Article 2Section 2.Supplements to the National Master AgreementThere are three (3) divisions of the Automobile Transporting Industry covered by thisAgreement and for this reason Supplemental Agreements are provided for each of thespecific divisions controlled by this National Master Agreement.All such Supplemental Agreements are subject to and controlled by the terms of thisNational Master Agreement and are referred to herein as "Supplemental Agreements."All such Supplemental Agreements are to be clearly limited to the specific division andclassification of work as enumerated or described in each individual Supplement.Section 3.Non-covered UnitsThis Agreement shall not be applicable to those operations of the Employer where theemployees are covered by a collective bargaining agreement with a Union not signatoryto this Agreement or to those employees who have not designated a signatory Union astheir collective bargaining agent.When a majority of the eligible employees in any appropriate bargaining unit (includingoffice) performing work for a signatory Employer, execute a card authorizing a signatoryLocal Union to represent them as their collective bargaining agent at their terminallocation, then, such employees shall automatically be covered by this Agreement andthe applicable Supplemental Agreements. In such cases, the parties may by mutualagreement negotiate wages and conditions, subject to Joint Area Committee approval.In the event the Employer and the Union are unable to mutually agree to the inclusionor exclusion of individuals within the appropriate bargaining unit with sole reference tothe question of their supervisory, managerial, guard or confidential status, such issueshall be resolved by a special committee appointed by the appropriate Joint AreaCommittee. The Committee shall meet and resolve the dispute within fourteen (14)days. Subsequent to the resolution of this issue, the parties shall ascertain whether amajority of employees included within the appropriate bargaining unit have designatedthe Union as their collective bargaining agent and they shall be immediately covered bythis Agreement and applicable Supplemental Area Agreements. In such cases, theparties may by mutual agreement negotiate wages and conditions subject to Joint Areaapproval.
