premises would be likely to give rise to public nuisance and crime and disorder. Thiswould take into account the extent <strong>of</strong> activities, the operation <strong>of</strong> plant and equipmentand the proximity <strong>of</strong> residential property. If there are representations made, conditionsmay be imposed that the sale <strong>of</strong> alcohol in restaurants later than core hours must beas part <strong>of</strong> the continuing service and consumption <strong>of</strong> a table meal at the same table.This is in order to ensure that restaurants continue to function as restaurants andnot as late-night bars. When considering applications the sale <strong>of</strong> alcohol after 01:00,when representations are made on the grounds <strong>of</strong> prevention <strong>of</strong> crime and disorderor public nuisance, the council will take into account the increased likelihood <strong>of</strong> crimeand disorder and the greater disturbance from activities late at night, It will particularlynote the higher incidence <strong>of</strong> reports <strong>of</strong> crime associated with premises that areopen after 01:00 as indicated by the analysis <strong>of</strong> crime reports <strong>of</strong> violence by types <strong>of</strong>premises and by time <strong>of</strong> last sale <strong>of</strong> alcohol included in Appendix 12.2.3.9 Premises where regulated entertainment is provided to a seated audience (egcinemas and theatres) provide a diverse range <strong>of</strong> cultural and entertainment facilitiesand are attended by a mix <strong>of</strong> age groups. They generally have little association withcrime and disorder or public nuisance. Because <strong>of</strong> this, these types <strong>of</strong> premiseswill be given the opportunity to operate more fl exibly late at night. Any relevantrepresentations received and the availability <strong>of</strong> transport will be matters for carefulconsideration.2.3.10 In the past qualifying clubs have had little association with crime and disorder orpublic nuisance. Through their membership requirements, they exert a degree <strong>of</strong>control over behaviour in and around their premises. Any relevant representationsreceived and the availability <strong>of</strong> transport will also be matters for careful consideration.Non-standard hours2.3.11 In order to have conditions that are clear and enforceable the circumstances in whichthe non-standard hours will apply must be identifi able This is to give an opportunityfor representations to be made in relation to particular events and in order to providepredictability as to when non-standard hours will apply for the benefi t <strong>of</strong> those whomay be affected.
