2.3 HoursIntroduction/definitions2.3.1 This policy applies to all types of premises licences and club premises certifi cates. Itshould be noted that the Operating Schedules must specify both the hours in whichpremises are open to customers and the hours when licensable activities are takingplace. Under Policy PN1 hours when servicing refuse and recycling collections maytake place may also be subject to conditions.2.3.2 The council as a Licensing Authority is not proposing to set fi xed closing times forparticular areas as urged against in Government‘s revised Guidance (paragraph13.57). It is the intention to generally grant licences or variations to licences wherethe hours proposed are within the ‘core hours’ as set out in Policy HRS1. This is not apolicy to refuse applications for hours longer than the core hours. Where a proposalis made to operate outside these core hours each application will be considered onits merits against the criteria as set out in paragraphs (ii) to (iv) below as suggested inrevised Guidance (paragraph 13.40 ). In common with the rest of the city, in the StressAreas variations of hours within the core hours under Policy HRS1 will generally begranted.Hours(i)(ii)Policy HRS1Applications for hours within the core hours set out below in this policy willgenerally be granted, subject to not being contrary to other policies in theStatement of Licensing Policy.Applications for hours outside the core hours set out below in this policy will beconsidered on their merits, subject to other relevant policies and with particularregard to the following:Criteriaa) The demonstration of compliance with relevant criteria in policies CD1, PS1,PN1 associated with the likelihood of the effect of the grant of a licencefor later or earlier hours on crime and disorder, public safety and publicnuisance.b) Whether there is residential accommodation in the proximity of the premisesthat would be likely to be adversely affected by premises being open orcarrying out operations at the hours proposed.36
(v)(vi)c) The proposed hours of the licensable activities and when customers will bepermitted to remain on the premises.d) The proposed hours when any music, including incidental music, will beplayed.e) The hours when customers will be allowed to take food or drink outside thepremises or be within open areas which form part of the premises.f) The existing hours of licensable activities and the past operation of thepremises (if any) and hours of licensable premises in the vicinity.g) Whether customers and staff have adequate access to public transportwhen arriving at and leaving the premises, especially at night.h) The capacity of the premises.i) The type of use: recognising that premises that sell alcohol, play music fordancing, provide late night refreshment or take-away food, are more likely tobe associated with crime and disorder and public nuisance than restaurants,theatres, cinemas, other performance venues or qualifying clubs.(j) The Licensing Authority will take into account the active measuresproposed for a ‘winding down’ period including arrangements for people tobe collected from the premises to travel home safely.(k) Conditions on hours may be attached that require that the supply of alcoholfor consumption on the premises ceases a suitable period of time beforecustomers are required to leave the premises.The council acting as the Licensing Authority may reduce hours if, after review,it is necessary to impose conditions specifying shorter hours in order topromote the licensing objectives.Specifi c days for non-standard hours should be identifi ed and justifi ed aspart of the application to allow responsible authorities and interested partiesto evaluate the impact that these licensable activities may have, and toplan accordingly. The consideration of applications for later hours for BankHoliday Mondays will take into account that later hours are generally grantedfor preceding Sundays and that the next day is a working day. Non specifi cdays are expected to be covered by Temporary Event Notices or variationapplications.37
