Article 5Section 2.Terminal seniority rights for all employees covered by this <strong>Agreement</strong> shall prevailunless <strong>the</strong> Supplements or o<strong>the</strong>r provisions of this <strong>Agreement</strong> provide specifically to <strong>the</strong>contrary. Because of <strong>the</strong> nature of <strong>the</strong> transportation industry in which employeestransfer during <strong>the</strong> term of <strong>the</strong>ir employment in <strong>the</strong> industry from one location to ano<strong>the</strong>ras <strong>the</strong> flow of business requires, <strong>the</strong>re are two (2) levels of seniority recognized by this<strong>Agreement</strong>. These levels are known as "company seniority" and "terminal seniority" asdefined in Section 1.The extent to which seniority shall be applied and accrued as well as <strong>the</strong> methods andprocedures of such application shall be clearly set forth, in writing, in this <strong>Agreement</strong>and in <strong>the</strong> Supplemental <strong>Agreement</strong>s, including approved Local Riders.Section 3.(a) Seniority, including for fringe benefits, shall only be broken by discharge,voluntary quit, more than a seven (7)-year layoff, except as o<strong>the</strong>rwise provided hereinor for such greater period than seven (7) years as <strong>the</strong> appropriate Joint ArbitrationCommittee may direct during <strong>the</strong> seventh (7th) year. This provision shall be uniformlyapplied throughout all Supplemental <strong>Agreement</strong>s to <strong>the</strong> <strong>National</strong> <strong>Master</strong> <strong>Automobile</strong><strong>Transporters</strong> <strong>Agreement</strong>.(b) Leave of Absence for Union ActivitiesEmployees elected or appointed to full-time Union positions shall maintain andaccumulate <strong>the</strong>ir seniority with <strong>the</strong> Employer so long as <strong>the</strong> employee maintains suchfull-time position with <strong>the</strong> Union. Such employee shall be granted a leave of absencewithout pay and be guaranteed re-employment at <strong>the</strong> end of such period with <strong>the</strong> sameseniority as though <strong>the</strong> employee had been continuously employed, provided that <strong>the</strong>employee is physically qualified to perform <strong>the</strong> duties which he/she previouslyperformed for <strong>the</strong> Employer.Section 4.Seniority lists are dovetailed in <strong>the</strong> following circumstances:(a) When <strong>the</strong> same Employer merges two (2) or more terminals;(b) When commonly owned separate Employers merge two (2) or moreterminals;17
