Reasons for Policy NS12.5.54 Premises providing sex related entertainment are likely to constitute a public nuisanceif they are• in or near residential areas• in other areas which are not already associated with entertainment• particularly if they are close to schools, places of worship and communityfacilities.Their clientele sometimes arrive and depart in large groups. Premises offering sexrelated entertainment have a cumulative effect particularly if they are clusteredtogether. This is irrespective of any visual displays that indicate the type ofentertainment on offer, which if judged to be indecent can be regulated by IndecentDisplays Act 1981. Many of these premises are not classifi ed as sex establishmentsby virtue of them providing regulated entertainment or late night refreshmentauthorised under the Licensing Act 2003, which specifi cally exempts them fromthe legal requirement for a sex establishment licence under the Local GovernmentMiscellaneous Provisions Act 1982. The council has consulted Visit London, theoffi cial visitor organisation for London, on their views on expansion in the number ofpremises offering sex related entertainment. It has advised that if the balance and mixof uses in areas such as Soho, were to change and become more dominated by sexrelated entertainment this could deter visitors and have a negative impact overall.2.5.55 There are specifi c concerns over some aspects of crime and disorder and publicnuisance that have associated with some poorly run premises offering this typeof entertainment. These arise from lewd acts and disorder on the premises andprostitution, touting and ”clipping” around and associated with the premises.2.5.56 This policy has therefore been designed to restrict further growth of this form ofentertainment, and to ensure that where it is permitted it promotes the licensingobjectives and has suffi cient conditions attached to ensure the premises are managedsatisfactorily. The council as the Licensing Authority, and the police, are concernedthat nudity or partial nudity does not become incidental to the operation of licensedpremises such as pubs and bars on either a permanent or occasional basis. TheLicensing Authority would expect that any proposals for such entertainment oroperation at any time should be identifi ed in the operating schedule. In general theLicensing Authority will not consider that nudity is part of the normal operation of apub, bar or restaurant and will require that the premises where such entertainmentor operation is proposed benefi ts from an appropriate planning permission or other76
lawful planning use. The proper regulation of sex related entertainment requires arange of conditions to be imposed and supervised by the Licensing Authority and thespecialist units of the police. The specialist resources to do this are limited and suchnecessary regulation cannot be operated if sex related entertainment is provided onan incidental or casual basis or in a great number of premises.Conditions2.5.57 If nudity or partial nudity forms part of the entertainment (eg striptease, pole or lapdancing), or is part of the operation of the premises (eg topless or fetish bars andclubs), the Licensing Authority will attach conditions to any such premises licence itmay grant to promote the licensing objectives. These will include conditions relating to• the exclusion of persons under 18 at all times from premises where these activitiestake place• the prevention of views into the premises• prohibiting exterior advertising of the sex related entertainment at the premises• the leafl eting or touting for business.Conditions will be imposed requiring that all service is to seated customers; prohibitingthe participation of customers in performances and maintaining a minimum distanceof one metre between performers and customers, and between performers duringperformance. This is to ensure that it can be easily observed that no touching, or otheracts that would constitute disorder, take place. There will also be conditions on theinstallation and operation of CCTV and retaining recordings of performances and onthe employment of supervisors. The Licensing Authority may attach other conditionsas appropriate.2.5.58 To prevent the proliferation of such premises, applications for premises which providemusic, dancing and late night refreshment, that do not specify that there will notbe any adult entertainment, services or other entertainment which may give rise toconcern in respect of children in the relevant part of the application (currently Box N onpage 13 of the application form will), be asked to accept a “no nudity” condition.77
