<str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>Rights</strong> <strong>of</strong> <strong>Indigenous</strong> <strong>Peoples</strong>http://www.un.org/esa/socdev/unpfii/en/drip.htmlPage 3 <strong>of</strong> 922/10/2010Solemnly proclaims <strong>the</strong> following <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>Rights</strong> <strong>of</strong> <strong>Indigenous</strong> <strong>Peoples</strong>as a standard <strong>of</strong> achievement to be pursued in a spirit <strong>of</strong> partnership and mutual respect:Article 1<strong>Indigenous</strong> peoples have <strong>the</strong> right to <strong>the</strong> full enjoyment, as a collective or as individuals, <strong>of</strong> allhuman rights and fundamental freedoms as recognized in <strong>the</strong> Charter <strong>of</strong> <strong>the</strong> <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g>, <strong>the</strong>Universal <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> <strong>of</strong> Human <strong>Rights</strong>(4) and internati<strong>on</strong>al human rights law.Article 2<strong>Indigenous</strong> peoples and individuals are free and equal to all o<strong>the</strong>r peoples and individuals andhave <strong>the</strong> right to be free from any kind <strong>of</strong> discriminati<strong>on</strong>, in <strong>the</strong> exercise <strong>of</strong> <strong>the</strong>ir rights, inparticular that based <strong>on</strong> <strong>the</strong>ir indigenous origin or identity.Article 3<strong>Indigenous</strong> peoples have <strong>the</strong> right to self-determinati<strong>on</strong>. By virtue <strong>of</strong> that right <strong>the</strong>y freelydetermine <strong>the</strong>ir political status and freely pursue <strong>the</strong>ir ec<strong>on</strong>omic, social and cultural development.Article 4<strong>Indigenous</strong> peoples, in exercising <strong>the</strong>ir right to self-determinati<strong>on</strong>, have <strong>the</strong> right to aut<strong>on</strong>omy orself-government in matters relating to <strong>the</strong>ir internal and local affairs, as well as ways and meansfor financing <strong>the</strong>ir aut<strong>on</strong>omous functi<strong>on</strong>s.Article 5<strong>Indigenous</strong> peoples have <strong>the</strong> right to maintain and streng<strong>the</strong>n <strong>the</strong>ir distinct political, legal,ec<strong>on</strong>omic, social and cultural instituti<strong>on</strong>s, while retaining <strong>the</strong>ir right to participate fully, if <strong>the</strong>y sochoose, in <strong>the</strong> political, ec<strong>on</strong>omic, social and cultural life <strong>of</strong> <strong>the</strong> State.Article 6Every indigenous individual has <strong>the</strong> right to a nati<strong>on</strong>ality.Article 71. <strong>Indigenous</strong> individuals have <strong>the</strong> rights to life, physical and mental integrity, liberty and security<strong>of</strong> pers<strong>on</strong>.2. <strong>Indigenous</strong> peoples have <strong>the</strong> collective right to live in freedom, peace and security as distinctpeoples and shall not be subjected to any act <strong>of</strong> genocide or any o<strong>the</strong>r act <strong>of</strong> violence, includingforcibly removing children <strong>of</strong> <strong>the</strong> group to ano<strong>the</strong>r group.Article 81. <strong>Indigenous</strong> peoples and individuals have <strong>the</strong> right not to be subjected to forced assimilati<strong>on</strong> ordestructi<strong>on</strong> <strong>of</strong> <strong>the</strong>ir culture.2. States shall provide effective mechanisms for preventi<strong>on</strong> <strong>of</strong>, and redress for:(a) Any acti<strong>on</strong> which has <strong>the</strong> aim or effect <strong>of</strong> depriving <strong>the</strong>m <strong>of</strong> <strong>the</strong>ir integrity as distinct peoples,or <strong>of</strong> <strong>the</strong>ir cultural values or ethnic identities;(b) Any acti<strong>on</strong> which has <strong>the</strong> aim or effect <strong>of</strong> dispossessing <strong>the</strong>m <strong>of</strong> <strong>the</strong>ir lands, territories orresources;(c) Any form <strong>of</strong> forced populati<strong>on</strong> transfer which has <strong>the</strong> aim or effect <strong>of</strong> violating or underminingany <strong>of</strong> <strong>the</strong>ir rights;(d) Any form <strong>of</strong> forced assimilati<strong>on</strong> or integrati<strong>on</strong>;(e) Any form <strong>of</strong> propaganda designed to promote or incite racial or ethnic discriminati<strong>on</strong> directedagainst <strong>the</strong>m.Article 9<strong>Indigenous</strong> peoples and individuals have <strong>the</strong> right to bel<strong>on</strong>g to an indigenous community ornati<strong>on</strong>, in accordance with <strong>the</strong> traditi<strong>on</strong>s and customs <strong>of</strong> <strong>the</strong> community or nati<strong>on</strong> c<strong>on</strong>cerned. Nodiscriminati<strong>on</strong> <strong>of</strong> any kind may arise from <strong>the</strong> exercise <strong>of</strong> such a right.

