Any employeefailing to meet the Employer requirement shall have an unqualified right to return to thejob and shift left for the Training Program. The Employer shall be obligated for only one(1) opportunity under the transferability clause for any employee.(3) Retraining Programa. At any point in the disciplinary process, involving cargo damage,at the employee's option, with Local Union agreement, the driver can be given theopportunity to enter a retraining program in lieu of the discipline. Should the driver electto enter the retraining program, the driver shall be paid at fifty percent (50%) of theregular hourly rate existing at that time until successful completion of the retrainingprogram, which shall not exceed three (3) days at eight (8) hours per day in duration.b. In addition, drivers off work longer than six (6) months due tolayoff, disability, compensable injury or leave of absence may be required to enter, atthe Employer's option, a retraining program to ensure an awareness of the currentloading and unloading policies/procedures of the Employer. The driver shall be paid atfifty percent (50%) of the regular hourly rate existing at that time until completion of theretraining program, which shall not exceed three (3) days at eight (8) hours per day induration.retraining program.c. Drivers shall not perform revenue-producing work during the(k) Nothing contained in this Section shall be construed so as to require theEmployer to violate any applicable law.Section 2.Probationary EmployeesA probationary employee shall work under the provisions of this Agreement but shall beemployed only on a thirty (30)-day trial basis, during which period the employee may beterminated without further recourse; provided, however, that the Employer may notterminate or discipline for the purpose of evading this Agreement or discriminatingagainst Union members. The Union and the Employer may agree to extend theprobationary period for no more than thirty (30) days but the probationary employeemust agree to such extension in writing. The accrual of seniority for probationaryemployees shall be determined consistent with Article 3, Section 1(j)(1), if applicable,and provided in the applicable Supplemental Agreement except as it has beenotherwise applied by the parties.12
13Article 3In case of discipline within the thirty (30)-day trial period, the Employer shall notify theLocal Union, in writing, of such discipline.Section 3.Employment Agency FeesIf employees are hired through an employment agency, the Employer is to pay theemployment agency fee. However, if the Union was given equal opportunity to furnishemployees under Article 3, Section 1(c), and if the employee is retained through theprobationary period, the fee need not be paid until the thirty-first (31st) day ofemployment. Under no circumstances will any employee or applicant be required topay any employment agency or recruitment fees, training fees or any other fees orcosts related to the obtaining and maintaining of employment.Section 4.CheckoffThe Employer agrees to deduct from the pay of all employees covered by thisAgreement the dues, initiation fees, legally established credit union and/or uniformassessments of the Local Union having jurisdiction over such employees and agrees toremit to said Local Union all such deductions prior to the end of the month for which thededuction is made. Where laws require written authorization by the employee, the sameis to be furnished in the form required.The Employer will recognize authorization for deduction from wages, if in compliancewith state law, to be transmitted to the Union or to such other organizations as theUnion may request, if mutually agreed. No such authorization shall be recognized if inviolation of state or federal law.All monies required to be checked off shall become the property of the entities for whichit was intended at the time that such checkoff is required to be made. All moniesrequired to be checked off and paid over to other entities under this Agreement shallbecome the property of those entities for which it was intended at the time that suchpayment or checkoff is required to be made.No deduction shall be made which is prohibited by applicable law.The Employer agrees to deduct from the paycheck of all employees covered by thisAgreement voluntary contributions to DRIVE. DRIVE shall notify the Employer of theamounts designated by each contributing employee that are to be deducted fromhis/her paycheck on a weekly basis for all weeks worked. The phrase "weeks worked"excludes any week other than a week in which the employee earned a wage. TheEmployer shall transmit to DRIVE National Headquarters on a monthly basis, in one (1)
