negligence of Contractor to provide the required equipment, supplies ormaterials.47.3. Extension of contract time may be granted only when the affected activitiesfall within the critical path of the PERT/CPM network.47.4. No extension of contract time shall be granted when the reason given tosupport the request for extension was already considered in thedetermination of the original contract time during the conduct of detailedengineering and in the preparation of the contract documents as agreed uponby the parties before contract perfection.47.5. Extension of contract time shall be granted for rainy/unworkable daysconsidered unfavorable for the prosecution of the works at the site, based onthe actual conditions obtained at the site, in excess of the number ofrainy/unworkable days pre-determined by the Procuring Entity in relation tothe original contract time during the conduct of detailed engineering and inthe preparation of the contract documents as agreed upon by the partiesbefore contract perfection, and/or for equivalent period of delay due to majorcalamities such as exceptionally destructive typhoons, floods andearthquakes, and epidemics, and for causes such as non-delivery on time ofmaterials, working drawings, or written information to be furnished by theProcuring Entity, non-acquisition of permit to enter private properties withinthe right-of-way resulting in complete paralyzation of construction activities,and other meritorious causes as determined by the Procuring Entity’sRepresentative and approved by the Head of the Procuring Entity. Shortageof construction materials, general labor strikes, and peace and orderproblems that disrupt construction operations through no fault of theContractor may be considered as additional grounds for extension ofcontract time provided they are publicly felt and certified by appropriategovernment agencies such as DTI, DOLE, DILG, and DND, among others.The written consent of bondsmen must be attached to any request of theContractor for extension of contract time and submitted to the ProcuringEntity for consideration and the validity of the Performance Security shall becorrespondingly extended.48. Price AdjustmentExcept for extraordinary circumstances as determined by NEDA and approved by theGPPB, no price adjustment shall be allowed. Nevertheless, in cases where the cost ofthe awarded contract is affected by any applicable new laws, ordinances, regulations,or other acts of the GOP, promulgated after the date of bid opening, a contract priceadjustment shall be made or appropriate relief shall be applied on a no loss-no gainbasis.49. CompletionThe Contractor shall request the Procuring Entity’s Representative to issue acertificate of Completion of the Works, and the Procuring Entity’s Representative willdo so upon deciding that the work is completed.73