No relocati<strong>on</strong>shall take place without <strong>the</strong> free, prior and informed c<strong>on</strong>sent <strong>of</strong> <strong>the</strong> indigenous peoples c<strong>on</strong>cernedand after agreement <strong>on</strong> just and fair compensati<strong>on</strong> and, where possible, with <strong>the</strong> opti<strong>on</strong> <strong>of</strong> return.Article 111. <strong>Indigenous</strong> peoples have <strong>the</strong> right to practise and revitalize <strong>the</strong>ir cultural traditi<strong>on</strong>s and customs.This includes <strong>the</strong> right to maintain, protect and develop <strong>the</strong> past, present and future manifestati<strong>on</strong>s<strong>of</strong> <strong>the</strong>ir cultures, such as archaeological and historical sites, artefacts, designs, cerem<strong>on</strong>ies,technologies and visual and performing arts and literature.2. States shall provide redress through effective mechanisms, which may include restituti<strong>on</strong>,developed in c<strong>on</strong>juncti<strong>on</strong> with indigenous peoples, with respect to <strong>the</strong>ir cultural, intellectual,religious and spiritual property taken without <strong>the</strong>ir free, prior and informed c<strong>on</strong>sent or in violati<strong>on</strong><strong>of</strong> <strong>the</strong>ir laws, traditi<strong>on</strong>s and customs.Article 121. <strong>Indigenous</strong> peoples have <strong>the</strong> right to manifest, practise, develop and teach <strong>the</strong>ir spiritual andreligious traditi<strong>on</strong>s, customs and cerem<strong>on</strong>ies; <strong>the</strong> right to maintain, protect, and have access inprivacy to <strong>the</strong>ir religious and cultural sites; <strong>the</strong> right to <strong>the</strong> use and c<strong>on</strong>trol <strong>of</strong> <strong>the</strong>ir cerem<strong>on</strong>ialobjects; and <strong>the</strong> right to <strong>the</strong> repatriati<strong>on</strong> <strong>of</strong> <strong>the</strong>ir human remains.2. States shall seek to enable <strong>the</strong> access and/or repatriati<strong>on</strong> <strong>of</strong> cerem<strong>on</strong>ial objects and humanremains in <strong>the</strong>ir possessi<strong>on</strong> through fair, transparent and effective mechanisms developed inc<strong>on</strong>juncti<strong>on</strong> with indigenous peoples c<strong>on</strong>cerned.Article 131. <strong>Indigenous</strong> peoples have <strong>the</strong> right to revitalize, use, develop and transmit to future generati<strong>on</strong>s<strong>the</strong>ir histories, languages, oral traditi<strong>on</strong>s, philosophies, writing systems and literatures, and todesignate and retain <strong>the</strong>ir own names for communities, places and pers<strong>on</strong>s.2. States shall take effective measures to ensure that this right is protected and also to ensure thatindigenous peoples can understand and be understood in political, legal and administrativeproceedings, where necessary through <strong>the</strong> provisi<strong>on</strong> <strong>of</strong> interpretati<strong>on</strong> or by o<strong>the</strong>r appropriatemeans.Article 141. <strong>Indigenous</strong> peoples have <strong>the</strong> right to establish and c<strong>on</strong>trol <strong>the</strong>ir educati<strong>on</strong>al systems andinstituti<strong>on</strong>s providing educati<strong>on</strong> in <strong>the</strong>ir own languages, in a manner appropriate to <strong>the</strong>ir culturalmethods <strong>of</strong> teaching and learning.2. <strong>Indigenous</strong> individuals, particularly children, have <strong>the</strong> right to all levels and forms <strong>of</strong> educati<strong>on</strong><strong>of</strong> <strong>the</strong> State without discriminati<strong>on</strong>.3. States shall, in c<strong>on</strong>juncti<strong>on</strong> with indigenous peoples, take effective measures, in order forindigenous individuals, particularly children, including those living outside <strong>the</strong>ir communities, tohave access, when possible, to an educati<strong>on</strong> in <strong>the</strong>ir own culture and provided in <strong>the</strong>ir ownlanguage.Article 151. <strong>Indigenous</strong> peoples have <strong>the</strong> right to <strong>the</strong> dignity and diversity <strong>of</strong> <strong>the</strong>ir cultures, traditi<strong>on</strong>s,histories and