(d) Nothing herein shall prevent the Employer or the Union from securingremedies granted by law except as specifically set forth in subsection 2(b).Section 3.Designation of Representatives28Article 7The Employer and Local Union must designate its representatives at each facility whoare authorized to settle grievances on the local level and must so notify each partywithin one (1) week of the consummation of this Agreement. In the event theauthorized representatives of the Employer or the Local Union change during the life ofthis Agreement, the Employer shall notify the Union or the Union shall notify theEmployer, as the case may be, within one (1) week of such change.Section 4.Grievance ProcedureThe following procedure shall be used in processing all grievances. This Sectioncontains a special provision for processing alleged pay shortages and violations of thedispatch procedure. There are separate provisions in the Supplemental Agreementsfor processing grievances involving suspensions or discharges.The provisions of subpart (b) below shall not be applicable at any terminals covered bythe Western Area Supplemental Agreement. The provisions of subpart (b) below shallnot be applicable at a terminal covered by the Central-Southern SupplementalAgreement unless the Employer and the Local Union agree in writing to make itapplicable.Step 1.(a) All grievances shall first be taken up and discussed by the employee and theEmployer.(b) Claims Involving Pay Shortages and Violations of Dispatch ProcedureAny employee who claims any pay shortage, including a claimed violation of thedispatch procedure, shall file a request for a wage review with the Employer. Thisrequest must be filed in writing within ten (10) days excluding Saturdays, Sundays andholidays after receipt of the paycheck by the employee. Multiple copies of a request forwage review in a form set forth below shall be made available by the Employer for thatpurpose. The Employer shall meet with the employee to discuss the claim as soon aspossible but no later than ten (10) days following receipt of such request excludingSaturdays, Sundays and holidays at which time the Employer shall make a written replyto the claim. If the claim is not adjusted satisfactorily, and if the employee wishes to file
Article 7a written grievance, such grievance shall be filed within ten (10) days excludingSaturdays, Sundays and holidays after the written denial of the claim. These time limitsreplace other time limits expressed in this Agreement and are firm. Failure to file orrespond on time will result in a default against the party failing to comply. Defaultsestablish no precedent on the merits of the claim.After any grievance is reduced to writing, the Employer representative will makeavailable for inspection by the business agent and/or the steward, time sheets and allsuch other records as are pertinent to the handling of the specific dispute or grievance.This does not preclude or prevent an oral attempt on the part of the business agent orthe steward to settle such dispute or grievance before a request is made for suchrecords.
