Eppendorf Limited Product WarrantyMastercycler ®pro Thermal CyclerEppendorf North America Inc. (“Eppendorf”) warrants tothe purchaser (“Customer”) of Eppendorf Mastercycler ® proThermal Cycler (“Product”) that the Product excluding software,documentation and similar items, will be free of defects inworkmanship and materials for a period of two (2) years from thedate of purchase of the Product, to the Customer (the “WarrantyPeriod”). the thermal block, heated lid and fan.This Limited Warranty applies only to a Product which ispurchased for Customer’s own use and does not apply toProducts purchased for resale, unless Customer obtainsEppendorf’s prior written approval at the time of purchase fromEppendorf. This Limited Warranty is not transferable.Notice of a defect in a Product must be received by Eppendorfprior to the expiration of the Limited Warranty Period and withinthirty (30) days after any alleged defect becomes reasonablyapparent to Customer. During the Limited Warranty Period,Eppendorf will, at its sole discretion, repair or replace a defectiveProduct, free of charge for labor and parts provided that theProduct is handled and/or shipped for repair in accordance withEppendorf’s warranty service procedures. Eppendorf reservesthe right to determine the best way to service warranty issues.If Eppendorf elects to repair a defective Product, in Eppendorf’ssole discretion, it may use new or used parts that aresubstantially equivalent to the originally installed parts in functionand performance. Such parts will be warranted for the longer ofninety (90) days or the remainder of the Limited Warranty Period,but shall not extend the Limited Warranty Period for the Product.If notice of a defect is provided to Eppendorf within the first 90days after purchase, Eppendorf will arrange and pay for all costsinvolved in the standard ground transport of the unit to andfrom an Eppendorf approved service center for warranty repair.To receive warranty service after this 90 day period, Customerwill be required to ship the unit, at Customer's expense, toan Eppendorf approved service center for warranty repair.Eppendorf will pay for return shipping of the repaired Product.Excluded from this Limited Warranty is any damage causedduring any shipment/transport/movement of the Productfollowing its initial receipt by the Customer, the replacementof wearing parts the calibration of the thermal block, and anydamage caused by: (a) accident, impacts, fluids, fire, flood,wind, earthquake, lightening or similar disaster, unauthorizedmodifications including removal or exchange of instrumentcomponents or identification labels, attachments of peripherals;improper use, installation or problems with the electrical supply;improper maintenance; any other misuse, abuse, improperattachment of any non eppendorf labeled chargers and/orpower supplies, mishandling or software viruses; (b) neglect,defacing, spilling or other forms of contamination, outside ofthe suggested handling and applications within the ProductInstruction Manual; (c) use of the Product in non-standardenvironmental conditions, including but not limited to failure tomeet requirements of ambient temperature, lubrication, humidityor magnetic field influences; (d) installation or maintenance ofthe Product by Customer, or installation or maintenance of theProduct by a service supplier not authorized by Eppendorf,in either case beyond the user maintenance prescribed in theProduct instruction manual. Furthermore, this Limited Warrantydoes not cover software including issues in which controlcomputer specifications do not meet required functionalityand features according to the specifications described in theProduct Instruction Manual, as well as computer and computercomponents and linked network systems. Reported softwareissues regarding maintenance of data files and where evidenceexists of removal or de-installation of certain components,features or programs, are further excluded from Limited Warrantycoverage.This Limited Warranty does not involve or imply the provision ofproduct or applications training and does not govern levels ofservice by Applications Support networks.Eppendorf’s sole liability, under this Limited Warranty, for failureto repair or replace the Product after a reasonable number ofattempts is limited to the replacement of the Product or, atEppendorf’s sole discretion, the refund of the original purchaseprice of the Product.The above constitutes the Customer’s exclusive remedies forbreach of Limited Warranty, unless otherwise provided by law.Under no circumstances shall Eppendorf be liable for any (a)special, incidental or consequential damages or similar claimswhether based upon breach of contract, breach of warranty,negligence, absolute or strict liability, or any other similartheories, (b) tort claims for injury to persons or property,including negligence and strict liability, (c) loss of profit, lossof revenue, loss of use of the hardware system, loss of use ofrelated equipment, loss of reagents, loss of sample, cost ofsubstitute or replacement equipment, “downtime”, Purchaser’stime or injury to property, or (d) any claims of third parties.

Eppendorf Limited Product WarrantyEPPENDORF SPECIFICALLY DISCLAIMS ALL OTHERWARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOTLIMITED TO IMPLIED WARRANTIES OR MERCHANTABILITYAND FITNESS FOR A PARTICULAR PURPOSE. THISWARRANTY IS THE EXCLUSIVE WARRANTY. ANY IMPLIEDWARRANTY THAT MAY BE IMPOSED BY APPLICABLE LAWIS LIMITED IN ALL RESPECTS TO THE DURATION OF THISLIMITED WARRANTY. THIS WARRANTY MAY NOT BE ALTEREDBY ANY VERBAL ADVICE OR REPRESENTATION MADE BYOR ON BEHALF OF EPPENDORF OR BY ANY WRITING MADEBY OR ON BEHALF OF EPPENDORF UNLESS SUCH WRITINGIS SPECIFICALLY LABELED OR TERMED: “MODIFICATIONTO WARRANTY” AND IS SIGNED BY A DULY AUTHORIZEDSIGNATORY OF EPPENDORF. CUSTOMER AGREES THATREPAIR, REPLACEMENT OR REFUND, AS APPLICABLE,UNDER THIS LIMITED WARRANTY DESCRIBED HEREINARE CUSTOMER’S SOLE AND EXCLUSIVE REMEDIES WITHRESPECT TO ANY BREACH OF WARRANTY.Some states do not allow limitations on how long an impliedwarranty may last, in which case the above limitation maynot apply to you. Some states do not allow the exclusion orlimitation of incidental or consequential damages in which casethe above limitation may not apply to you. This Limited Warrantygives you specific legal rights, and you may also have otherrights which may vary from state to state. You can also email a description of the problem youare experiencing to techserv@eppendorf.com.l Have your operating manual and the invoice number from yourPacking Slip for the Product available when calling to report aproblem.