aspirati<strong>on</strong>s which shall be appropriately reflected in educati<strong>on</strong> and publicinformati<strong>on</strong>.2. States shall take effective measures, in c<strong>on</strong>sultati<strong>on</strong> and cooperati<strong>on</strong> with <strong>the</strong> indigenouspeoples c<strong>on</strong>cerned, to combat prejudice and eliminate discriminati<strong>on</strong> and to promote tolerance,understanding and good relati<strong>on</strong>s am<strong>on</strong>g indigenous peoples and all o<strong>the</strong>r segments <strong>of</strong> society.Article 161. <strong>Indigenous</strong> peoples have <strong>the</strong> right to establish <strong>the</strong>ir own media in <strong>the</strong>ir own languages and tohave access to all forms <strong>of</strong> n<strong>on</strong>-indigenous media without discriminati<strong>on</strong>.

States shall take effective measures to ensure that State-owned media duly reflect indigenouscultural diversity. States, without prejudice to ensuring full freedom <strong>of</strong> expressi<strong>on</strong>, shouldencourage privately owned media to adequately reflect indigenous cultural diversity.Article 171. <strong>Indigenous</strong> individuals and peoples have <strong>the</strong> right to enjoy fully all rights established underapplicable internati<strong>on</strong>al and domestic labour law.2. States shall in c<strong>on</strong>sultati<strong>on</strong> and cooperati<strong>on</strong> with indigenous peoples take specific measures toprotect indigenous children from ec<strong>on</strong>omic exploitati<strong>on</strong> and from performing any work that islikely to be hazardous or to interfere with <strong>the</strong> child’s educati<strong>on</strong>, or to be harmful to <strong>the</strong> child’shealth or physical, mental, spiritual, moral or social development, taking into account <strong>the</strong>ir specialvulnerability and <strong>the</strong> importance <strong>of</strong> educati<strong>on</strong> for <strong>the</strong>ir empowerment.3. <strong>Indigenous</strong> individuals have <strong>the</strong> right not to be subjected to any discriminatory c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong>labour and, inter alia, employment or salary.Article 18<strong>Indigenous</strong> peoples have <strong>the</strong> right to participate in decisi<strong>on</strong>-making in matters which would affect<strong>the</strong>ir rights, through representatives chosen by <strong>the</strong>mselves in accordance with <strong>the</strong>ir ownprocedures, as well as to maintain and develop <strong>the</strong>ir own indigenous decisi<strong>on</strong>-making instituti<strong>on</strong>s.Article 19States shall c<strong>on</strong>sult and cooperate in good faith with <strong>the</strong> indigenous peoples c<strong>on</strong>cerned through<strong>the</strong>ir own representative instituti<strong>on</strong>s in order to obtain <strong>the</strong>ir free, prior and informed c<strong>on</strong>sentbefore adopting and implementing legislative or administrative measures that may affect <strong>the</strong>m.Article 201. <strong>Indigenous</strong> peoples have <strong>the</strong> right to maintain and develop <strong>the</strong>ir political, ec<strong>on</strong>omic and socialsystems or instituti<strong>on</strong>s, to be secure in <strong>the</strong> enjoyment <strong>of</strong> <strong>the</strong>ir own means <strong>of</strong> subsistence anddevelopment, and to engage freely in all <strong>the</strong>ir traditi<strong>on</strong>al and o<strong>the</strong>r ec<strong>on</strong>omic activities.2. <strong>Indigenous</strong> peoples deprived <strong>of</strong> <strong>the</strong>ir means <strong>of</strong> subsistence and development are entitled to justand fair redress.Article 211. <strong>Indigenous</strong> peoples have <strong>the</strong> right, without discriminati<strong>on</strong>, to <strong>the</strong> improvement <strong>of</strong> <strong>the</strong>irec<strong>on</strong>omic and social c<strong>on</strong>diti<strong>on</strong>s, including, inter alia, in <strong>the</strong> areas <strong>of</strong> educati<strong>on</strong>, employment,vocati<strong>on</strong>al training and retraining, housing, sanitati<strong>on</strong>, health and social security.2. States shall take effective measures and, where appropriate, special measures to ensurec<strong>on</strong>tinuing improvement <strong>of</strong> <strong>the</strong>ir ec<strong>on</strong>omic