If the delinquent is suspended, it isopen to the disciplinary authority to review the order <str<strong>on</strong>g>of</str<strong>on</strong>g>suspensi<strong>on</strong>. In that c<strong>on</strong>text, the court can <strong>on</strong>ly exercise itspowers <str<strong>on</strong>g>of</str<strong>on</strong>g> interference in a limited number <str<strong>on</strong>g>of</str<strong>on</strong>g> cases whereit is shown that the decisi<strong>on</strong> to suspend is arbitrary and ortis a mala fide exercise <str<strong>on</strong>g>of</str<strong>on</strong>g> power and or colorable exercise<str<strong>on</strong>g>of</str<strong>on</strong>g> power and or the State or the authorities are not able toexplain the reas<strong>on</strong>s for suspensi<strong>on</strong> when it is for a undulyl<strong>on</strong>g period and adequate reas<strong>on</strong>s re not forthcoming forthe order <str<strong>on</strong>g>of</str<strong>on</strong>g> suspensi<strong>on</strong>. These must be the parameters <strong>on</strong>which every authority including M.A.T. must c<strong>on</strong>siderwhilst dealing with an order <str<strong>on</strong>g>of</str<strong>on</strong>g> suspensi<strong>on</strong> more so in thecase <str<strong>on</strong>g>of</str<strong>on</strong>g> delinquent employee who hold the sensitive postsunder Police services and such other services. It is not forthe courts including the tribunal to interfere with exercise<str<strong>on</strong>g>of</str<strong>on</strong>g> discreti<strong>on</strong> by the disciplinary authority otherwise than incircumstances set out.1. In our opini<strong>on</strong>, it would be indeed inc<strong>on</strong>ceivable thatthe petiti<strong>on</strong>ers should allow the resp<strong>on</strong>dent to resume <strong>on</strong>duty when they are facing serious charges <str<strong>on</strong>g>of</str<strong>on</strong>g> corrupti<strong>on</strong>.Allowing such employee to remain in seat would result ingiving him further opportunity to indulge in the acts forwhich he is being prosecuted. Merely because theresp<strong>on</strong>dents are under suspensi<strong>on</strong> for over 18-24 m<strong>on</strong>thscannot be a ground to pass the order <str<strong>on</strong>g>of</str<strong>on</strong>g> reinstatement.2. We draw support from the aforesaid observati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g>the Apex Court to hold that a public servant who ischarged <str<strong>on</strong>g>of</str<strong>on</strong>g> corrupti<strong>on</strong> should be kept away from the <str<strong>on</strong>g>of</str<strong>on</strong>g>ficeuntil he is judicially absolved. Merely because a trial <str<strong>on</strong>g>of</str<strong>on</strong>g>such public servant is being delayed, that by itself shouldnot be a ground for passing an order <str<strong>on</strong>g>of</str<strong>on</strong>g> reinstatement. Ifsuch public servant is reinstated and allowed to c<strong>on</strong>tinue todo <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial acts until he is judicially absolve from thecharge <str<strong>on</strong>g>of</str<strong>on</strong>g> corrupti<strong>on</strong> by reas<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> reinstatement order it ispublic interest which suffers and sometimes evenirreparably. When such public servant is allowed to holdpublic <str<strong>on</strong>g>of</str<strong>on</strong>g>fice, it would impair the morale <str<strong>on</strong>g>of</str<strong>on</strong>g> other pers<strong>on</strong>s


SUSPENSION.(1) Puting restricti<strong>on</strong> <strong>on</strong> themovements <str<strong>on</strong>g>of</str<strong>on</strong>g> policepers<strong>on</strong>nel ( <str<strong>on</strong>g>of</str<strong>on</strong>g> and below therank <str<strong>on</strong>g>of</str<strong>on</strong>g> Police Inspectors),i.e. asking to attend thedaily roll call etc.(2) Although the posts <str<strong>on</strong>g>of</str<strong>on</strong>g>Police Inspectors haveupgraded as Class “A”from Feb.2005, yet theirservices are governed underthe Bombay Police Act,1951 and The BombayPolice ( Punishments andAppeals) Rules, 1956.* Judgement given by theH<strong>on</strong>’ble M.A.T., Mumbai inthe O.A.No.293 <str<strong>on</strong>g>of</str<strong>on</strong>g> 2005 filedby P.I. If h<strong>on</strong>est public servants are compelled totake orders from <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer, facing charges <str<strong>on</strong>g>of</str<strong>on</strong>g> corrupti<strong>on</strong> <strong>on</strong>account <str<strong>on</strong>g>of</str<strong>on</strong>g> setting aside the suspensi<strong>on</strong> the fallout would be<strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> shaking the system itself.1. In paragraph 10<str<strong>on</strong>g>of</str<strong>on</strong>g> the said order the H<strong>on</strong>’ble M.A.T.,Mumbai has held that “the Supreme Court had notfrowned up<strong>on</strong> any such restricti<strong>on</strong> being imposed <strong>on</strong> thePolice pers<strong>on</strong>nel if the rules permitted such restricti<strong>on</strong>s.Secti<strong>on</strong> 15 and secti<strong>on</strong> 23 (h) <str<strong>on</strong>g>of</str<strong>on</strong>g> the