Details ofthis warranty are given below.NOTE:<strong>JABIRU</strong>’S LIMITED, EXPRESS WARRANTY IS EXCLUSIVE, EXPRESSLY GIVEN <strong>AND</strong>HAS BEEN ACCEPTED IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED,ORAL OR WRITTEN, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OFMERCHANTABILITY, FITNESS <strong>FOR</strong> A PARTICULAR PURPOSE, OR OTHERWARRANTIES IMPLIED IN LAW. THERE ARE NO WARRANTIES WHICH EXTENDBEYOND THAT WHICH IS DESCRIBED IN <strong>JABIRU</strong>’S LIMITED, EXPRESS WARRANTY.Jabiru Aircraft Pty Ltd, hereinafter <strong>JABIRU</strong> warrants that it will make good without charge,any defect which appears in this engine.Provided:1. The defect has been notified in writing to <strong>JABIRU</strong>:i) Before the engine has operated a total of 200 hours or,ii) Within twelve (12) months of the date of delivery of the engine to the firstretail purchaser.Whichever comes first, and2. The engine has been delivered to a <strong>JABIRU</strong> Approved Service Centre or such otherservice facility as advised by <strong>JABIRU</strong>, and3. the engine has been installed in an aircraft type in accordance with a <strong>JABIRU</strong>approved installation system, and4. The engine has been updated in accordance with <strong>JABIRU</strong> Service Bulletins beforeoperation, and5. The engine has been stored in accordance with the Engine Preservation instruction inthe Jabiru Instruction & Maintenance Manual, and6. <strong>JABIRU</strong> has determined that the defect complained of is one of workmanship and isnot caused by:i) Misuse or abuse of the engine such as by operation outside the approvedFlight Manual, or Maintenance and Operation Manual, etc, or by neglectii) Improper installation, including overheating.iii) Operation of the engine after it is known to be defectiveiv) Accident or deliberate actv) Atmospheric fallout or flood, hail, salt, wind, etc.vi) Failure to carry out proper maintenance servicevii) Use of incorrect types and/or grades of fuel, oil or lubricantsviii) Alteration or modification of the engine by any party not authorised in writingby <strong>JABIRU</strong>ix) The fitting of parts or accessories not marketed by <strong>JABIRU</strong>This document is controlled while it remains on the Jabiru server.
