Article 3(3) In accordance with the policy set forth under subparagraphs (1) and(2) of this Section, all employees shall, as a condition of continued employment, pay tothe Union, the employee's exclusive collective bargaining representative, an amount ofmoney equal to that paid by other employees in the bargaining unit who are membersof the Union, which shall be limited to an amount of money equal to the Union's regularand usual initiation fees, and its regular and usual dues. For present employees, suchpayments shall commence thirty-one (31) days following the effective date or on thedate of execution of this Agreement, whichever is the later, and for new employees, thepayment shall start thirty-one (31) days following the date of employment.(f) If any provision of this Article is invalid under federal law or the law of anystate wherein this Agreement is executed, such provision shall be modified to complywith the requirements of federal or state law or shall be renegotiated for the purpose ofadequate replacement. If such negotiations shall not result in mutually satisfactoryagreement, either party shall be permitted all legal or economic recourse.(g) In those instances where subsection (b) hereof may not be validly applied,the Employer agrees to recommend to all employees that they become members of theLocal Union and maintain such membership during the life of this Agreement, to refernew employees to the Local Union representative, and to recommend to delinquentmembers that they pay their dues since they are receiving the benefits of thisAgreement.(h) To the extent such amendments may become permissible under applicablefederal and state law during the life of this Agreement as a result of legislative,administrative or judicial determination, all of the provisions of this Article shall beautomatically amended to embody the greater union security provisions contained inthe 1947-1952 National Truckaway Agreement, or to apply or become effective insituations not now permitted by law.(i) Supervisory or non-unit personnel shall not perform work which is recognizedby the Union and the Employer as the work of employees covered by this Agreement,except when mutually agreed by the Union and the Employer and except in accordancewith Article 8 (Protection of Rights), Section 3.Training Program(j) (1) The Employer shall have the right to establish a driver (Truckawayand/or Driveaway) training program with the following understanding and conditions:(Driveaway shall not include single drive.)10
11Article 3a. Period - In the event a truck driver applicant has prior drivingexperience and has a CDL, the driver training period shall not exceed thirty (30) days.The thirty (30) days shall be defined to mean fifteen (15) days driving out of a thirty (30)day period. In the event a truck driver applicant has no driving experience and does nothave a CDL, the driver training period shall not exceed sixty (60) days. The sixty (60)day period shall be defined to mean a maximum of forty-five (45) days driving out of thesixty (60) day period.b. Employer Rights-The Employer shall have the right to selectapplicants for the training program, establish instruction procedures and requirements,to eliminate any trainee(s) during the training period, or subsequent thereto, prior toemployment.c. All of the contract terms, including Article 3, Section 2Probationary Employees, shall apply to the individual trainee on the first (1st) date afterthe training program is successfully completed and the individual performsrevenue-producing work for the Employer.d. The trainee shall be prohibited from performing any work in anyclassification covered by this Agreement.e. The training program referred to in Subsection (j)(1) above shallbe specifically confined to work pertaining to the classification of truckaway ordriveaway driver.f. Rates of pay for driver trainee shall be as set forth in eachrespective Supplement or Local Rider.g. The Employer agrees to establish a training program formechanics and welders. This program shall include ongoing training for currentmechanics to cover any and all new or different equipment that is related to the carhaulbusiness and the Employer's operation.h. In the event an Employer has regularly used driver trainers in itsdriver training program, such practice will be maintained consistent with the termscontained in the appropriate Area Supplemental Agreement or Local Riders.i. Effective December 18, 1995, new employees who successfullycomplete the probationary period shall be assigned a seniority date commencing withtheir date of hire.(2) Transferability seniority employees shall be entitled to all of the aboverights under the Training Program. However, the employee shall be paid in the same
