall be <strong>the</strong> function of <strong>the</strong> <strong>National</strong> Joint Arbitration Committee to settle disputes andgrievances which arise under <strong>the</strong> following circumstances:(1) Involving interpretations of, or disputes over, <strong>the</strong> provisions of <strong>the</strong><strong>National</strong> <strong>Master</strong> <strong>Automobile</strong> <strong>Transporters</strong> <strong>Agreement</strong>;(2) Disputes and grievances <strong>the</strong> determination of which affect anEmployer and/or Union operating in two (2) or more of <strong>the</strong> designated Areas if morethan one (1) area is affected by <strong>the</strong> issue;(3) Disputes and/or grievances which are deadlocked or referred by any of<strong>the</strong> four (4) Joint Area Arbitration Committees referred to above;(4) Disputes and interpretations concerning alleged conflicts in provisionsof <strong>the</strong> <strong>National</strong> <strong>Master</strong> <strong>Agreement</strong> on <strong>the</strong> one hand and Area Supplements and Riders<strong>the</strong>reto on <strong>the</strong> o<strong>the</strong>r hand.32