and social c<strong>on</strong>diti<strong>on</strong>s. Particular attenti<strong>on</strong> shall be paidto <strong>the</strong> rights and special needs <strong>of</strong> indigenous elders, women, youth, children and pers<strong>on</strong>s withdisabilities.Article 221. Particular attenti<strong>on</strong> shall be paid to <strong>the</strong> rights and special needs <strong>of</strong> indigenous elders, women,youth, children and pers<strong>on</strong>s with disabilities in <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> this <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g>.2. States shall take measures, in c<strong>on</strong>juncti<strong>on</strong> with indigenous peoples, to ensure that indigenouswomen and children enjoy <strong>the</strong> full protecti<strong>on</strong> and guarantees against all forms <strong>of</strong> violence anddiscriminati<strong>on</strong>.Article 23<strong>Indigenous</strong> peoples have <strong>the</strong> right to determine and develop priorities and strategies for exercising<strong>the</strong>ir right to development. In particular, indigenous peoples have <strong>the</strong> right to be actively involvedin developing and determining health, housing and o<strong>the</strong>r ec<strong>on</strong>omic and social programmesaffecting <strong>the</strong>m and, as far as possible, to administer such programmes through <strong>the</strong>ir owninstituti<strong>on</strong>s.


<str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>Rights</strong> <strong>of</strong> <strong>Indigenous</strong> <strong>Peoples</strong>http://www.un.org/esa/socdev/unpfii/en/drip.htmlPage 6 <strong>of</strong> 922/10/2010Article 241. <strong>Indigenous</strong> peoples have <strong>the</strong> right to <strong>the</strong>ir traditi<strong>on</strong>al medicines and to maintain <strong>the</strong>ir healthpractices, including <strong>the</strong> c<strong>on</strong>servati<strong>on</strong> <strong>of</strong> <strong>the</strong>ir vital medicinal plants, animals and minerals.<strong>Indigenous</strong> individuals also have <strong>the</strong> right to access, without any discriminati<strong>on</strong>, to all social andhealth services.2. <strong>Indigenous</strong> individuals have an equal right to <strong>the</strong> enjoyment <strong>of</strong> <strong>the</strong> highest attainable standard <strong>of</strong>physical and mental health. States shall take <strong>the</strong> necessary steps with a view to achievingprogressively <strong>the</strong> full realizati<strong>on</strong> <strong>of</strong> this right.Article 25<strong>Indigenous</strong> peoples have <strong>the</strong> right to maintain and streng<strong>the</strong>n <strong>the</strong>ir distinctive spiritual relati<strong>on</strong>shipwith <strong>the</strong>ir traditi<strong>on</strong>ally owned or o<strong>the</strong>rwise occupied and used lands, territories, waters and coastalseas and o<strong>the</strong>r resources and to uphold <strong>the</strong>ir resp<strong>on</strong>sibilities to future generati<strong>on</strong>s in this regard.Article 261. <strong>Indigenous</strong> peoples have <strong>the</strong> right to <strong>the</strong> lands, territories and resources which <strong>the</strong>y havetraditi<strong>on</strong>ally owned, occupied or o<strong>the</strong>rwise used or acquired.2. <strong>Indigenous</strong> peoples have <strong>the</strong> right to own, use, develop and c<strong>on</strong>trol <strong>the</strong> lands, territories andresources that <strong>the</strong>y possess by reas<strong>on</strong> <strong>of</strong> traditi<strong>on</strong>al ownership or o<strong>the</strong>r traditi<strong>on</strong>al occupati<strong>on</strong> oruse, as well as those which <strong>the</strong>y have o<strong>the</strong>rwise acquired.3. States shall give legal recogniti<strong>on</strong> and protecti<strong>on</strong> to <strong>the</strong>se lands, territories and resources. Suchrecogniti<strong>on</strong> shall be c<strong>on</strong>ducted with due respect to <strong>the</strong> customs, traditi<strong>on</strong>s and land tenure systems<strong>of</strong> <strong>the</strong> indigenous peoples c<strong>on</strong>cerned.Article 27States shall establish and implement, in c<strong>on</strong>juncti<strong>on</strong> with indigenous peoples c<strong>on</strong>cerned, a fair,independent, impartial, open and transparent process, giving due recogniti<strong>on</strong> to