6Article 2Riders may become effective on an interim basis by agreement between the Employerand the Local Union, provided that such Riders have been filed with the appropriateArea Joint Arbitration Committee within thirty (30) days of their implementation. LocalRiders not submitted to the appropriate Area Joint Arbitration Committee for approvalwithin this thirty (30) day period shall be considered null and void. If not approved orotherwise modified by the Area Joint Arbitration Committee, the Rider shall become nulland void from the date of the Area Joint Arbitration Committee decision. Riders thataffect the provisions of the National Master Agreement must be first approved by theNational Joint Arbitration Committee.(b) Riders to this Agreement and to Supplements thereto between Local Unionsand Employers that do not meet the standards set forth in the National MasterAgreement and Supplements thereto, shall be continued pending negotiations foramendment of such Riders, which negotiations shall be conducted and concludedwithin one hundred eighty (180) days after execution of this Agreement. All such Ridersmust be submitted to the Area Joint Arbitration Committee for approval or rejection. Ifthe Area Joint Arbitration Committee cannot finally dispose of the matter, such Ridershall be null and void. However, wage and monetary matters negotiated in thisAgreement shall become effective June 1, 2008.(c) This Section shall not restrict the Union's legal right to organize.(d) In the event a shipper transfers any work covered by a Local Rider from onesignatory employer to another signatory employer, the Local Rider shall remain in effectand shall not be renegotiated unless mutually agreed to by the parties. In advance of acompetitive bid involving two (2) or more signatory Employers, upon request, the LocalUnion shall provide to each involved signatory Employer the Local Rider and other localconditions including, but not limited to, zone rates, shuttle rates, incentive or piece workrates and other loading or unloading rates which prevail at the location involved in thecompetitive bid.Section 6.Approval of Local RidersThe Employer and the Union mutually agree that there may be added to an AreaSupplemental Agreement any Article governing any phase of employment which theymutually deem necessary provided said change and/or Rider is signed by both partiesor attached to this Agreement as a Rider or Supplement, and provided further, thatsuch Rider or Supplement is approved by the applicable Area Joint ArbitrationCommittee, unless it affects provisions of the same National Master Agreement atwhich time same must first be approved by the National Joint Arbitration Committee. Allnegotiated Riders must become a part of the appropriate Area SupplementalAgreement and be attached thereto.
Article 2Section 7.It is understood and agreed that the Local Union and the Employer must make aconcerted effort to mutually agree on Local Riders. In the event that the Local Unionand the Employer cannot agree to a Local Rider within one hundred eighty (180) daysfrom the date of execution of this Agreement, such Rider must be referred to theappropriate Area Joint Arbitration Committee, which Committee(s) shall hold hearingsand attempt to adjust the dispute.In the event the Area Joint Arbitration Committee cannot resolve the Local Riderdispute, such Committee shall submit the matter to the National Joint ArbitrationCommittee for determination.It is understood and agreed that in the event the National Joint Arbitration Committee isdeadlocked on the Rider dispute, then either party shall be entitled to all lawfuleconomic recourse to support its position in this matter.Section 8.(a) Agreements may be negotiated by the Employer and the Local Union whichmodify the wage rates, incentives and other provisions set forth in the National Masterand the applicable Supplemental Agreement and Riders for employees working indriving, loading and unloading classifications which will have the effect of permitting theEmployer to acquire and retain truckaway, yard work at plants, railheads, ports andother facilities, subject to National Committee approval and the approval of the affectedmembership prior to implementation.(b) Nothing in this section is intended to or shall allow a Local Union(s) and anEmployer to enter into any transaction that undermines the wages, benefits or othercontractual rights of employees working at any other terminal or location covered by theAgreement.(c) In the handling of traffic from terminals or locations where modifications havebeen approved under Subsection (a) of this Section, foreign drivers shall be paid theirfull contractual rate.7
