Article 2Section 2.Supplements to <strong>the</strong> <strong>National</strong> <strong>Master</strong> <strong>Agreement</strong>There are three (3) divisions of <strong>the</strong> <strong>Automobile</strong> Transporting Industry covered by this<strong>Agreement</strong> and for this reason Supplemental <strong>Agreement</strong>s are provided for each of <strong>the</strong>specific divisions controlled by this <strong>National</strong> <strong>Master</strong> <strong>Agreement</strong>.All such Supplemental <strong>Agreement</strong>s are subject to and controlled by <strong>the</strong> terms of this<strong>National</strong> <strong>Master</strong> <strong>Agreement</strong> and are referred to herein as "Supplemental <strong>Agreement</strong>s."All such Supplemental <strong>Agreement</strong>s are to be clearly limited to <strong>the</strong> specific division andclassification of work as enumerated or described in each individual Supplement.Section 3.Non-covered UnitsThis <strong>Agreement</strong> shall not be applicable to those operations of <strong>the</strong> Employer where <strong>the</strong>employees are covered by a collective bargaining agreement with a Union not signatoryto this <strong>Agreement</strong> or to those employees who have not designated a signatory Union as<strong>the</strong>ir collective bargaining agent.When a majority of <strong>the</strong> eligible employees in any appropriate bargaining unit (includingoffice) performing work for a signatory Employer, execute a card authorizing a signatoryLocal Union to represent <strong>the</strong>m as <strong>the</strong>ir collective bargaining agent at <strong>the</strong>ir terminallocation, <strong>the</strong>n, such employees shall automatically be covered by this <strong>Agreement</strong> and<strong>the</strong> applicable Supplemental <strong>Agreement</strong>s. In such cases, <strong>the</strong> parties may by mutualagreement negotiate wages and conditions, subject to Joint Area Committee approval.In <strong>the</strong> event <strong>the</strong> Employer and <strong>the</strong> Union are unable to mutually agree to <strong>the</strong> inclusionor exclusion of individuals within <strong>the</strong> appropriate bargaining unit with sole reference to<strong>the</strong> question of <strong>the</strong>ir supervisory, managerial, guard or confidential status, such issueshall be resolved by a special committee appointed by <strong>the</strong> appropriate Joint AreaCommittee. The Committee shall meet and resolve <strong>the</strong> dispute within fourteen (14)days. Subsequent to <strong>the</strong> resolution of this issue, <strong>the</strong> parties shall ascertain whe<strong>the</strong>r amajority of employees included within <strong>the</strong> appropriate bargaining unit have designated<strong>the</strong> Union as <strong>the</strong>ir collective bargaining agent and <strong>the</strong>y shall be immediately covered bythis <strong>Agreement</strong> and applicable Supplemental Area <strong>Agreement</strong>s. In such cases, <strong>the</strong>parties may by mutual agreement negotiate wages and conditions subject to Joint Areaapproval. Failure to resolve such issues will constitute a disputed Rider, subject to <strong>the</strong>provisions of Section 7 of this Article.Notwithstanding <strong>the</strong> foregoing paragraph, <strong>the</strong> provisions of <strong>the</strong> <strong>National</strong> <strong>Master</strong><strong>Automobile</strong> <strong>Transporters</strong> <strong>Agreement</strong> and <strong>the</strong> applicable Supplemental <strong>Agreement</strong>s4