indigenouspeoples’ laws, traditi<strong>on</strong>s, customs and land tenure systems, to recognize and adjudicate <strong>the</strong> rights<strong>of</strong> indigenous peoples pertaining to <strong>the</strong>ir lands, territories and resources, including those whichwere traditi<strong>on</strong>ally owned or o<strong>the</strong>rwise occupied or used. <strong>Indigenous</strong> peoples shall have <strong>the</strong> right toparticipate in this process.Article 281. <strong>Indigenous</strong> peoples have <strong>the</strong> right to redress, by means that can include restituti<strong>on</strong> or, when thisis not possible, just, fair and equitable compensati<strong>on</strong>, for <strong>the</strong> lands, territories and resources which<strong>the</strong>y have traditi<strong>on</strong>ally owned or o<strong>the</strong>rwise occupied or used, and which have been c<strong>on</strong>fiscated,taken, occupied, used or damaged without <strong>the</strong>ir free, prior and informed c<strong>on</strong>sent.2. Unless o<strong>the</strong>rwise freely agreed up<strong>on</strong> by <strong>the</strong> peoples c<strong>on</strong>cerned, compensati<strong>on</strong> shall take <strong>the</strong>form <strong>of</strong> lands, territories and resources equal in quality, size and legal status or <strong>of</strong> m<strong>on</strong>etarycompensati<strong>on</strong> or o<strong>the</strong>r appropriate redress.Article 291. <strong>Indigenous</strong> peoples have <strong>the</strong> right to <strong>the</strong> c<strong>on</strong>servati<strong>on</strong> and protecti<strong>on</strong> <strong>of</strong> <strong>the</strong> envir<strong>on</strong>ment and <strong>the</strong>productive capacity <strong>of</strong> <strong>the</strong>ir lands or territories and resources. States shall establish and implementassistance programmes for indigenous peoples for such c<strong>on</strong>servati<strong>on</strong> and protecti<strong>on</strong>, withoutdiscriminati<strong>on</strong>.2. States shall take effective measures to ensure that no storage or disposal <strong>of</strong> hazardous materialsshall take place in <strong>the</strong> lands or territories <strong>of</strong> indigenous peoples without <strong>the</strong>ir free, prior andinformed c<strong>on</strong>sent.3. States shall also take effective measures to ensure, as needed, that programmes for m<strong>on</strong>itoring,maintaining and restoring <strong>the</strong> health <strong>of</strong> indigenous peoples, as developed and implemented by <strong>the</strong>peoples affected by such materials, are duly implemented.Article 301. Military activities shall not take place in <strong>the</strong> lands or territories <strong>of</strong> indigenous peoples, unless

States shall undertake effective c<strong>on</strong>sultati<strong>on</strong>s with <strong>the</strong> indigenous peoples c<strong>on</strong>cerned, throughappropriate procedures and in particular through <strong>the</strong>ir representative instituti<strong>on</strong>s, prior to using<strong>the</strong>ir lands or territories for military activities.Article 311. <strong>Indigenous</strong> peoples have <strong>the</strong> right to maintain, c<strong>on</strong>trol, protect and develop <strong>the</strong>ir culturalheritage, traditi<strong>on</strong>al knowledge and traditi<strong>on</strong>al cultural expressi<strong>on</strong>s, as well as <strong>the</strong> manifestati<strong>on</strong>s<strong>of</strong> <strong>the</strong>ir sciences, technologies and cultures, including human and genetic resources, seeds,medicines, knowledge <strong>of</strong> <strong>the</strong> properties <strong>of</strong> fauna and flora, oral traditi<strong>on</strong>s, literatures, designs,sports and traditi<strong>on</strong>al games and visual and performing arts. They also have <strong>the</strong> right to maintain,c<strong>on</strong>trol, protect and develop <strong>the</strong>ir intellectual property over such cultural heritage, traditi<strong>on</strong>alknowledge, and traditi<strong>on</strong>al cultural expressi<strong>on</strong>s.2. In c<strong>on</strong>juncti<strong>on</strong> with indigenous peoples, States shall take effective measures to recognize andprotect <strong>the</strong> exercise <strong>of</strong> <strong>the</strong>se rights.Article 321. <strong>Indigenous</strong> peoples have <strong>the</strong> right to determine and develop priorities and strategies for <strong>the</strong>development or use <strong>of</strong> <strong>the</strong>ir lands or territories and o<strong>the</strong>r resources.2. States shall c<strong>on</strong>sult and cooperate in good faith with <strong>the</strong> indigenous peoples c<strong>on</strong>cerned through<strong>the</strong>ir own representative instituti<strong>on</strong>s in order to obtain <strong>the</strong>ir free and informed c<strong>on</strong>sent prior to <strong>the</strong>approval <strong>of</strong> any project affecting <strong>the</strong>ir lands or territories and o<strong>the</strong>r resources, particularly inc<strong>on</strong>necti<strong>on</strong> with <strong>the</strong> development, utilizati<strong>on</strong> or exploitati<strong>on</strong> <strong>of</strong> mineral, water or o<strong>the</strong>r resources.3. States shall provide effective mechanisms for just and fair redress for any such activities, andappropriate measures shall be taken to mitigate adverse envir<strong>on</strong>mental, ec<strong>on</strong>omic, social, culturalor spiritual impact.Article 331. <strong>Indigenous</strong> peoples have <strong>the</strong> right to determine <strong>the</strong>ir own identity or membership in accordancewith <strong>the</strong>ir customs and traditi<strong>on</strong>s. This does not impair <strong>the</strong> right <strong>of</strong> indigenous individuals toobtain citizenship <strong>of</strong> <strong>the</strong> States in which <strong>the</strong>y live.2. <strong>Indigenous</strong> peoples have <strong>the</strong> right to determine <strong>the</strong> structures and to select <strong>the</strong> membership <strong>of</strong><strong>the</strong>ir instituti<strong>on</strong>s in accordance with <strong>the</strong>ir own procedures.Article 34<strong>Indigenous</strong> peoples have <strong>the</strong> right to promote, develop and maintain <strong>the</strong>ir instituti<strong>on</strong>al structuresand <strong>the</strong>ir distinctive customs, spirituality, traditi<strong>on</strong>s, procedures, practices and, in <strong>the</strong> cases where<strong>the</strong>y exist, juridical systems or customs, in accordance with internati<strong>on</strong>al human rights standards.Article 35<strong>Indigenous</strong> peoples have <strong>the</strong> right to determine <strong>the</strong> resp<strong>on</strong>sibilities <strong>of</strong> individuals to <strong>the</strong>ircommunities.Article 361. <strong>Indigenous</strong> peoples, in particular those divided by internati<strong>on</strong>al borders, have <strong>the</strong> right tomaintain and develop c<strong>on</strong>tacts, relati<strong>on</strong>s and cooperati<strong>on</strong>, including activities for spiritual,cultural, political, ec<strong>on</strong>omic and social purposes, with <strong>the</strong>ir own members as well as o<strong>the</strong>r peoplesacross borders.2. States, in c<strong>on</strong>sultati<strong>on</strong> and cooperati<strong>on</strong> with indigenous peoples, shall take effective measures t<strong>of</strong>acilitate <strong>the</strong> exercise and ensure <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> this right.Article 371. <strong>Indigenous</strong> peoples have <strong>the</strong> right to <strong>the</strong> recogniti<strong>on</strong>, observance and enforcement <strong>of</strong> treaties,agreements and o<strong>the</strong>r c<strong>on</strong>structive arrangements c<strong>on</strong>cluded with States or <strong>the</strong>ir successors and to

Nothing in this <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> may be interpreted as diminishing or eliminating <strong>the</strong> rights <strong>of</strong>indigenous peoples c<strong>on</strong>tained in treaties, agreements and o<strong>the</strong>r c<strong>on</strong>structive arrangements.Article 38States in c<strong>on</strong>sultati<strong>on</strong> and cooperati<strong>on</strong> with indigenous peoples, shall take <strong>the</strong> appropriatemeasures, including legislative measures, to achieve <strong>the</strong> ends <strong>of</strong> this <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g>.Article 39<strong>Indigenous</strong> peoples have <strong>the</strong> right to have access to financial and technical assistance from Statesand through internati<strong>on</strong>al cooperati<strong>on</strong>, for <strong>the</strong> enjoyment <strong>of</strong> <strong>the</strong> rights c<strong>on</strong>tained in