<strong>Background</strong> & <str<strong>on</strong>g>Policy</str<strong>on</strong>g> Statement:NCC Respiratory Care Program<str<strong>on</strong>g>Policy</str<strong>on</strong>g> <strong>on</strong> <strong>Mandatory</strong> <strong>Criminal</strong> <strong>Background</strong> <strong>Checks</strong><strong>for</strong> <strong>Candidates</strong> <strong>for</strong> Admissi<strong>on</strong>To be employed in New York State (NYS) as a respiratory therapist up<strong>on</strong> graduati<strong>on</strong> from theRespiratory Care Program, student-graduates must be licensed and registered to practice bythe NYS Educati<strong>on</strong> Department, Office of the Professi<strong>on</strong>s. In order to obtain a NYS license,applicants must pass an approved examinati<strong>on</strong> and be of “good moral character” asdetermined under the NYS Educati<strong>on</strong> Law and the Rules of the NYS Board of Regents.Applicants <strong>for</strong> NYS licensure must reveal whether they have a criminal record (fel<strong>on</strong>y ormisdemeanor), whether any criminal charges are pending against them, whether anylicensing or disciplinary authority has ever taken any negative acti<strong>on</strong> against them, andwhether any hospital or licensed facility ever restricted or terminated professi<strong>on</strong>al training,employment, or privileges, and whether the applicant ever voluntarily or involuntarily resignedor withdrew from such associati<strong>on</strong> to avoid impositi<strong>on</strong> of such measures. In additi<strong>on</strong>, everyNew York State applicant <strong>for</strong> a professi<strong>on</strong>al license, permit, or registrati<strong>on</strong>, or any renewalthereof, must file a written statement that, as of the date of the filing, she or he is, or is not,under an obligati<strong>on</strong> to pay child support. Individuals who are four m<strong>on</strong>ths or more in arrearsin child support may be subject to suspensi<strong>on</strong> of their business, professi<strong>on</strong>al and/or driver’slicenses.In additi<strong>on</strong> to the <strong>for</strong>egoing NYS requirements, Federal law limits the issuance of professi<strong>on</strong>allicenses, registrati<strong>on</strong>s and limited permits to United States citizens or qualified aliens.Accordingly, NYS applicants are required to provide in<strong>for</strong>mati<strong>on</strong> regarding their citizenship oralien status.The <strong>for</strong>egoing licensure, “good moral character”, and employment standards apply tograduate-applicants <strong>for</strong> professi<strong>on</strong>al licenses. Students enrolled in approved RespiratoryCare educati<strong>on</strong> programs are exempt from licensure requirements while per<strong>for</strong>mingrespiratory care as an integral part of such educati<strong>on</strong>al program.Accordingly, to protect patients, the public, the Program, and Nassau Community College,and because the clinical work of Respiratory Care students routinely focuses <strong>on</strong> care of themost fragile and vulnerable patients, across the life-span, the Respiratory Care Programrequires criminal background checks <strong>for</strong> all students enrolling in the Program <strong>on</strong> or after April1, 2008.


NCC Respiratory Care Program<str<strong>on</strong>g>Policy</str<strong>on</strong>g> <strong>on</strong> <strong>Mandatory</strong> <strong>Criminal</strong> <strong>Background</strong> <strong>Checks</strong><strong>for</strong> <strong>Candidates</strong> <strong>for</strong> Admissi<strong>on</strong>Page 2 of 2.Procedure:1. Within fifteen days of receipt of a c<strong>on</strong>diti<strong>on</strong>al offer of acceptance to the RespiratoryCare Program, applicants are required to:a. Register with the designated Healthcare Student <strong>Background</strong> CheckProgram, and,b. Order the background check authorized by the Respiratory CareProgram Admissi<strong>on</strong>s Committee, and,c. Authorize the Respiratory Care Program Admissi<strong>on</strong>s Committee to viewand receive the complete results of the authorized background check.Any in<strong>for</strong>mati<strong>on</strong> received by the Program will be used <strong>for</strong> the solepurpose of screening applicants <strong>for</strong> admissi<strong>on</strong>.2. The cost of the authorized background check shall be the sole resp<strong>on</strong>sibility of theapplicant and cannot be reimbursed by the Program or the College.3. Within fifteen days of receipt of the complete background check report, the RespiratoryCare Program Admissi<strong>on</strong>s Committee shall notify the applicant of the final admissi<strong>on</strong>decisi<strong>on</strong>. In the event a reas<strong>on</strong>able questi<strong>on</strong> arises as to the moral character of anapplicant that cannot be sufficiently answered <strong>on</strong> the available record, the applicantmay be requested to submit an explanati<strong>on</strong>, correcti<strong>on</strong>, or amplificati<strong>on</strong> of the record<strong>for</strong> further c<strong>on</strong>siderati<strong>on</strong> by the Admissi<strong>on</strong>s Committee. In c<strong>on</strong>sidering results ofbackground checks <strong>for</strong> the purpose of admitting student to the Respiratory CareProgram, to the extent possible the Admissi<strong>on</strong>s Committee shall rely up<strong>on</strong> thestandards used by the NYS Educati<strong>on</strong> Department in determining “good moralcharacter” with respect to licensure decisi<strong>on</strong>s.If admissi<strong>on</strong> to the Program is denied based up<strong>on</strong> in<strong>for</strong>mati<strong>on</strong> received through thebackground check, the applicant may, within ten days of receipt of written notice ofsuch determinati<strong>on</strong>, submit an explanati<strong>on</strong>, correcti<strong>on</strong>, or amplificati<strong>on</strong> of their record<strong>for</strong> further c<strong>on</strong>siderati<strong>on</strong> by the Admissi<strong>on</strong>s Committee.April 1, 2008NCC Respiratory Care ProgramAdmissi<strong>on</strong>s Committee
