13Article 3In case of discipline within the thirty (30)-day trial period, the Employer shall notify theLocal Union, in writing, of such discipline.Section 3.Employment Agency FeesIf employees are hired through an employment agency, the Employer is to pay theemployment agency fee. However, if the Union was given equal opportunity to furnishemployees under Article 3, Section 1(c), and if the employee is retained through theprobationary period, the fee need not be paid until the thirty-first (31st) day ofemployment. Under no circumstances will any employee or applicant be required topay any employment agency or recruitment fees, training fees or any other fees orcosts related to the obtaining and maintaining of employment.Section 4.CheckoffThe Employer agrees to deduct from the pay of all employees covered by thisAgreement the dues, initiation fees, legally established credit union and/or uniformassessments of the Local Union having jurisdiction over such employees and agrees toremit to said Local Union all such deductions prior to the end of the month for which thededuction is made. Where laws require written authorization by the employee, the sameis to be furnished in the form required.The Employer will recognize authorization for deduction from wages, if in compliancewith state law, to be transmitted to the Union or to such other organizations as theUnion may request, if mutually agreed. No such authorization shall be recognized if inviolation of state or federal law.All monies required to be checked off shall become the property of the entities for whichit was intended at the time that such checkoff is required to be made. All moniesrequired to be checked off and paid over to other entities under this Agreement shallbecome the property of those entities for which it was intended at the time that suchpayment or checkoff is required to be made.No deduction shall be made which is prohibited by applicable law.The Employer agrees to deduct from the paycheck of all employees covered by thisAgreement voluntary contributions to DRIVE. DRIVE shall notify the Employer of theamounts designated by each contributing employee that are to be deducted fromhis/her paycheck on a weekly basis for all weeks worked. The phrase "weeks worked"excludes any week other than a week in which the employee earned a wage. TheEmployer shall transmit to DRIVE National Headquarters on a monthly basis, in one (1)