this<str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g>.Article 40<strong>Indigenous</strong> peoples have <strong>the</strong> right to access to and prompt decisi<strong>on</strong> through just and fairprocedures for <strong>the</strong> resoluti<strong>on</strong> <strong>of</strong> c<strong>on</strong>flicts and disputes with States or o<strong>the</strong>r parties, as well as toeffective remedies for all infringements <strong>of</strong> <strong>the</strong>ir individual and collective rights. Such a decisi<strong>on</strong>shall give due c<strong>on</strong>siderati<strong>on</strong> to <strong>the</strong> customs, traditi<strong>on</strong>s, rules and legal systems <strong>of</strong> <strong>the</strong> indigenouspeoples c<strong>on</strong>cerned and internati<strong>on</strong>al human rights.Article 41The organs and specialized agencies <strong>of</strong> <strong>the</strong> <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> system and o<strong>the</strong>r intergovernmentalorganizati<strong>on</strong>s shall c<strong>on</strong>tribute to <strong>the</strong> full realizati<strong>on</strong> <strong>of</strong> <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> this <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> through<strong>the</strong> mobilizati<strong>on</strong>, inter alia, <strong>of</strong> financial cooperati<strong>on</strong> and technical assistance. Ways and means <strong>of</strong>ensuring participati<strong>on</strong> <strong>of</strong> indigenous peoples <strong>on</strong> issues affecting <strong>the</strong>m shall be established.Article 42The <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g>, its bodies, including <strong>the</strong> Permanent Forum <strong>on</strong> <strong>Indigenous</strong> Issues, andspecialized agencies, including at <strong>the</strong> country level, and States shall promote respect for and fullapplicati<strong>on</strong> <strong>of</strong> <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> this <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> and follow up <strong>the</strong> effectiveness <strong>of</strong> this<str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g>.Article 43The rights recognized herein c<strong>on</strong>stitute <strong>the</strong> minimum standards for <strong>the</strong> survival, dignity and wellbeing<strong>of</strong> <strong>the</strong> indigenous peoples <strong>of</strong> <strong>the</strong> world.Article 44All <strong>the</strong> rights and freedoms recognized herein are equally guaranteed to male and femaleindigenous individuals.Article 45Nothing in this <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> may be c<strong>on</strong>strued as diminishing or extinguishing <strong>the</strong> rightsindigenous peoples have now or may acquire in <strong>the</strong> future.Article 461. Nothing in this <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> may be interpreted as implying for any State, people, group orpers<strong>on</strong> any right to engage in any activity or to perform any act c<strong>on</strong>trary to <strong>the</strong> Charter <strong>of</strong> <strong>the</strong><str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> or c<strong>on</strong>strued as authorizing or encouraging any acti<strong>on</strong> which would dismember orimpair, totally or in part, <strong>the</strong> territorial integrity or political unity <strong>of</strong> sovereign and independentStates.2. In <strong>the</strong> exercise <strong>of</strong> <strong>the</strong> rights enunciated in <strong>the</strong> present <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g>, human rights andfundamental freedoms <strong>of</strong> all shall be respected. The exercise <strong>of</strong> <strong>the</strong> rights set forth in this<str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> shall be subject <strong>on</strong>ly to such limitati<strong>on</strong>s as are determined by law and in accordancewith internati<strong>on</strong>al human rights obligati<strong>on</strong>s. Any such limitati<strong>on</strong>s shall be n<strong>on</strong>-discriminatory andstrictly necessary solely for <strong>the</strong> purpose <strong>of</strong> securing due recogniti<strong>on</strong> and respect for <strong>the</strong> rights andfreedoms <strong>of</strong> o<strong>the</strong>rs and for meeting <strong>the</strong> just and most compelling requirements <strong>of</strong> a democratic