Bombay Police Act,1951 empowers c<strong>on</strong>trol <str<strong>on</strong>g>of</str<strong>on</strong>g> authorities <strong>on</strong> Police Officerseven when they are under suspensi<strong>on</strong>. It would be correctsay that no orders have been issued under secti<strong>on</strong> 23 (h) <str<strong>on</strong>g>of</str<strong>on</strong>g>the Bombay Police Act in this regard, because the Circulardtd.25thJanuary, 1955 clearly states that in exercise <str<strong>on</strong>g>of</str<strong>on</strong>g> thepowers under Secti<strong>on</strong> 15 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Bombay Police Act, 1951Officers empowered to suspend can pass orders imposingrestricti<strong>on</strong> <strong>on</strong> the employment <str<strong>on</strong>g>of</str<strong>on</strong>g> the delinquent undersuspensi<strong>on</strong>. In the light <str<strong>on</strong>g>of</str<strong>on</strong>g> these provisi<strong>on</strong>s and the variousjudgments cited, I hold that the c<strong>on</strong>diti<strong>on</strong> imposed in theimpugned order regarding attendance <str<strong>on</strong>g>of</str<strong>on</strong>g> roll call everyday by the delinquent is valid. “2. In paragraph no.3 <str<strong>on</strong>g>of</str<strong>on</strong>g> the said judgement theH<strong>on</strong>’bleTribunal has accepted the positi<strong>on</strong> that hough thepost <str<strong>on</strong>g>of</str<strong>on</strong>g> Police Inspectors has no doubt been upgraded, butyet the police pers<strong>on</strong>nel upto the rank <str<strong>on</strong>g>of</str<strong>on</strong>g> Police Inspectorare governed by the Bombay Police (Punishments andAppeals) Rules, 1956. Rule 3 (1) <str<strong>on</strong>g>of</str<strong>on</strong>g> the M.C.S.(Disciplineand Appeal)Rules, 1979 states that the said Rules are notapplicable to those who are governed by the BombayPolice Act, 1951 as defined under Secti<strong>on</strong> 2 (16) <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>of</str<strong>on</strong>g>the said Act. As per secti<strong>on</strong> 24 (2) (a) <str<strong>on</strong>g>of</str<strong>on</strong>g> the BombayPolice Act, 1951, The Director General <str<strong>on</strong>g>of</str<strong>on</strong>g> Police, M.S.,Mumbai, including Additi<strong>on</strong>al Director Genral, SpecialInspector Genral, Commissi<strong>on</strong>er (including JointCommissi<strong>on</strong>er, Additi<strong>on</strong>al Commissi<strong>on</strong>er) and

We cannot agree that G.Rs. or guide-lines are rulesmade under Article 309 <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>stituti<strong>on</strong>.2. We therefore, find that there is no infirmity in theultimate c<strong>on</strong>clusi<strong>on</strong>s arrived at by the Full Bench judgment<str<strong>on</strong>g>of</str<strong>on</strong>g> M.A.T., Mumbai. The said Full Bench held that “thereis the Bombay Police Act, 1951 which had received theassent <str<strong>on</strong>g>of</str<strong>on</strong>g> the President <strong>on</strong> 1.6.1951. Rules came to be madeunder the said Act, known as the Bombay Police(Punishments and Apples)Rules, 1956 which hereinaftershall be referred to as the Rules. By virtue <str<strong>on</strong>g>of</str<strong>on</strong>g> Rule 1 (2) allpolice <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers including Railway Police Officers, belowthe rank <str<strong>on</strong>g>of</str<strong>on</strong>g> Inspector in the State <str<strong>on</strong>g>of</str<strong>on</strong>g> Bombay are governedby the said Rules. The G.R.s and the Circulars are notapplicable to police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers who are governed by BombayPolice (Punishments and Appeals)Rules, and that they areapplicable <strong>on</strong>ly those case <str<strong>on</strong>g>of</str<strong>on</strong>g> the Govt. servant who are notgoverned the said Rules. That G.R. dated 29.12.1988 andthe subsequent Circulars issued dd.11.1.990 and 6.1.2001cannot override the statutory rules framed under theBombay Police Act, 1951. Preventi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Delay in Discharge<str<strong>on</strong>g>of</str<strong>on</strong>g> Official Duties Act, 2005 in thematter <str<strong>on</strong>g>of</str<strong>on</strong>g> Original Applicati<strong>on</strong> nos.376 and 377 <str<strong>on</strong>g>of</str<strong>on</strong>g> 2007 filed byShri/s Murlidhar Changdeo Patiland Ravindranath Kashinath Patil,both from the <str<strong>on</strong>g>of</str<strong>on</strong>g>fice TalukaAgriculture Officer, Sinnar, Dist.Nashik.years.(3) Preparati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> list <str<strong>on</strong>g>of</str<strong>on</strong>g> government servants every yeardue for transfer in m<strong>on</strong>th <str<strong>on</strong>g>of</str<strong>on</strong>g> January is c<strong>on</strong>diti<strong>on</strong> precedentto effect transfers in April/May, which in comm<strong>on</strong>parlance, are called as general transfers.(4) General transfers will be in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> the list <str<strong>on</strong>g>of</str<strong>on</strong>g> thosegovernment servants figuring in the list and n<strong>on</strong>e else.