Introduction/definitions2.5.46 Casinos are licensed for the sale <strong>of</strong> alcohol and since 2002 are no longer prohibitedfrom serving drinks at gaming areas. However, they must ensure they are providedin a way which does not disturb or threaten the orderly conduct <strong>of</strong> the gaming. Therestrictions on live entertainment in casinos were removed by the Gaming Clubs<strong>Licensing</strong> Amendment Regulations 2002 (SI No 1910/2002), which came into forceon 12 August 2002. They are no longer prohibited from providing entertainment butdo so as ancillary to the gaming and as a private place <strong>of</strong> entertainment. Casinos nolonger have to be private clubs since the provisions <strong>of</strong> the Gambling Act 2005 cameinto effect on 1 September 2007. The requirements for identity checks at casinos hasled many casinos to continue to operate membership schemes. Casinos have soughtpremises licences for the sale <strong>of</strong> alcohol and regulated entertainment alongside thelicences they need for gaming and gambling.There are, at the time <strong>of</strong> writing thisreport, 20 casinos in <strong>Westminster</strong>. A number <strong>of</strong> proposals for additional casinos havebeen granted by the council as a Planning Authority. The licensing magistrates willultimately determine all these applications under provisions <strong>of</strong> the Gambling Act 1968.2.5.47 Proposals for new style casinos under the Gambling Act 2005 can only be submittedfor 17 sites identifi ed by the Casino Advisory Panel and approved by the Parliamentfor the initial period <strong>of</strong> the operation <strong>of</strong> the Gambling Act 2005. <strong>Westminster</strong> was notidentifi ed and Parliament has not approved any sites.2.5.48 The hours for casino gambling are set by way <strong>of</strong> default conditions on convertedlicences to be midday until 06:00 everyday <strong>of</strong> the week. However casinos can seeklonger hours by application for a premises licence under the Gambling Act 2005. Theprovision <strong>of</strong> regulated entertainment and the sale <strong>of</strong> alcohol late night refreshment,and hours for these activities are separately regulated under the <strong>Licensing</strong> Act 2003.Casinos<strong>Policy</strong> CAS1The inclusion <strong>of</strong> regulated entertainment and extension <strong>of</strong> the hours for the sale <strong>of</strong>alcohol ancillary to the playing <strong>of</strong> casino games in casinos, will be considered inrelation to the likely effect on the licensing objectives.70
