Madde 40- Gecikme halinde alınacak cezalarArticle 40- Penalties applicable in case of delays40.1. Mücbir sebep hallerinden dolayı verilebilecek süre uzatımı halleri hariç, mal/iş zamanında teslim edilmediğitakdirde, İdare tarafından, geçen her takvim günü için Yükleniciye yapılacak ödemelerden geç teslim edilen malzemebedeli üzerinden %01 (bindebir) oranında gecikme cezası kesilecektir. Bu gecikme sözleşmede belirtilen teslimsüresinin 1/3’ünü aşamaz. Ancak Yüklenicinin talebi üzerine İdarece uygun görülmesi halinde 1/3’lük cezalı süreye ekolarak cezalı süre verilebilir.40.1. Except for the cases for permitting extension periods, in case the goods/service are not delivered in due time, a penaltyamounting to a rate of one per thousand (01%) of price of the goods delivered late shall be imposed for each calendar day of thedelay by the Contracting Entity over the payments to be made to the contractor. Nevertheless, this delay cannot exceed 1/3 of thedelivery period mentioned in the contract. However, upon contractor’s request, if it is found convenient by the Contracting Entity, aperiod with penalty in addition to penalty period of 1/3 may be granted.40.2. Kesilecek toplam ceza tutarı hiçbir şekilde ihale bedelini aşamaz.40.2. Total penalty amount to be imposed cannot exceed the tender price in any case.40.3. Gecikme cezası Yükleniciye ayrıca protesto çekmeye gerek kalmaksızın ödemelerden kesilir. Bu cezanınödemelerden karşılanamaması halinde Yükleniciden ayrıca tahsil edilir.40.3. Delay penalty is deducted from the payments without serving any protest to the Contractor. If the payments cannot meet thepenalty, it shall be collected from the contractor additionally.40.4. Yukarıda belirtilen sürelere rağmen malzemenin/işin teslim edilmemesi halinde sözleşmenin fesih hükümleriyürürlüğe konulacaktır.40.4. If the goods/service are not delivered in spite of the above-mentioned periods, the provisions for canceling the contract shall beput into force.Madde 41.Teslim etme, teslim alma şekil ve şartları:Article 41- Terms and conditions for delivering and taking delivery:a) Sözleşmenin yerli istekli ile imzalanması halinde; malzeme boşaltma ve istifleme dahil teslim edilecek, buradaİdare elemanlarınca bir tutanakla teslim alınacak, ancak malzemenin muayene ve kabulü tamamlanıncaya kadaryüklenicinin sorumluluğu devam edecektir.b) Sözleşmenin yabancı istekli ile imzalanması halinde; teslim edilecek malzemenin gümrükleme işlemleri İdaretarafından yapılarak malzeme teslim alınacak, ancak malzemenin muayene ve kabulü tamamlanıncaya kadaryüklenicinin sorumluluğu devam edecektir.Süresi içinde malzemenin bir bölümü teslim edilmişse ve bu bölümünden bağımsız olarak yararlanma olanağı olsa bileİdare getirilen malzemeyi teslim alıp almamakta ve bedelini ödeyip ödememekte serbesttir.a) In case the contact is signed with a domestic tenderer, the material shall be delivered including unloading and stowing and itsdelivery shall be taken by the personnel of the Contracting Entity therein with a minutes, however, the responsibility of thecontractor shall continue until the completion of the inspection and acceptance of the material.b) In case the contract is signed with a foreign tenderer, the delivery of the material shall be taken by completing the customsclearance of the material by the Contracting Entity, however, the responsibility of the contractor shall continue until the completionof the inspection and acceptance of the material.If one part of the goods are delivered within its period and although there is a possibility to utilize this part, the Contracting Entity isfree to take the delivery of the material and to make the payment of the cost of the material.41.1. Sözleşmenin imzalanarak yürürlüğe girmesine kadar olan süreçte doğacak ihtilaflar İdare hakları saklı kalmaküzere İdari Yargıda dava konusu edilebilecektir.43.1. Suits may be filed at the administrative courts with regard to disputes arising during the period until the contract is signed andits entry into force, provided that rights of the Contracting Entity are reserved.43.2. Sözleşmenin uygulanmasından doğacak ihtilaflarda ise işin sözleşmesinde yer alan bu konuya ilişkin hükümleruygulanacaktır.43.2. The relevant provisions in the contract of the work shall apply to disputes arising from the implementation of the contract.22
Madde 44-Diğer Hususlar:Article 44- Other Issues:44.1. İdare, ceza ve ihalelerden yasaklama hükümleri hariç 4734 ve 4735 sayılı Kanunlara tabi değildir.44.1. The Contracting Entity is not subject to the laws no. 4734 and 4735 except for the provisions for punishment and prohibitingfrom tenders.44.2. Teklif edilecek malzemeler orijinal veya dengi olacaktır.44.2. The materials to be offered shall be original or their equivalent.44.3. Teklif edilen malzemeler için talep edilen tip araç veya aksamın kullanıcısı olan demiryolu kuruluşundansöz konusu malzemelerin problemsiz ve tatminkar bir şekilde kullanıldığına dair referans belgesi.44.3. The reference document for offered materials, to be obtained from the railway organization that is the user of the vehicle orequipment for which the parts are ordered, providing that the mentioned materials have been used without problem andsatisfactorily.44.4. Teklif edilen malzemelerin üretici firma adları, marka ve tipleri ile bu malzemelere ait teknik özellikleribelgelenecektir.44.4. The names of the manufacturers, marks and types of the offered materials and the technical characteristics belong to thesematerials shall be documented.44.5. Malzemelerin üzerine imalatçı firma adı veya sembolü, parça numarası imal tarihi vb. bilgilermarkalanacaktır.44.5. The name or symbol of the manufacture and part number, etc. shall be marked on the materials23