(5) No modificati<strong>on</strong>s or alterati<strong>on</strong>s in the list so preparedare permitted thereafter.(6) Validity <str<strong>on</strong>g>of</str<strong>on</strong>g> list so prepared, will be till the orders <str<strong>on</strong>g>of</str<strong>on</strong>g>transfers are issued in pursuant to that list.(7) There are no provisi<strong>on</strong>s c<strong>on</strong>tained in the Act toreceive or entertain any representati<strong>on</strong> or request fortransfer <strong>on</strong>ce the list is finalized. The competent authoritymay direct the head <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fice to apprise governmentservant due for transfer. Govt. servant whose name isincluded in the list, if makes an applicati<strong>on</strong> [it shall beaddressed to the competent authority and shall be madethrough proper channel <strong>on</strong>ly] against proposed transfer thesame may be c<strong>on</strong>sidered according to exigency or need <str<strong>on</strong>g>of</str<strong>on</strong>g>administrati<strong>on</strong> but in no case such request will be binding<strong>on</strong> the administrati<strong>on</strong>.(8) Any representati<strong>on</strong> or request to the competentauthority with any recommendati<strong>on</strong>s from an outsider,political, big wigs, H<strong>on</strong>’ble Minister not in charge <str<strong>on</strong>g>of</str<strong>on</strong>g> suchdepartment, shall be summarily rejected and the Govt.servant indulging in such activities shall be firmly dealtwith in accordance with c<strong>on</strong>duct rules.(9) Any applicati<strong>on</strong> sent directly to any <str<strong>on</strong>g>of</str<strong>on</strong>g> theMantralaya Department or H<strong>on</strong>’ble Minister not c<strong>on</strong>cernedwith the department shall not be entertained at any level.(10) On receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> such applicati<strong>on</strong> by the competentauthority, having regard to provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 4 (4), 1 stand 2 nd proviso r/w Secti<strong>on</strong> 4 (5) <str<strong>on</strong>g>of</str<strong>on</strong>g> the Act shall c<strong>on</strong>siderthat applicati<strong>on</strong> and find out prima facie whether thereas<strong>on</strong> or cause for transfer or n<strong>on</strong> transfer from <strong>on</strong>e postto another or retain at that place is genuine and just, thenhaving regard to administrative exigencies, needs,availability <str<strong>on</strong>g>of</str<strong>on</strong>g> post etc. <strong>on</strong> the back drop <str<strong>on</strong>g>of</str<strong>on</strong>g> statutoryprovisi<strong>on</strong>, c<strong>on</strong>tained in secti<strong>on</strong> 4 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Act, that too aftermaking applicati<strong>on</strong> in prescribedformat and take any acti<strong>on</strong>according to the certificate copy <str<strong>on</strong>g>of</str<strong>on</strong>g>the order.


scrupulously adhering to it, may entertain such request,then order <str<strong>on</strong>g>of</str<strong>on</strong>g> transfer be issued.(11) In case such request applicati<strong>on</strong> does not fit in tothe stature, it shall be rejected and it shall not be necessaryto intimate to the c<strong>on</strong>cerned.(12) The power or authority <str<strong>on</strong>g>of</str<strong>on</strong>g> delegati<strong>on</strong> as envisagedin Secti<strong>on</strong> 6 (1), 2 nd proviso <strong>on</strong>ly in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> secti<strong>on</strong> 6 <str<strong>on</strong>g>of</str<strong>on</strong>g>the Act and that delegati<strong>on</strong> shall not apply to secti<strong>on</strong> 4 orsecti<strong>on</strong> 5 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Act, unless specifically delegated.(13) C<strong>on</strong>sultati<strong>on</strong> as envisaged and referred to in secti<strong>on</strong>4 and secti<strong>on</strong> 6 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Act shall be meaningful, real andeffective. Superficial acti<strong>on</strong> in that behalf shall beavoided.(14) Reas<strong>on</strong>s to be recorded as required by clause (ii) <str<strong>on</strong>g>of</str<strong>on</strong>g>proviso <str<strong>on</strong>g>of</str<strong>on</strong>g> sub secti<strong>on</strong> (4) <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 4 and sub secti<strong>on</strong> (5)<str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 4 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Act being mandatory, n<strong>on</strong> recording <str<strong>on</strong>g>of</str<strong>on</strong>g>reas<strong>on</strong>s shall vitiate the ultimate order.(14) Generally reas<strong>on</strong>s to be recorded as required by 4(4) proviso, not be referred to in the order <str<strong>on</strong>g>of</str<strong>on</strong>g> transfer.However, it invariably to be recorded in c<strong>on</strong>cerned file. Itshould indicate due applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> mind by the competentauthority to the fact and situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>law</strong>.
