It is only an <strong>of</strong>fenceto fail to comply with a Police <strong>of</strong>fi cer‘s requirements.VariationA variation is a material change to a premises licence and would include an increasein the capacity <strong>of</strong> the premises, a change in the hours <strong>of</strong> operation <strong>of</strong> the premises, achange to the way the premises is to operate in regard to the Operating Schedule or arequest to vary an existing condition attached to the premises licence. Policies relatingto variations do not apply to applications to change the name or address <strong>of</strong> someonenamed in the licence or an application to vary the licence to specify a new individualas the designated premises supervisor.VesselsA vessel (which includes a ship or a boat or a barge) that is permanently mooredor berthed is regarded as a “premises” situated at that place. The Act also appliesin relation to a vessel which is not permanently moored or berthed as if it werepremises situated at the place where it is usually moored or berthed. The relevant<strong>Licensing</strong> Authority is the <strong>Licensing</strong> Authority for the area in which it is usually mooredor berthed. An activity is not a licensable activity if it takes place aboard a vesselengaged on an international voyage. The Secretary <strong>of</strong> State for Transport representedby the Maritime and Coastguard Agency is the lead responsible authority for vesselswith regard to public safety, including fi re safety, and issues affecting passengervessels. Merchant Shipping legislation does not, however, apply to permanentlymoored vessels, for example, restaurant ships moored on the Thames Embankment.In relation to a vessel, but no other premises, responsible authorities also includethe navigation authorities that have statutory functions in relation to the waters wherethe vessel is usually moored or berthed or any waters where it is proposed to benavigated at a time when it is used for licensable activities.94
